CIRCULAR

Regulations on statistical reporting system

for the agriculture and rural development sector

 

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government 02017 of the Government pursuant to the Law on Forestry dated November 15, 2017;

Pursuant to the Law on Statistics dated November 23, 2015;

Pursuant to Decree No. 94/2016/NĐ-CP dated July 1, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;

Pursuant to Decree No. 60/2018/NĐ-CP dated April 20, 2018 of the Government detailing the contents of the national statistical reporting system;

Pursuant to Decree No. 85/2017/NĐ-CP dated July 19, 2017 of the Government stipulating the structure, tasks, and powers of centralized statistical organizations and ministry-level statistical systems;

At the proposal of the Director of the Department of Planning;

The Minister of Agriculture and Rural Development promulgates this Circular regulating the statistical reporting system for the agriculture and rural development sector.

Article 1. Scope of Regulation

Article 1. This Circular regulates the statistical reporting system for the agriculture and rural development sector.

Clause 2. Statistical reporting on forestry shall be implemented in accordance with the provisions of Circular No. 12/2019/TT-BNNPTNT dated October 25, 2019 of the Minister of Agriculture and Rural Development regarding statistics in the forestry sector; statistical reports collected, compiled, and reported by the Forestry General Department shall comply with the provisions of this Circular.

Clause 3. Statistical reporting on losses caused by natural disasters shall be implemented in accordance with the provisions of Joint Circular No. 43/2015/TTLT-BNNPTNT-BKHĐT dated November 23, 2015 of the Minister of Agriculture and Rural Development and the Minister of Planning and Investment on guidelines for statistics and assessment of losses caused by natural disasters; statistical reports collected, compiled, and reported by the National Disaster Prevention and Control Center shall comply with the provisions of this Circular.

Article 2. Applicability

1. Agencies and units under the Ministry of Agriculture and Rural Development.

2. Departments of Agriculture and Rural Development of provinces and centrally governed cities.

3. Sub-departments and related public service organizations under the Departments of Agriculture and Rural Development.

4. Agricultural and Rural Development Offices or Economic Departments at districts, towns, and cities within provinces.

5. Other individuals and organizations related to statistical work in the agriculture and rural development sector.

Article 3. Contents of the statistical reporting system for the agriculture and rural development sector

Clause 1. The statistical reporting system for the agriculture and rural development sector is implemented to collect statistical information belonging to the national statistical index system assigned to the Ministry of Agriculture and Rural Development, the agricultural and rural development statistical index system, and other statistical information to serve management needs in the sector and field.

Clause 2. The statistical reporting system for the agriculture and rural development sector is detailed in Appendix I and Appendix II attached to this Circular.

Clause 3. Reporting units and receiving units are specifically recorded in the upper right corner of each statistical report form.

a) For nationwide-level statistical reports:

Reporting unit: Agencies and units under the Ministry of Agriculture and Rural Development; Departments of Agriculture and Rural Development.

Receiving unit: Information Technology and Statistics Center.

b) For provincial-level statistical reports:

Reporting unit: Sub-department or agency/unit tasked with managing the specialized field (at provincial level) for areas without a sub-department managing the specialized field that requires reporting.

Receiving unit: Relevant specialized management agencies under the Ministry of Agriculture and Rural Development; Departments of Agriculture and Rural Development.

c) For district-level:

Reporting unit: Agricultural and Rural Development Office or Economic Department at districts, towns, and cities within provinces.

Receiving unit: Department of Agriculture and Rural Development.

Clause 4. Statistical report forms

a) Statistical report forms (hereinafter referred to as report forms) specify: Report name, reporting period, reporting deadline, reporting unit, receiving unit, and report content. Report forms and explanations of report forms are detailed in Appendix II attached to this Circular;

b) The code of statistical report forms consists of a number part and a letter part. The number part includes two digits used to number report forms within each field, those report forms with letters (a, b, c, d...) next to their numbers are those with the same content but different classifications; the letter part following the number part includes two sections, the section before the slash (/) is the abbreviation of the field, the section after the slash is the abbreviation of the reporting period (month - T, quarter - Q, year - N, five years - 5N).

