CIRCULAR
DETAIL REGULATIONS ON PROCEDURES AND PROCEDURAL REQUIREMENTS FOR REGISTRATION OF CONTENT INFORMATION SERVICES ON MOBILE TELECOMMUNICATION NETWORKS
Pursuant to the Law on Telecommunications dated November 23, 2009;
Pursuant to Decree No. 72/2013/NĐ-CP dated July 15, 2013 of the Government on management, provision, and use of Internet services and information on networks;
Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Article 1. Amending and supplementing some articles of Circular No. 19/2016/TT-BTTTT dated June 30, 2016 of the Minister of Information and Communications on forms for registration declaration, application for license, certificate, license, and business report as prescribed in Decree No. 06/2016/NĐ-CP dated January 18, 2016 of the Government on management, provision, and use of radio and television services.
The Minister of Information and Communications issues this Circular to provide detailed regulations on procedures and procedural requirements for registration of content information services on mobile telecommunications networks.
Article 1. Scope of Regulation and Applicability
1. This Circular stipulates the procedures and procedural requirements for registration of content information services on terrestrial mobile telecommunications networks in Vietnam (hereinafter referred to as content information services on mobile telecommunications networks), rights and obligations of organizations and enterprises providing content information services on mobile telecommunications networks, and mobile telecommunications enterprises.
2. This Circular applies to organizations and enterprises providing content information services on mobile telecommunications networks, and mobile telecommunications enterprises.
3. This Circular does not regulate activities of providing content information services to users on mobile telecommunications networks through comprehensive online information portals, social networks, video games, and advertising services on mobile telecommunications networks.
Article 3. General Provisions
Providing content information services on mobile telecommunications networks means that organizations and enterprises establish and use equipment systems in Vietnam and connect with mobile telecommunications enterprises to provide public information to service users through one of the following services:
1. Free call service as defined in this Circular is a mobile telecommunication network service used by agencies, organizations, and enterprises to provide content information services and are responsible for paying telecommunications charges on behalf of service users to telecommunications enterprises.
2. High-cost call service as defined in this Circular is a mobile telecommunication network service used by agencies, organizations, and enterprises to provide content information services and require service users, in addition to telecommunications charges as prescribed, to pay an additional charge to receive requested content information.
3. Short message application service as defined in Clause 17, Article 3 of the Telecommunications Number Planning Plan issued together with Circular No. 22/2014/TT-BTTTT dated December 22, 2014 of the Minister of Information and Communications.
4. Other telephone and messaging services on mobile telecommunications networks.
Article 3. Certificate of Registration for Content Information Services on Mobile Telecommunications Networks
1. The Certificate of Registration for Content Information Services on Mobile Telecommunications Networks includes the following basic information:
a) Information about the organization or enterprise;
b) Service provision method;
c) Information about the person responsible for the organization or enterprise before the law;
d) Effective date of the Certificate and obligations of the organization or enterprise after being granted the Certificate;
e) Other necessary information.
2. The model of the Certificate of Registration for Content Information Services is specified in Model No. 02 issued together with this Circular.
Article 4. Procedures for Registration of Content Information Services on Mobile Telecommunications Networks
1. Application dossier for registration of content information services.
Organizations and enterprises submit one set of the application dossier for registration of content information services on mobile telecommunications networks directly or via postal service to the Radio, Television, and Electronic Information Administration, including the following documents:
a) Application form for registration of content information services on mobile telecommunications networks according to Model No. 01 issued together with this Circular;
b) Certified copy (or copy accompanied by original for verification) of one of the following documents: Business Registration Certificate, Investment Certificate, Decision on Establishment (accompanied by a copy of the Charter of operation for associations and mass organizations), Press License with functions, tasks, and business fields of providing content information services on mobile telecommunications networks (enterprises send printed copies stamped with the enterprise's confirmation seal containing the enterprise's business fields announced on the National Enterprise Registration Portal).
2. Time limit and processing procedure for the dossier.
Within twenty (20) days from the date of receipt of a valid dossier, the Radio, Television, and Electronic Information Administration will examine and issue the Certificate of Registration for Content Information Services on Mobile Telecommunications Networks to the organization or enterprise.
