Detailed regulations on standards, procedures, and processes for examining and recognizing "Commune Meeting New Rural Cultural Standards"

Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Based on Decision No. 491/QĐ-TTg dated April 16, 2009 of the Prime Minister promulgating the National Criteria for Building New Rural Areas;

Based on Decision No. 22/QĐ-TTg dated January 5, 2010 of the Prime Minister approving the Project "Developing Rural Culture until 2015 with Orientation to 2020";

Based on Decision No. 800/QĐ-TTg dated June 4, 2010 of the Prime Minister approving the Target Program on Building New Rural Areas from 2010 to 2020;

Based on Decision No. 1610/QĐ-TTg dated September 16, 2011 of the Prime Minister approving the Implementation Program of the Movement "All People United to Build a Civilized Rural Life" from 2011 to 2015, with orientation to 2020,

The Ministry of Culture, Sports and Tourism provides detailed regulations on standards, procedures, and processes for examining and recognizing "Commune Meeting New Rural Cultural Standards", as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of regulation and applicable subjects

Article 1. This Circular specifies detailed regulations on standards, procedures, and processes for examining and recognizing "Commune Meeting New Rural Cultural Standards".

a) Communes throughout the country implementing the National Target Program on Building New Rural Areas;

b) Agencies, organizations, and individuals related to the procedures and processes for examining and recognizing "Commune Meeting New Rural Cultural Standards".

Article 2. Principles for Examining and Recognizing "Commune Meeting New Rural Cultural Standards"

1. "Commune Meeting New Rural Cultural Standards" is a commune that meets the cultural standards for new rural areas as stipulated in this Circular.

2. The cultural standards for new rural areas specified in this Circular serve as the basis for localities to guide and implement cultural criteria in the National Criteria for Building New Rural Areas and criteria for developing rural culture linked to building new rural areas.

3. The recognition of "Commune Meeting New Rural Cultural Standards" must ensure transparency, democracy, and compliance with regulations.

Article 3. Authority and Recognition Period

1. "Commune Meeting New Rural Cultural Standards" shall be recognized by the Chairman of the People's Committee of the district, town, or city directly under a province (hereinafter referred to collectively as the district level); it shall be conducted every two (02) years for the first recognition and every five (05) years for subsequent recognitions.

2. A unified model of the Certificate of Recognition for "Commune Meeting New Rural Cultural Standards", according to Model No. 01 and No. 02 in the Appendix promulgated together with this Circular.

Chapter II

SPECIFIC PROVISIONS

Article 4. Standards for "Commune Meeting New Rural Cultural Standards"

1. Helping Each Other Develop the Economy

a) Effectively implementing the campaign "Day for the Poor", contributing to eliminating poverty-stricken households; reducing the number of poor households in the commune below the provincial/city average;

b) At least eighty percent (80%) of households engaged in agriculture in the commune have been informed and educated about scientific and technological knowledge in agricultural production;

c) At least seventy percent (70%) of households participate in various forms of economic cooperation;

d) There are many activities promoting production and business development, attracting labor employment, and increasing people's income.

2. Improving the Quality of Building Cultural Families; Cultural Villages, Hamlets, and Equivalent Units

a) At least sixty percent (60%) of families have been recognized as "Cultural Family" for three years or more;

b) At least seventy percent (70%) of households have improved their miscellaneous gardens, not leaving land idle, ensuring green, clean, and beautiful living spaces;

c) At least fifteen percent (15%) of households have developed their economy, increased their income from producing agricultural goods and rural services;

d) At least fifty percent (50%) of villages, hamlets, ấp, bản, and equivalent units have been recognized and maintained the title of "Village of Culture", "Hamlet of Culture", " Ấp of Culture", "Bản of Culture", and equivalents continuously for five years or more;

đ) At least fifty percent (50%) of cultural villages, hamlets, ấp, bản, and equivalent units have mobilized the people to contribute to building and upgrading economic, cultural, and social infrastructure in the community.

3. Building Cultural and Sports Institutions and Movements at the Grassroots Level

a) The Cultural-Sports Center of the commune has adequate facilities and equipment, stable organization, regular and effective operations, gradually meeting the standards set by the Ministry of Culture, Sports and Tourism;

b) One hundred percent (100%) of villages (hamlets, ấp, bản, and equivalents) have Cultural Houses-Sports Areas, of which fifty percent (50%) meet the standards set by the Ministry of Culture, Sports and Tourism;

c) One hundred percent (100%) of villages (hamlets, ấp, bản, and equivalents) maintain club activities, cultural and artistic movements, and mass sports. The commune organizes annual folk art festivals and sports competitions;

d) Historical and cultural relics, natural landscapes are protected; traditional cultural activities and local customs are preserved.

