Providing for the Statistical Reporting System of the Justice Sector

Pursuant to the Law on Statistics No. 89/2015/QH13; the Law Amending and Supplementing Certain Provisions and the National Statistical Indicators List of the Law on Statistics No. 01/2021/QH15;

Pursuant to the Government Decree No. 94/2016/NĐ-CP detailing and guiding the implementation of certain provisions of the Law on Statistics;

Pursuant to the Government Decree No. 94/2022/NĐ-CP providing the contents of statistical indicators belonging to the national statistical indicator system and the process of compiling gross domestic product indicators, provincial gross domestic product indicators;

Pursuant to the Government Decree No. 62/2024/NĐ-CP amending and supplementing certain provisions and appendices of the Government Decree No. 94/2016/NĐ-CP detailing and guiding the implementation of certain provisions of the Law on Statistics and the Government Decree No. 94/2022/NĐ-CP providing the contents of statistical indicators belonging to the national statistical indicator system and the process of compiling gross domestic product indicators, provincial gross domestic product indicators;

Pursuant to Decree No. 39/2025/NĐ-CP of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of the Director of the Planning and Finance Department;

The Minister of Justice promulgates this Circular providing for the Statistical Reporting System of the Justice Sector.

Article 1. Scope of Regulation

1. This Circular provides for the statistical reporting system of the Justice Sector to collect statistical information belonging to the national statistical indicator system which the Ministry of Justice is responsible for collecting and summarizing; statistical information belonging to the Justice Sector's statistical indicator system and other statistical information serving management needs within the sector and field.

2. The statistical reporting system provided for in this Circular shall apply to statistical activities in the following fields:

a) Policy review, draft normative legal documents;

b) Drafting and promulgating normative legal documents;

c) Inspecting normative legal documents within the scope of authority;

d) Reviewing normative legal documents;

e) Popularizing and educating the law;

f) Mediation at the grassroots level;

g) Legal access standards;

h) Household registration;

i) Citizenship;

j) Adoption;

k) Authentication;

l) Notarization;

m) Lawyers;

n) Forensic appraisal;

o) Auction of assets;

p) Commercial arbitration;

q) Legal aid;

r) Registration of security measures;

s) Mutual legal assistance in civil matters;

t) Legal regulations;

u) Commercial mediation;

v) Management of asset liquidation;

w) Legal support for small and medium-sized enterprises;

3. For fields under the management authority of the Ministry of Justice not specified in Clause 2 of this Article, statistical activities or those with a statistical nature shall be carried out in accordance with the provisions of legal documents regulating such fields.

Article 2. Applicability

1. Ministries, ministerial-level agencies, and agencies under the Government.

2. People's Committees at all levels.

3. Units under the Ministry of Justice.

4. Departments of Justice and other specialized agencies under the People's Committee of the province.

5. State-owned enterprises.

6. Organizations practicing lawyer, notary, auction of assets, and asset liquidation management.

7. Organizations conducting forensic appraisal, commercial mediation, and commercial arbitration.

8. Individual commercial mediators and bankruptcy trustees registered to practice individually.

9. Agencies registering security measures, transactions, and assets.

10. Organizations implementing legal aid.

11. Other agencies and organizations related according to the provisions of the law.

Article 3. Content of the Reporting and Statistics System

1. Reporting Forms:

a) The list of reporting statistics for the Justice sector (including: serial number, form code, form name, reporting period, reporting unit, receiving unit) as specified in Appendix I attached to this Circular;

b) The system of reporting forms and explanations of the forms' contents (including: concepts, calculation methods, recording methods, data sources) as specified in Appendix IV attached to this Circular.

2. Reporting Units and Receiving Units:

a) The reporting units are specifically recorded at the top right corner of each reporting form;

b) The receiving units are specifically recorded at the top right corner of each reporting form, below the line indicating the reporting unit.