Article 5. Amending and Supplementing the Certificate for Registration of Content Information Services on Mobile Telecommunication Networks
1. Organizations and enterprises must complete procedures to amend and supplement the certificate for registration of content information services that have been issued when changing the name of the organization or enterprise.
2. Organizations and enterprises are not required to perform procedures to amend and supplement the certificate for registration of content information services but must notify in writing to the Radio, Television, and Electronic Information Administration and the Department of Information and Communications at the locality where the enterprise has registered its headquarters at least 10 (ten) days before changing any of the following information:
a) Head office address;
b) The legal representative of the organization or enterprise;
c) Service provision methods.
3. Documents for Requesting Amendment and Supplement of the Certificate for Registration of Content Information Services
Organizations and enterprises shall submit one set of documents requesting amendment and supplement of the certificate for registration of content information services on mobile telecommunication networks directly or through postal service to the Radio, Television, and Electronic Information Administration, including the following documents:
a) A written request for amendment and supplement of the certificate for registration of content information services on mobile telecommunication networks according to Model No. 03 promulgated together with this Circular;
b) Relevant documents related to the changed information.
4. Time Limit and Processing Procedure for Documents
Within 10 (ten) days from the date of receiving valid documents, the Radio, Television, and Electronic Information Administration will consider issuing an amended and supplemented certificate for registration of content information services on mobile telecommunication networks according to Model No. 05 promulgated together with this Circular to organizations and enterprises.
Article 6. Reissuing the Certificate for Registration of Content Information Services on Mobile Telecommunication Networks
1. In case the certificate for registration of content information services on mobile telecommunication networks is lost, destroyed, damaged, or otherwise eliminated, the organization or enterprise must send a request for reissuance of the certificate for registration of content information services on mobile telecommunication networks directly or through postal service to the Radio, Television, and Electronic Information Administration. The request for reissuance of the certificate for registration of content information services on mobile telecommunication networks shall be carried out according to Model No. 04 promulgated together with this Circular.
2. Within 10 (ten) days from the date of receipt of the request, the Radio, Television, and Electronic Information Administration will issue a reissued certificate for registration of content information services on mobile telecommunication networks to the organization or enterprise.
3. The reissued certificate for registration of content information services on mobile telecommunication networks will be updated and supplemented with the changed information reported according to Clause 2 of Article 5 of this Circular.
Article 7. Rights and Obligations of Organizations and Enterprises Providing Content Information Services on Mobile Telecommunication Networks
1. Implement the rights and obligations stipulated in Article 28 of Decree No. 72/2013/ND-CP of the Government dated July 15, 2013 on Management, Provision, and Use of Internet Services and Information on Networks (hereinafter referred to as Decree No. 72/2013/ND-CP).
2. Develop and publicly announce agreements on the provision and use of content information services for users before providing the service in accordance with the provisions of Decree No. 72/2013/ND-CP.
3. For services provided periodically (daily, weekly, monthly, quarterly, annually, etc.), organizations and enterprises may only provide the service and extend the use of the service after obtaining confirmation of user agreement via text message, phone call, or other forms.
4. Ensure that users have the ability to refuse, cancel, and inquire about registered content information services through appropriate means without being charged (sending a text message to the service number, calling the customer support hotline, accessing the company's electronic information website, other forms).
5. Provide services in accordance with the requirements of the users who have registered; do not charge fees for content information services that users do not receive or receive incomplete or incorrect content information as advertised by the organization or enterprise.
6. When advertising content information services provided on mobile telecommunication networks and before starting or extending the provision of content information services to users, organizations and enterprises must inform users of at least the following information:
a) Tariff and billing method for content information services provided by the organization or enterprise;
b) Name or abbreviated name of the organization or enterprise providing content information services on mobile telecommunication networks;
c) Contact and support phone number;
d) Methods for registering, extending, canceling, and refusing to use the service.
7. Store provided content information for a minimum period of 90 (ninety) days from the date of provision; store data processing requests for registration, cessation of service provision, detailed tariffs, user complaints, and complaint resolution results from the date of receipt for a minimum period of 01 (one) year to serve inspection and supervision work as prescribed.