5. Reporting Period

The statistical reporting period is a specific time frame defined for statistical reporting entities to reflect their activities' results through statistical criteria in the statistical report forms. The reporting period is recorded in the middle of each report form and calculated according to the Gregorian calendar, including:

a) Monthly statistical reports: Calculated from the first day of the month until the last day of the month;

b) Quarterly statistical reports: Calculated from the first day of the first month of the quarter until the last day of the quarter;

c) Six-monthly statistical reports: Calculated from January 1st until June 30th;

d) Annual statistical reports: Calculated from January 1st until December 31st;

đ) Other statistical reports: Statistical reports with specific reporting periods and deadlines are specified in each report form;

e) Ad hoc statistical reports: In cases where ad hoc statistical reports are required to implement state management requirements of the Ministry of Agriculture and Rural Development, the requesting agency must submit a written request specifying the time, deadline, and specific statistical criteria.

6. Data Sources

a) Sources of data for collecting, compiling, and preparing report forms are specifically noted in the explanation section of each report form.

b) The collection of statistical information from various data sources is as follows:

For data sources from statistical surveys, the reporting unit is responsible for organizing and implementing statistical surveys, either independently or in collaboration with relevant agencies and units, to collect statistical information, compile, and report according to the prescribed report forms.

For data sources from agencies, units, organizations under the management of the agriculture and rural development sector or from agencies, units, organizations, and individuals responsible for reporting to authorized state agencies within the sector on production, business, and service provision results as prescribed by law, such agencies, units, organizations, and individuals shall be responsible for providing relevant statistical information to the reporting unit as required.

For data sources from agencies, units, organizations, and individuals not under the management of the agriculture and rural development sector, the reporting unit shall be responsible for contacting the agencies, units, organizations, and individuals managing those data sources to collect them according to current regulations.

7. Reporting Deadline

The reporting deadline is specifically noted in the upper left corner of each report form, below the form identification line. If the last day of the reporting period coincides with a public holiday, a Tet holiday, or a weekend, then the submission date for the report will be the next working day following the holiday or weekend.

8. Reporting Method

Reporting units shall submit reports through one of the following methods:

a) A paper report signed and stamped by the head of the reporting unit, or an electronic file authenticated by the digital signature of the head of the reporting unit;

b) Direct reporting on the Agricultural Statistics Information System webpage (hereinafter referred to as the Agricultural Statistics Information System), authenticated by an account registered by the representative of the reporting unit.

In case of technical issues with the data transmission network or software of the Agricultural Statistics Information System, reporting units shall send their reports via email or follow the guidance of the Computing and Statistics Center, and subsequently submit the report as stipulated in point a of Clause 8 of this Circular.

Article 4. Statistical Reporting Data

1. Statistical report data for the agriculture and rural development sector includes official, preliminary, and estimated figures as prescribed in Clauses 15, 16, and 17 of Article 3 of the Statistics Law 2015.

2. Statistical report data must fully, timely, and accurately reflect the operational situation of sectors under state management within the agriculture and rural development sector; serve the evaluation, forecasting, strategic planning, policy formulation, directive, and administrative functions of the Ministry of Agriculture and Rural Development and other state agencies; provide information and data according to national statistical reporting systems; meet requirements for exchanging, providing, and disseminating statistical information as prescribed by law.

3. In cases where reported data is revised or there are unusual fluctuations in the data during the reporting period, the reporting unit must submit a written explanation or an electronic file as required in point a of Clause 8 of this Circular to the receiving unit.

Article 5. Data and Information Utilization

1. Agencies, units directly under the Ministry of Agriculture and Rural Development, Departments of Agriculture and Rural Development, and agencies, units, organizations, and individuals participating in the management and implementation of agricultural and rural development statistical reporting are granted access, exploitation, and utilization rights to related statistical data and information.

2. The method of exploiting and utilizing statistical report data is carried out on the Agricultural Statistics Information System.

3. Agencies, units, organizations, and individuals permitted to exploit and utilize data and information related to published statistical information in the database are responsible for managing and using statistical information and data in accordance with the provisions of the Statistics Law.

Article 6. Application of Information Technology and Information Security in Agricultural Statistics and Rural Development

1. The Agricultural Statistics and Rural Development Information System shall be used for sending, receiving, exploiting statistical information and data in accordance with the reporting system of the agricultural sector and rural development. The system shall be constructed, managed, operated, and exploited to ensure smooth integration, exchange, and sharing of data in a timely manner and meet the standards for information security and safety as prescribed by law.

2. Statistical report data and related documents classified as state secrets or secrets of the agricultural sector and rural development must be managed and used in compliance with the laws on protecting state secrets and Article 57 of the Statistics Law 2015.

