CIRCULAR
REGARDING THE FREQUENCY CHANNEL PLANNING FOR FIXED AND MOBILE GROUND SERVICES IN THE 30-30000 MHZ BAND17/2017/ND-CPz
WHEREAS, the Law on Radio Frequency Spectrum dated November 23, 2009;
Decree No. 2013/QD-TTg dated February 17, 2017 of the Government detailing the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to Decision No. 71/ dated November 21, 2013, the Prime Minister issued the National Radio Frequency Spectrum Plan; dated January 17, 2017, the Prime Minister amended and supplemented the National Radio Frequency Spectrum Plan issued pursuant to Decision No.
Pursuant to Decision No. Decision No. 02/2017/QĐ-TTg dated November 21, 2013, of the Prime Minister; 71/ dated November 21, 2013, the Prime Minister issued the National Radio Frequency Spectrum Plan; The Minister of Information and Communications issues this Circular on the frequency channel planning for fixed and mobile ground services in the 30-30000 MHz band.
At the proposal of the Director of the Radio Frequency Management Department,
Article 1. Scope of Regulation and Subjects

1. This Circular plans the frequency channel allocation for fixed and mobile ground services in the 30-30000 MHz band (excluding cellular mobile communication systems with separate planning). in accordance with

2. This Circular applies to organizations and individuals managing, using, producing, importing, and trading radio equipment under fixed and mobile ground services in the 30-30000 MHz band (excluding cellular mobile communication systems) in Vietnam.

In this information, the following terms are understood as follows:

Article 2. Interpretation of Terms

Radio frequency channel (hereinafter referred to as channel)

1. is a band of radio frequencies defined by the width and center frequency of the channel or other characteristic parameters. Mobile Ground Service

2. is a radio communication service between fixed radio stations and mobile ground radio stations, or between mobile ground radio stations. Fixed Service

3. is a radio communication service between predetermined fixed points. Single-frequency transmission

4. is a mode of operation where two radio stations can transmit in one or two directions, but not simultaneously in both directions and only use one frequency channel. Dual-frequency transmission

5. is a mode of operation where transmissions between two radio stations use two frequency channels. Simplex is a mode of operation where transmission is carried out sequentially in each direction on one communication channel.

Duplex

7. is a mode of operation where transmission is carried out simultaneously in both directions on one communication channel. Half-duplex

8. is a mode of operation where simplex is applied at one end of the channel and duplex at the other end. VHF/UHF system

9. is a radio communication system within the fixed service operating in the frequency range above 30 MHz, utilizing tropospheric propagation and typically including one or more relay radio stations. Point-to-point communication (applicable to VHF/UHF)

10. is a communication link between two radio stations located at two predetermined fixed points. Point-to-multipoint communication (applicable to VHF/UHF)

11. are communication links between one radio station located at one fixed point and several radio stations located at other predetermined fixed points. Channelization

12. is the arrangement of channels within the same frequency band. Primary channelization

13. is channelization determined by basic parameters including the center frequency, the distance between adjacent channels, and the frequency separation. Secondary channelization

14. is additional channelization inserted between primary channels, with the center frequencies of secondary channels offset by half the distance between adjacent primary channels from the center frequencies of primary channels. Minimum transmission distance (applicable to VHF/UHF)

Article 3. Objectives of the Plan

1. Establishing order in the use of channels, unifying standards for radio frequency information systems, limiting harmful interference between devices, systems, and networks.

2. Guiding producers, importers, traders, and users in the production, importation, and investment in equipment, assisting management authorities in organizing the use of frequency bands and managing frequencies effectively and reasonably.

Article 4. Principles of the Plan

1. Adhering to the National Radio Frequency Spectrum Plan that has been approved by the Prime Minister and is currently in effect.

2. Based on channel allocation recommendations from the International Telecommunication Union (ITU) and regional telecommunications organizations.

3. Considering the current status of radio frequency usage in Vietnam, transitioning from the current status to the Plan with a phased approach.

4. Meeting the need for channel usage in the coming years and having the capability to incorporate new technologies.

Article 5. Content of the Plan

Channel allocation planning for Fixed and Mobile Ground Services in the 30-30000 MHz band, including the conditions for using frequency channels:

a) Channel allocation planning for Fixed and Mobile Ground Services in the 30-1000 MHz band as detailed in Appendix 1;

b) Channel allocation planning for Fixed and stock, Mobile Ground Services in the 1000-30000 MHz band as detailed in Appendix 2.

Article 6. Implementation Organization

1. The Radio Frequency Management Department shall ensure responsibility for disseminating and guiding the implementation of this Circular.

2. Organizations and individuals using radio frequency shall be responsible for using them according to the objectives, radio services, and conditions stipulated in this Circular and other laws regarding radio frequencies.

3. Organizations and individuals producing, importing, and trading in radio equipment shall be responsible for ensuring that the radio equipment meets the technical requirements suitable for radio services and the conditions stipulated in this Circular and other laws regarding radio frequencies.

Article 7. Implementation Provisions

1. This Circular takes effect from January 28, 2019, and replaces Circular No. 13/2013/TT-BTTTT dated June 14, 2013, issued by the Minister of Information and Communications on the Planning of Channel Allocation for Fixed and Mobile Ground Services in the 30-30000 MHz band.

2. The Director of the Office, the Director of the Radio Frequency Management Department, the Heads of agencies and units under the Ministry of Information and Communications, and domestic and foreign organizations and individuals operating, producing, importing, and trading in radio equipment for use in Vietnam shall assume responsibility for implementing this Circular.

3. In the course of implementation, if there are difficulties, organizations and individuals shall promptly report to the Ministry of Information and Communications (Radio Frequency Management Department) for guidance or review, amendment, and supplementation./.
