CIRCULAR

Issuing the "Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam"

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production, business; Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and business;

Pursuant to the Law on Product Quality and Goods dated November 21, 2007; Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government stipulating state management of product quality and goods;

Pursuant to Decision No. 100/2008/QĐ-BNN dated October 15, 2008 of the Minister of Agriculture and Rural Development on regulations for fertilizer production, business, and use;

At the proposal of the Director of the Crop Production Department,

Article 1. Issued along with this Circular is the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam (Annex 1 attached), including 227 types, divided into:

1. Micronutrient fertilizers: 37 types;

2. Organic bio-fertilizers: 25 types;

3. Mineral organic fertilizers: 24 types;

4. Microbial organic fertilizers: 21 types;

5. Foliar fertilizers: 119 types;

6. Soil amendment materials: 01 type.

Article 2. Organizations and individuals are permitted to produce, trade, and use the types of fertilizers listed in this Supplementary List when they meet the conditions stipulated in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and business; stipulated in Clause 4, Article 1 of Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and business.

Article 3. This Circular shall take effect forty-five days from the date of issuance. The types of fertilizers listed in the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam (Annex 2 attached) shall be removed from the list from the date this Circular takes effect.

Article 4. The Director of the Office of the Ministry, the Director of the Crop Cultivation Department, the Director of the Science, Technology, and Environment Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities, heads of units, organizations, and individuals related to fertilizer production, business, and use in Vietnam are responsible for implementing this Circular./.
