Circular No. 17/2022/TT-BGTVT amends and supplements certain provisions of Circular No. 12/2020/TT-BGTVT dated May 29, 2020, issued by the Minister of Transport on the organization and management of road passenger transport services and supporting road transport services.

CIRCULAR

Amending and supplementing the list of narcotic substances and precursors promulgated amending and supplementing certain đArticles of Circular No. 12/2020/TT-BGTVT dated May 29, 2020 of the Minister of Transport on the organization and management of road passenger transport services and road freight transport services using motor vehicles.bằng ô tô và dịch vụ hỗ trợ vận tải đường bộ.

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Circular No. 05/2024/TT-BGTVT amending and supplementing some articles of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers, based on the following:

Pursuant to Decree No. 12/2017/NĐ-CPdated February 10, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the request of the Director of the Transport Department and the Director General of the Vietnam Highway Administration,

The Minister of Transport issues this Circular amending and supplementing certain đArticles of Circular No. 12/2020/TT-BGTVT dated May 29, 2020 of the Minister of Transport on the organization and management of road passenger transport services and road freight transport services using motor vehicles.

Article 1. Amending and supplementing certain Articles of Circular No. 12/2020/TT-BGTVT dated May 29, 2020 of the Minister of Transport on the organization and management of road passenger transport services and road freight transport services using motor vehicles.

1. Supplementing Point d of Clause 4 of Article 6 as follows:

"d) Allow vehicles to depart from the station at the time specified in the timetable published by the route management authority."

2. Amending and supplementing Clause 4 of Article 20 as follows:

"4. On the vehicle, emergency escape equipment must be installed; ensuring fire safety conditions for motorized traffic according to the provisions of Government Decree No. 136/2020/NĐ-CP dated November 24, 2020 detailing some articles and measures to implement the Law on Fire Prevention and Combating and the Law Amending and Supplementing Some Provisions of the Law on Fire Prevention and Combating."

3. Amending and supplementing Clause 1 of Article 25 as follows:

"1. The transportation order shall be issued in paper form or electronically by the enterprise or cooperative according to the model prescribed in Appendix 6 attached to this Circular. In addition to the mandatory contents prescribed in Appendix 6, enterprises and cooperatives may add other contents to serve their management work.

When carrying out a trip, the driver must carry the transportation order in paper form or have access to the electronic transportation order content; present the paper or electronic transportation order when requested by competent authorities.

The provision of information on the transportation order shall be carried out according to the provisions of Clause 4 of Article 51 of this Circular."

4. Amend and supplement Clause 2 of Article 29 as follows:

"2. On the vehicle, emergency escape equipment must be installed; ensuring fire safety conditions for motorized traffic according to the provisions of Government Decree No. 136/2020/NĐ-CP dated November 24, 2020 detailing some articles and measures to implement the Law on Fire Prevention and Combating and the Law Amending and Supplementing Some Provisions of the Law on Fire Prevention and Combating."

5. Amending and supplementing Point a of Clause 6 of Article 30 as follows:

"a) The transportation order shall be issued in paper form or electronically by the enterprise or cooperative according to the model prescribed in Appendix 6 attached to this Circular. In addition to the mandatory contents prescribed in Appendix 6, enterprises and cooperatives may add other contents to serve their management work.

6. Amending and supplementing Clause 3 of Article 38 as follows:

"3. On the vehicle, fire safety conditions for motorized traffic must be ensured according to the provisions of Government Decree No. 136/2020/NĐ-CP dated November 24, 2020 detailing some articles and measures to implement the Law on Fire Prevention and Combating and the Law Amending and Supplementing Some Provisions of the Law on Fire Prevention and Combating."

7. Amending and supplementing Clause 7 of Article 43 as follows:

"7. On the vehicle, emergency escape equipment must be installed; ensuring fire safety conditions for motorized traffic according to the provisions of Government Decree No. 136/2020/NĐ-CP dated November 24, 2020 detailing some articles and measures to implement the Law on Fire Prevention and Combating and the Law Amending and Supplementing Some Provisions of the Law on Fire Prevention and Combating."

8. Amending and supplementing Clause 5 of Article 46 as follows:

"5. On the vehicle, emergency escape equipment must be installed; ensuring fire safety conditions for motorized traffic according to the provisions of Government Decree No. 136/2020/NĐ-CP dated November 24, 2020 detailing some articles and measures to implement the Law on Fire Prevention and Combating and the Law Amending and Supplementing Some Provisions of the Law on Fire Prevention and Combating."

9. Amending Clause 5 of Article 62 as follows:

"5. Announce the structure of information, devices, and procedures for checking information on the QR code on the license plate."

10. Amending and supplementing Clause 10 of Article 63 as follows:

"10. Manage and organize the printing of the Road Passenger Transport Business License and Road Freight Transport Business License according to the models issued in this Circular; issue and reissue the Road Passenger Transport Business License and Road Freight Transport Business License to passenger transport businesses and freight transport businesses within the local area."

11. Amending and supplementing Clause 11 of Article 63 as follows:

"11. Manage and organize the printing of various license plates and signs according to the models issued in this Circular or special taxi license plates for the locality; issue and reissue various license plates and signs according to regulations."

Article 2. Implementation clause

1. This Circular takes effect from September 15, 2022.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Directors of Provincial Departments of Transport under the Central Government, the Heads of agencies, units, and individuals concerned are responsible for implementing this Circular./.
