Circular No. 17/2016/TT-BCT amends and supplements Article 10 of Circular No. 31/2012/TTLT-BCT-KHĐT dated October 10, 2012 guiding the handling of industrial clusters formed before the Industrial Cluster Management Regulation attached to Decision No. 105/2009/QĐ-TTg dated August 19, 2009 of the Government came into effect.

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decision No. 105/2009/QĐ-TTg dated August 19, 2009 of the Prime Minister promulgating the Industrial Cluster Management Regulation;

Pursuant to the unified opinion of the Ministry of Planning and Investment at document No. 4733/BKHĐT-QLKKT dated June 17, 2016;

At the proposal of the Director of the Department of Local Industry,

The Minister of Industry and Trade issues this Circular to amend and supplement Circular No. 31/2012/TTLT-BCT-KHĐT dated October 10, 2012 guiding the handling of industrial clusters formed before the Industrial Cluster Management Regulation accompanying Decision No. 105/2009/QĐ-TTg dated August 19, 2009 of the Prime Minister took effect.

Article 1. Amending Clause 2 and supplementing Clause 3 of Article 10 of Circular No. 31/2012/TTLT-BCT-KHĐT dated October 10, 2012 guiding the handling of industrial clusters formed before the Industrial Cluster Management Regulation accompanying Decision No. 105/2009/QĐ-TTg dated August 19, 2009 of the Prime Minister (referred to as the Regulation) took effect as follows:

"Article 10. Time limit for handling industrial clusters formed before the Regulation took effect

2. The deadline for completing the handling of industrial clusters formed before the Regulation took effect shall be no later than December 31, 2017.

3. After December 31, 2017, the handling of industrial clusters formed before the Regulation took effect shall be applied as if they were industrial clusters formed after the Regulation took effect."

Article 2. Effective Date

This Circular takes effect from the date of issuance./.
