CIRCULAR
Amending and supplementing some articles of Decision No. 06/2007/QĐ-BGTVT dated February 5, 2007 of the Ministry of Transport on the Civil Aviation Security Program
Pursuant to Decision No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decision No. 81/2010/NĐ-CP dated July 14, 2010 of the Government on Civil Aviation Security;
The Minister of Transport hereby promulgates the following:
Pursuant to Decree No. 83/2007/ND-CP dated May 25, 2007 of the Government on management and operation of civil airports and airfields;
Amending and supplementing some articles of Decision No. 06/2007/QĐ-BGTVT dated February 5, 2007 of the Ministry of Transport on the Civil Aviation Security Program as follows:
Article 1. 1. Supplement Article 4b as follows:
Article 4b:
“Procedures for approving the Civil Aviation Security Program of airport operators, airlines; contingency plans for aircraft in flight subject to unlawful interference by air navigation service providers; security regulations of air service providers. 1. The person requesting approval of the Civil Aviation Security Program of airports or airlines shall submit one set of documents directly or through postal services to the Vietnam Civil Aviation Authority for examination and approval. The documents include:
a) A request letter according to the model prescribed in Appendix II attached hereto;
b) The decision on issuing the Civil Aviation Security Program of the airport operator or airline (original copy).
2. Foreign airlines operating in Vietnam requesting approval of their Civil Aviation Security Programs shall submit two sets of documents (one set in Vietnamese and one set in English) directly or through postal services to the Vietnam Civil Aviation Authority for examination and approval. The documents include:
b) A certified copy of the approval decision issued by the competent authority in the country where the airline has its headquarters or main business location, along with the approved Civil Aviation Security Program.
b) The decision on issuing the Civil Aviation Security Program of the airport operator or airline (original copy).
3. Within twenty days from the date of establishment, the air navigation service provider shall submit to the Vietnam Civil Aviation Authority a contingency plan for aircraft in flight subject to unlawful interference for examination and approval. The person requesting approval of the contingency plan shall submit one set of documents directly or through postal services to the Vietnam Civil Aviation Authority for examination and approval. The documents include:
b) The decision on issuing the contingency plan for aircraft in flight subject to unlawful interference;
b) The decision on issuing the Civil Aviation Security Program of the airport operator or airline (original copy).
c) The contingency plan for aircraft in flight subject to unlawful interference.
4. The person requesting approval of the security regulations of air service providers shall submit one set of documents directly or through postal services to the Vietnam Civil Aviation Authority for examination and approval. The documents include:
b) The decision on issuing the security regulations of air service providers;
b) The decision on issuing the Civil Aviation Security Program of the airport operator or airline (original copy).
c) The security regulations of air service providers.
5. Within twenty working days from the date of receipt of complete documents as required by the person requesting examination and approval or acceptance of the Civil Aviation Security Program, contingency plan for aircraft in flight subject to unlawful interference, or security regulations, the Vietnam Civil Aviation Authority shall be responsible for examining the documents, organizing inspections, and issuing the approval decision.
The person requesting approval of the Civil Aviation Security Program, contingency plan for aircraft in flight subject to unlawful interference, or security regulations shall pay fees as prescribed by law.”
2. Amend Clause 1 and supplement Clause 14 of Article 9 as follows:
“1. Drafting the Civil Aviation Security Program of airport operators and submitting it to the Vietnam Civil Aviation Authority for examination; implementing the program after approval.
Airport operators must specify the principles for recruiting staff who regularly work in restricted areas of airports or participate in ensuring aviation security at airports when drafting the security program, in accordance with the conditions stipulated in Clause 4, Article 1 of this Circular.
14. Issuing new, replacing, or reissuing Civil Aviation Security Control Cards and Civil Aviation Security Control Permits for officers, employees, and equipment under the management and use of airport operators. Within five working days after issuing new, replacement, or reissued Civil Aviation Security Control Cards and Permits, the airport operator must notify and submit a list of officers, employees, and equipment according to the model prescribed in Appendix V attached hereto to the relevant Air Port Service Office.
3. Supplement Point c of Clause 3 of Article 14 as follows:
“c) Airport operators issue new, replace, or reissue Civil Aviation Security Control Cards and Permits for officers, employees, and equipment under their management and use.”