3. Individuals authorized to exploit statistical report data on the Agricultural Statistics and Rural Development Information System shall be responsible for complying with regulations on managing access passwords and securing information as prescribed by law and by the Ministry of Agriculture and Rural Development.

Article 7. Responsibility for Implementation

1. Department of Planning

a) Take the lead and coordinate with relevant agencies and units to organize the implementation, guidance, monitoring, inspection, and reporting on the implementation of this Circular;

b) Review the list and content of statistical report forms, propose amendments and supplements to the forms to suit the needs.

2. Center for Computing and Statistics

a) Serve as the focal point for guiding, monitoring, urging units to report according to the statistical reporting system; organize the receipt and timely update of electronic report forms into the Agricultural Statistics and Rural Development Information System; promptly provide feedback on the system regarding the status of sending and receiving electronic reports to reporting units; periodically compile and report statistics to serve the directives and management of the Ministry;

b) Take the lead and coordinate with relevant agencies and units to regularly establish, manage, store, provide, and publish comprehensive statistical data in accordance with the law and directives from the Minister of Agriculture and Rural Development;

c) Take the lead and coordinate with units under the Ministry of Agriculture and Rural Development to compile national-level statistical reports within the reporting system, and send them to the General Statistics Office as stipulated in Decree No. 60/2018/NĐ-CP dated April 20, 2018, of the Government detailing the content of the national-level statistical reporting system;

d) Upgrade, organize management, and develop operational and exploitation regulations for the Agricultural Statistics and Rural Development Information System;

đ) Aggregate and grant access rights to related statistical report forms and data for agencies, units, organizations, and individuals accessing and using the Agricultural Statistics and Rural Development Information System;

e) Handle issues related to sending and receiving statistical reports; record and back up logs of received reports from reporting units, and logs of form and data usage by agencies, units, organizations, and individuals. In case of data transmission or system failures, immediate measures must be taken to resolve the issue;

g) Organize training, guidance, and inspections on the implementation of the statistical reporting system as prescribed in this Circular;

h) Ensure information security and confidentiality in accordance with Clause 2 of Article 6 of this Circular.

b) Take the lead and coordinate with relevant agencies and units to regularly establish, manage, store, provide, and publish comprehensive statistical data in accordance with the law and directives from the Minister of Agriculture and Rural Development;

c) Take the lead and coordinate with units under the Ministry of Agriculture and Rural Development to compile national-level statistical reports within the reporting system, and send them to the General Statistics Office as stipulated in Decree No. 60/2018/NĐ-CP dated April 20, 2018, of the Government detailing the content of the national-level statistical reporting system;

3. Provincial Departments of Agriculture and Rural Development

a) Take the lead in organizing the implementation of the agricultural and rural development statistical reporting system in their jurisdiction;

b) Direct, guide, and assign tasks to relevant agencies and units to implement the statistical reporting system as prescribed in this Circular;

c) Direct subordinate agencies and units to closely cooperate with local statistical agencies to review, reconcile, and unify agricultural and rural development statistical data in their jurisdiction.

4. Reporting Units

a) Based on assigned functions and tasks, collect and aggregate statistical information within the assigned management scope including statistical information from subordinate units and statistical information from units under their management authority and geographical area;

b) Implement the statistical reporting regulations stipulated in this Circular; submit complete and timely reports; bear responsibility before the Minister of Agriculture and Rural Development and the law for the completeness, timeliness, and accuracy of statistical report data. If errors are found in the report forms, they must be reported to the receiving unit and updated and resubmitted in a timely manner as required.

5. Receiving Units

a) Direct and urge reporting units to comply with the statistical reporting regulations stipulated in this Circular; request reporting units to check and resubmit reports and related information when necessary;

b) Compile statistical information according to the prescribed report forms in the statistical reporting system;

c) Publish, use, and secure statistical information in accordance with the laws on statistics, protection of state secrets, and other relevant laws.

6. Agencies and organizations implementing the agricultural and rural development statistical reporting system shall perform their rights and obligations as prescribed in Article 44 of the Statistics Law 2015. Statistical activities at state agencies and public service units shall be carried out in accordance with Article 65 of the Statistics Law 2015.

Article 8. Effective Date

1. This Circular takes effect from February 11, 2021.

2. In cases where referenced documents in this Circular are amended, supplemented, or replaced, the amended, supplemented, or replacement documents shall apply.

3. During the implementation of this Circular, if any issues arise, agencies, units, organizations, and individuals are requested to promptly reflect them to the Ministry of Agriculture and Rural Development for research, amendment, and supplementation./.