4. Building Civilized Lifestyles and a Cultural Environment in Rural Areas

a) At least seventy-five percent (75%) of households comply with civilized lifestyle regulations regarding weddings, funerals, and festivals as stipulated by the Ministry of Culture, Sports and Tourism;

b) Building and effectively implementing civilized lifestyles in public places, collective activities, and communities; no social evils arise, existing social evils significantly decrease;

c) One hundred percent (100%) of villages (hamlets, ấp, bản, and equivalents) have cleaning teams, regularly sweeping and collecting waste to designated locations. The commune effectively organizes centralized waste disposal according to environmental standards; communal cemeteries and village cemeteries are built and managed according to planning;

d) Achieving quality and effectiveness in implementing movements such as "All People United to Build a Civilized Rural Life"; crime prevention; maintaining social security; repaying kindness; humanitarianism; traffic safety; and other rural cultural-social movements.

5. Adhering to Party Policies, State Laws, and Local Regulations

a) At least ninety percent (90%) of residents are informed and strictly follow Party policies, state laws, and local regulations;

b) At least eighty percent (80%) of farmer households participate in the movement to build new rural areas; participating in constructing new rural economic and social infrastructure;

c) One hundred percent (100%) of villages (hamlets, ấp, bản, and equivalents) establish and effectively implement community agreements and grassroots democratic regulations; there are no large-scale illegal protests.

d) Cultural service, information, sports, and tourism business establishments shall be constructed in accordance with planning and managed under the law; they shall not store or circulate harmful cultural products.

Article 5. Procedures for examination and recognition of "Rural Cultural Standard Village"

1. Registration, examination, and recognition procedures:

a) The County Steering Committee for the "All People United to Build a Cultural Life" Movement organizes a ceremony to launch the construction of "Rural Cultural Standard Village" within its jurisdiction; disseminates the recognition standards for "Rural Cultural Standard Village"; guides communes in registering to build "Rural Cultural Standard Village";

b) The Chairman of the Commune Steering Committee for the "All People United to Build a Cultural Life" Movement registers to build "Rural Cultural Standard Village" with the County People's Committee;

c) The Commune Steering Committee for the "All People United to Build a Cultural Life" Movement convenes a meeting to approve the report on achievements in building "Rural Cultural Standard Village", and sends it to the Commune People's Committee;

d) The Chairman of the Commune People's Committee proposes that the Chairman of the County People's Committee recognize "Rural Cultural Standard Village";

đ) The County Steering Committee for the "All People United to Build a Cultural Life" Movement inspects and evaluates the results of implementing the recognition standards for "Rural Cultural Standard Village" (with inspection records);

e) The Culture and Information Office at the county level coordinates with the commendation and reward department at the same level, presenting the Chairman of the County People's Committee with a decision to recognize, re-recognize, and issue a Certificate of Recognition for "Rural Cultural Standard Village".

2. Conditions for recognition:

a) Meeting the standards stipulated in Article 4 of this Circular and additional criteria prescribed by the provincial or centrally-administered city People's Committees (if applicable);

b) A registration period for building "Rural Cultural Standard Village" of two (02) years or more (for initial recognition); five (05) years or more (for re-recognition).

3. Recognition procedures:

a) Achievement reports on building "Rural Cultural Standard Village" from the Chairman of the Commune Steering Committee for the "All People United to Build a Cultural Life" Movement, confirmed by the Chairman of the Commune People's Committee:

- Report for two (02) years (initial recognition);

- Report for five (05) years (re-recognition);

b) A letter requesting recognition from the Chairman of the Commune People's Committee;

One (01) set of application files must be submitted directly to the County People's Committee.

Processing time is five working days from the date of receipt of complete and valid files;

Based on the application file and the inspection and evaluation record of the County Steering Committee regarding the implementation of the "Rural Cultural Standard Village" recognition standards, the Chairman of the County People's Committee issues a decision to recognize "Rural Cultural Standard Village", accompanied by a Certificate of Recognition; if not recognized, a written response must be provided to the Commune People's Committee, specifying the reasons for non-recognition.

Article 6. Awards

"Rural Cultural Standard Village" may be considered and awarded by the Chairman of the County People's Committee; the level of award is determined by each locality based on budget capacity and socialized resources.

Chapter III

IMPLEMENTATION

Article 7. Responsibility for Implementation

1. Based on this Circular, the People's Committees of provinces and centrally-administered cities may supplement additional criteria or specify achievement levels for criteria as appropriate to local conditions, but these shall not be lower than those specified in this Circular.

2. Provincial/Municipal Departments of Culture, Sports, and Tourism shall cooperate with district-level People's Committees to implement this Circular;

3. Based on annual assessment and inspection results, communes violating the provisions of this Circular will not be re-recognized; serious violators will have their Certificates of Recognition revoked by the Chairman of the County People's Committee.

Article 8. Implementation clause

1. This Circular takes effect forty-five (45) days from the date of issuance.

2. During implementation, if any issues arise or difficulties occur, please reflect them to the Ministry of Culture, Sports and Tourism for study, supplementation, and appropriate revision./.