4. Amend Point b of Clause 1 of Article 17 as follows:

"b) Ensure that individuals with prior criminal records, probation, or currently serving sentences for the following offenses will not be issued Air Security Control Cards: particularly serious crimes including national security violations; terrorism-related crimes; drug-related crimes involving production, sale, possession, transportation, and use; illegal manufacture, sale, possession, transportation, and use of weapons and explosives; crimes infringing upon human life, health, dignity, and reputation; public disorder offenses and resistance against law enforcement officers; unlawful interference in civil aviation activities; other offenses such as theft, harboring stolen goods, embezzlement, forgery of documents, or fraudulent acts using forged documents that have not yet been fully remedied according to court judgments. This process shall be subject to regular inspection and supervision by the Civil Aviation Administration of Vietnam and relevant airport authorities."
5. Amend Article 19 as follows:
"Article 19. Procedures for Issuing, Reissuing Air Security Control Cards and Permits
1. Individuals applying for a new multiple-use Air Security Control Card for the subjects specified in Clause 4 of Article 1 of this Circular must submit one set of application documents directly or via postal service to the issuing authority. The application package includes:
a) A document from the applicant's organization or entity in accordance with the model prescribed in Appendix II attached to this Decision;
b) A certified copy of the document proving the legal status, functions, and responsibilities of the organization or entity, except for state management agencies. For non-airport and airline enterprises providing air services, they must also provide an Air Service Provision Permit issued by the Civil Aviation Administration of Vietnam and a Contract concluded with the airport enterprise; for enterprises representing foreign airlines on a long-term basis, they must also provide a Registration Certificate for Representation Contracts; for enterprises representing foreign airlines or aircraft operators entering Vietnam on a short-term basis or through power of attorney, they must also provide representation contracts or letters of authorization from the airline and a Business Registration Certificate with the business activity of representing merchants as stipulated by the Commercial Law; for enterprises operating tourism and travel services in Vietnam, they must also provide a Travel Agency Registration Certificate;
c) An application form for the Air Security Control Card in accordance with the model prescribed in Appendix I attached to this Decision, affixed with a color photograph measuring 4 x 6 cm, stamped with a cross-stamp, and confirmed by the head of the agency for state management entities; or confirmed by the Police Station or Village Police where the individual resides or based on the Criminal Record Certificate for other individuals;
d) An application form for the Air Security Control Card in accordance with the model prescribed in Appendix I attached to this Decision, affixed with a color photograph measuring 4 x 6 cm, and stamped with a cross-stamp;
e) Two color photographs measuring 4 x 6 cm (taken against a white background, not more than six months old as of the date of submission);
2. Individuals applying for a replacement multiple-use Air Security Control Card for the subjects specified in Clause 4 of Article 1 of this Circular must submit one set of application documents directly or via postal service to the issuing authority. The application package includes:
a) A document from the applicant's organization or entity in accordance with the model prescribed in Appendix II attached to this Decision;
b) An application form for the Air Security Control Card in accordance with the model prescribed in Appendix I attached to this Decision, affixed with a color photograph measuring 4 x 6 cm, stamped with a cross-stamp, and confirmed by the head of the agency for state management entities; or confirmed by the Police Station or Village Police where the individual resides or based on the Criminal Record Certificate for other individuals;
c) Two color photographs measuring 4 x 6 cm (taken against a white background, not more than six months old as of the date of submission);
d) In cases where the card is still valid but faded, torn, or lacks security features, the old card must be returned;
e) In cases of lost cards, an additional statement regarding the time, place, and cause of loss must be provided, confirmed by the Police Station or Village Police where the individual resides or where the incident occurred;
f) In cases of tampered or altered cards, an additional statement explaining the reasons for tampering or alteration and the old card must be submitted;
g) In cases where the card was revoked due to violations, an additional document detailing the violation handling results and the revocation request from the violation handling authority must be submitted.
