Guidelines for Article 3, Article 7, and Article 8 of Decree No. 88/2001/ND-CP dated 21/11/2001 of the Government on the implementation of universal secondary education
On November 22, 2001, the Government issued Decree No. 88/2001/ND-CP on the implementation of universal secondary education. The Ministry of Education and Training provides detailed guidelines for Article 3, Article 7, and Article 8 of Decree No. 88/2001/ND-CP as follows:
I. TERMINOLOGY EXPLANATION
1. In this Circular, the object of universal secondary education shall be referred to as the target group.
2. Some terms defined in Decree No. 88/2001/ND-CP are understood as follows:
a) Target groups with special difficulties are those belonging to poor households as defined in Decision No. 1143/2000/QĐ-BLĐTBXH dated November 1, 2000, of the Ministry of Labor, Invalids, and Social Affairs.
b) Particularly difficult communes are those listed in Decision No. 1232/QĐ-TTg dated December 24, 1999, of the Prime Minister, supplemented by Decision No. 647/2000/QĐ-TTg dated July 12, 2000, and Decision No. 02/2001/QĐ-TTg dated March 26, 2001.
II. ENROLLMENT OF TARGET GROUPS IN LOWER SECONDARY SCHOOLS
1. All students who have completed primary school shall be admitted to lower secondary schools located in communes, wards, towns, or clusters of communes, wards where they have permanent residence registration or long-term temporary residence registration (six months or more).
2. In addition to the responsibility of admitting those with permanent or long-term temporary residence registration, if the number of students per class does not exceed the limit set by the Ministry of Education and Training, public lower secondary schools may admit target groups from outside the commune, ward, or town where the school is located according to the regulations of the People's Committee of the district, city district, or town within the province.
3. Target groups exceeding the age stipulated in the regulation for admission to grade 6 of public lower secondary schools shall be admitted to study at the district-level center for continuing education or non-formal secondary education classes according to the non-formal education method prescribed by the management authority of the district or county.
4. Procedures for admitting target groups to public lower secondary schools shall be carried out in accordance with the Charter of Lower Secondary Schools.
III. UNIVERSAL LOWER SECONDARY EDUCATION THROUGH NON-FORMAL METHODS
1. Target groups without conditions to study through formal education methods have the right and obligation to attend non-formal secondary education classes.
2. Non-formal learning forms for these target groups include:
Daytime classes, five sessions per week organized at centers for continuing education, secondary vocational schools, or non-formal secondary education classes at secondary schools.
Evening classes, outside working hours, organized for those who work during the day.
Intensive short-term classes organized for target groups living in clusters with special living and working conditions such as fishermen in fishing villages, river areas, or on the sea, or in highland communes, particularly difficult communes, or workers on shift systems.
8. Teaching of target groups for universal lower secondary education through non-formal education methods shall follow the supplementary secondary education curriculum issued together with Decision No. 48/2002/QĐ-BGDĐT dated November 27, 2002, of the Minister of Education and Training.
4. Locations for organizing learning activities: at centers for continuing education, secondary vocational schools, and non-formal secondary education classes opened at industrial, agricultural, forestry, fishery enterprises, agencies, organizations, or community clusters.
5. Target groups with particularly difficult economic circumstances shall not pay tuition fees or construction costs for schools and classes; they shall receive educational supplies subsidies; and they shall be provided free of charge or lent one set of textbooks for their current grade. Target groups studying grade 9 preparing for graduation exams in supplementary secondary education shall be provided an additional set of review materials.
6. Procedures for admitting and transferring target groups studying supplementary secondary education are as follows:
a) Target groups studying supplementary secondary education must record their names and submit applications and academic records (if available) at centers for continuing education, schools, or classes for supplementary education.
If target groups do not have academic records, the Department of Education and Training shall organize examinations in two subjects: Vietnamese language and mathematics. Based on the examination results, the Director of the Department of Education and Training shall issue a permit to study in the corresponding class. This permit serves as a basis to replace academic records in the application for supplementary secondary education graduation exams. Those without a primary school graduation certificate must take an exam to obtain a supplementary primary school graduation certificate at the end of the year.
b) Target groups studying supplementary secondary education wishing to transfer schools must submit a transfer request form and can only transfer when the receiving school agrees to accept them.
7. The allocation of teachers to teach in supplementary secondary education classes must meet the standards specified in the Charter of Lower Secondary Schools.
8. Teachers teaching universal lower secondary education shall be compensated according to the following provisions:
For full-time teachers at centers for continuing education, hours exceeding the current standard quota shall be paid according to the overtime payment system stipulated in Joint Circular No. 17/TTLB-BLĐTBXH-BTC-BGDĐT dated July 27, 1995, of the Ministries of Labor, Invalids, and Social Affairs, Finance, and Education and Training regarding the guidance on the salary system for extra hours and class combination allowances in the education sector.
For part-time teachers and voluntary teachers participating in universal lower secondary education, all hours taught shall be paid according to the overtime payment system stipulated in Joint Circular No. 17/TTLB-BLĐTBXH-BTC-BGDĐT mentioned above.
Depending on specific local conditions, additional travel expenses or allowances may be provided to teachers required to teach in remote locations with difficult transportation conditions.
In mountainous districts, remote areas, islands, highlands, particularly difficult communes, if teachers must stay at the school to guide learners in study and life, during the time staying at the school, teachers shall enjoy allowances equivalent to those of teachers in boarding schools for ethnic minority students.
9. Funds for students and teachers shall be allocated from the universal secondary education funds of the localities.
Specific provisions on funding for universal secondary education shall be guided by the Ministry of Finance.
IV. IMPLEMENTATION
1. This Circular shall take effect fifteen days from the date of publication in the Official Gazette.
2. The Department of High School Education, the Department of Continuing Education, the Department of Planning and Finance, and related units under the Ministry shall be responsible for directing and guiding the Departments of Education and Training to implement Decree No. 88/2001/NĐ-CP dated November 22, 2001, and this Circular.
During the implementation process, if there are any difficulties, localities and institutions shall report them to the Ministry for consideration and timely amendment.