8. Prevent or remove content information violating the provisions of Article 5 of Decree No. 72/2013/ND-CP within 03 (three) hours from the time of request by competent state management agencies.
9. Notify the use of service provision codes and numbers to the Ministry of Information and Communications (Radio, Television, and Electronic Information Administration) within 10 (ten) days from the date of issuance, return, recovery, or change of service provision codes and numbers.
10. Implement reporting procedures as stipulated in Article 10 of this Circular.
Article 8. Rights and Obligations of Mobile Telecommunication Enterprises
1. Implement the rights and obligations prescribed in Article 29 of Decree No. 72/2013/NĐ-CP.
2. Temporarily suspend or disconnect from organizations and enterprises providing information content services that violate the provisions of Article 5 of Decree No. 72/2013/NĐ-CP within three (3) hours from the time of receiving a written request from the competent state agency.
3. Report to the Ministry of Information and Communications (via the email address of the Radio, Television and Electronic Information Department: [email protected]) within three (3) hours from the time of discovering that an enterprise providing information content services has provided information in violation of the provisions of Article 5 of Decree No. 72/2013/NĐ-CP.
4. Implement the reporting regime as stipulated in Article 10 of this Circular.
Article 9. Handling Complaints Regarding Provision of Information Content Services on Mobile Telecommunication Networks
1. Mobile telecommunication enterprises and organizations, enterprises providing information content services on mobile telecommunication networks shall have the obligation to organize the receipt of complaints from service users regarding information content services.
In case the mobile telecommunication enterprise is the main point of complaint reception, it must transfer the complaints of service users regarding information content services to the enterprise providing such services within twenty-four (24) hours from the time of receipt and be responsible for coordinating during the resolution process.
The main point of complaint reception regarding information content services from service users shall be responsible for responding and informing the results of the resolution to the service user.
Service users may lodge complaints about issues related to the provision of information content services on mobile telecommunication networks through the following forms: written, email, online hotline number, or directly at the organization or enterprise providing the service.
2. Organizations and enterprises providing information content services shall be responsible for primarily resolving complaints. In case of detecting improper charges for using information content services, the organization or enterprise providing such services must notify the mobile telecommunication enterprise to refund the improperly charged service fees to the service user within forty-eight (48) hours from the time of receiving the notification.
3. Time limit for lodging complaints: Not exceeding ninety (90) days from the date of completion of service provision.
4. Time limit for resolving complaints: Not exceeding fifteen (15) days from the date of receiving feedback or complaints.
5. In case the service user disagrees with the result of the complaint resolution by the organization or enterprise providing information content services, the service user has the right to initiate a civil lawsuit at the court in accordance with the provisions of the Civil Procedure Law.
Article 10. Reporting System
1. Organizations and enterprises providing information content services shall implement periodic reporting once a year and ad hoc reports upon request of the competent state management agency. The content, form of submission, and specific time for periodic reporting are as follows:
a) Content of the report according to Model No. 06 issued together with this Circular;
b) Time of submission: before December 15 each year;
c) Form of submission: submit directly or via postal service to the Radio, Television and Electronic Information Department and the Provincial Department of Information and Communications at the location where the enterprise has registered its principal office.
2. Organizations and mobile telecommunication enterprises shall implement periodic reporting once a year and ad hoc reports upon request of the competent state management agency. The content, form of submission, and specific time for periodic reporting are as follows:
a) Content of the report according to Model No. 07 issued together with this Circular;
b) Time of submission: before December 15 each year;
c) Form of submission: submit directly or use postal service to the Radio, Television and Electronic Information Department and the Provincial Department of Information and Communications at the location where the enterprise has registered its principal office.
Article 11. Effective Date
1. This Circular takes effect from August 12, 2016.
2. Within ninety (90) days from the date this Circular takes effect, organizations and enterprises currently providing information content services on mobile telecommunication networks must complete the registration procedures for providing information content services in accordance with this Circular.
3. During the implementation period, if any difficulties arise, organizations and enterprises are requested to promptly reflect them to the Ministry of Information and Communications for consideration and resolution./.