3. Individuals applying for a new permit for vehicles meeting the conditions specified in Clause 5 of Article 17 of Decision No. 06/2007/QĐ-BGTVT dated February 5, 2007, issued by the Ministry of Transport on the Civil Aviation Security Program, must submit one set of application documents directly or via postal service to the issuing authority. The application package includes:
a) A document from the vehicle management organization in accordance with the model prescribed in Appendix II attached to this Decision;
b) A list of vehicles applying for permits in accordance with the model prescribed in Appendix IV attached to this Decision;
c) A certification of compliance with safety technical and environmental standards, still valid;
d) A certificate of completion of training courses on aircraft parking area safety for vehicle operators (except for vehicles serving special aircraft; vehicles transporting members of the Politburo, Central Committee members, ministers, provincial party secretaries, city party secretaries, and chairmen of provincial people's committees when entering the airfield operation must contact guide vehicles);
4. Individuals applying for a replacement permit for vehicles meeting the conditions specified in Clause 5 of Article 17 of Decision No. 06/2007/QĐ-BGTVT dated February 5, 2007, issued by the Ministry of Transport on the Civil Aviation Security Program, must submit one set of application documents directly or via postal service to the issuing authority. The application package includes:
a) A document from the vehicle management organization in accordance with the model prescribed in Appendix II attached to this Decision;
b) A list of vehicles applying for permits in accordance with the model prescribed in Appendix IV attached to this Decision;
c) A certification of compliance with safety technical and environmental standards, still valid;
d) Certificate of completion of the aircraft parking area safety course for vehicle operators when changing vehicle operators in new issuance (except in cases of issuance for vehicles serving special aircraft; vehicles transporting members of the Politburo, Central Committee members, ministers, provincial party secretaries, city party secretaries, and chairpersons of provincial and centrally-administered city people's committees upon entering operational areas must contact escort vehicles);
đ) A permit that is still valid but blurred, torn, or damaged;
e) In case of loss of the permit, an additional statement explaining the reason for the loss of the permit must be provided;
g) In case the permit is revoked due to violation, an additional document detailing the results of the violation handling by the competent authority must be provided;
5. Receiving applications:
a) After receiving the application, the issuing authority shall conduct an examination of the application. If the received application is incomplete or does not comply with regulations, within three working days from the date of receipt of the application, the issuing authority must directly notify or provide a written notice to the requesting agency or unit, specifying the reasons;
b) At the place where the card and permit are issued, the regulations on application materials and the procedures for issuing air transport security cards and permits, as well as notifications of the results of processing applications for cards, must be posted;
6. Examination and approval of applications for cards and permits.
a) Within ten working days from the date of receipt of a complete application as prescribed, the issuing authority is responsible for examining the application, determining the conditions for issuing the card or permit, the validity period, restricted areas, and airports permitted, approving, printing, and issuing the card or permit. The result must be notified directly or through postal service to the requesting agency or unit;
b) In case the equipment for issuing cards and permits malfunctions, the issuance of cards will depend on the actual ability to repair the equipment;
7. The requesting agencies or units for cards and permits are responsible for reviewing, recalling, and handing over to the issuing unit those cases where the cards are still valid but the users are no longer working in the restricted areas listed on the cards;
8. Procedures for issuing single-use air transport security cards and permits.
a) Issuance of Cards: Individuals applying for a card submit their application directly to the issuing authority. One person may represent multiple individuals in the same group to submit an application for a card;
The application for a single-use card includes: a request letter according to the model specified in Appendix II attached to this Decision, accompanied by a list according to the model specified in Appendix III attached to this Decision; the applicant must present one of the following valid identification documents: ID card; diplomatic identity card; passport; multiple-use air transport security card or internal security card. The issuing authority examines the application, assesses the necessity, assigns accompanying personnel, or notifies the air transport security force or the management unit of the restricted area to coordinate with security staff for supervision and security requirements;
b) Issuance of Permits: the organization or unit applying for a permit for a vehicle sends a representative to submit the application directly to the issuing authority;
The application for a permit includes: a request letter according to the model specified in Appendix II attached to this Decision, a list of vehicles according to the model specified in Appendix IV attached to this Decision; driver's license of the vehicle operator; if the vehicle operator does not have an air transport security card, they simultaneously submit an application for a single-use card for the vehicle operator. The issuing authority examines the application, evaluates the necessity, and requests the applying organization to contact the airport operator to arrange escort vehicles and ensure security requirements when the vehicle operates in restricted areas at the airport;
c) Within thirty minutes from the time of receiving the application, the issuing authority must examine and approve the issuance of the card or permit or notify the reason for not issuing the card or permit to the applicant.";
6. Supplement five Appendices as follows:
"1. Appendix I: Individual Application Form (for individuals belonging to state agencies, organizations, and enterprises; individuals not belonging to state agencies, organizations, and enterprises; foreigners).
2. Appendix II: Request Letter Model.
3. Appendix III: List Model of Staff Members Applying for Cards Proposed by the Organization.
4. Appendix IV: List Model of Vehicles Applying for Permits Proposed by the Organization.
5. Appendix V: List Model of Staff Members and Equipment Provided by the Airport Operator to be Submitted to the Civil Aviation Authority after Issuing Cards and Permits.";
Article 2. Implementation
1. This Circular takes effect 45 days from the date of signature.
2. The Director of the Ministry's Office, the Inspector General, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