3. Reporting Periods:

The reporting period for statistics is a specific time frame that the reporting unit must reflect the results of its activities through statistical data according to the criteria set out in the reporting forms. The reporting periods for statistics are recorded in the middle part of each reporting form, below the form name. The reporting periods include:

a) Preliminary six-month reporting period: including actual data from January 1 to May 31 of the reporting year;

b) Preliminary annual reporting period: including actual data from January 1 to October 31 of the reporting year;

c) Full-year reporting period: including all actual data from January 1 to December 31 of the reporting year;

d) Ad hoc statistical reports: carried out to collect and compile information outside the regular statistical information collected and compiled as stipulated in points a, b, and c of this clause. The data collection date, reporting deadline, and specific content of ad hoc statistical reports are implemented according to the written requirements signed by the Leadership of the Ministry of Justice.

4. Deadline for Receiving Reports:

The deadline for receiving reports for each receiving unit is specifically recorded at the top left corner of each statistical reporting form, below the form code. If the last day of the reporting deadline coincides with a public holiday, festival, or weekend, then the report submission date will be the next working day. The deadlines for receiving reports are summarized in Appendix II attached to this Circular.

5. Methods of Reporting:

Based on actual conditions, the reporting unit selects one of the following methods to submit reports to the receiving unit:

a) Reporting via the Justice Sector Statistical Software, authenticated by the account provided to the representative of the reporting unit and receiving unit;

b) Reporting by electronic document in file format, authenticated by the digital signature of the head of the reporting unit or an electronic document in image format of the paper report as stipulated in point c of this clause;

c) Reporting by paper document bearing the signature of the head and the seal of the reporting unit (if applicable), sent to the receiving unit via postal service or delivered directly.

6. Correction of Statistical Reports:

a) In cases where statistical data or information is incomplete or does not ensure accuracy and reasonableness, the reporting unit must immediately correct and supplement upon self-discovery or upon request from the receiving unit;

b) After correction and supplementation, the statistical report must be immediately resubmitted to the receiving unit using the method prescribed in Clause 5 of this Article.

7. Estimation of Statistical Data:

a) Nationwide estimation of statistical data is conducted by the Planning and Finance Department, Ministry of Justice. The method of estimating data and the recording of actual data and estimated data are carried out in accordance with detailed guidance in Appendix III issued together with this Circular;

b) Agencies and units may apply the data estimation method stipulated in point a of this clause to estimate statistical data for their management work.

Article 4. Responsibilities of Related Units

1. Responsibilities of the Department of Planning and Finance, Ministry of Justice:

a) Serve as the focal point for receiving statistical reports from reporting units sent to the Ministry of Justice; guide, urge, and inspect the implementation of the reporting system as stipulated in this Circular;

b) Organize statistical analysis and forecasting; compile key statistical information to serve annual review and summary activities of the sector and the dissemination of statistical information in accordance with the law;

c) Lead the preparation of statistical reports on socio-economic indicators of the Ministry of Justice to be submitted to the Government Office for government and Prime Minister's guidance; submit national statistical indicators within the Ministry's responsibility to the Ministry of Finance (General Statistics Office) as prescribed;

d) Lead and coordinate with the Department of Information Technology, Ministry of Justice, and related units to develop the Legal Sector Statistical Software; provide guidance on statistical reporting procedures using the software. Organize the establishment and management of the sector's statistical database.

2. Responsibilities of other units under the Ministry of Justice:

a) Closely cooperate with the Department of Planning and Finance and the Ministry Office in reviewing and cross-checking data from statistical reports sent to the Ministry of Justice, ensuring that statistical data in their areas of management are complete, accurate, truthful, and objective, serving timely and effective leadership guidance;

b) Connect and share data from software, information systems, digital platforms, and specialized databases managed by the unit (if applicable) with the Legal Sector Statistical Software.

c) The Department of Information Technology leads and coordinates with the Department of Planning and Finance to ensure the infrastructure and technical requirements for the smooth operation of the Legal Sector Statistical Software; guarantee system security and information confidentiality regulations.

3. Responsibilities of Reporting Units:

a) Adhere strictly to the provisions on statistical reporting as stipulated in this Circular. Submit full and timely reports; bear responsibility for the completeness and accuracy of reported statistical data; promptly revise and supplement statistical reports upon request from the receiving unit or when self-discovered deficiencies or inaccuracies are found;

b) Implement the application of information technology to ensure comprehensive, accurate, and timely collection, compilation, and reporting of data according to the reporting system stipulated in this Circular;

c) Fulfill other responsibilities as prescribed by laws on statistics.

4. Responsibilities of Receiving Units:

a) Check, cross-reference, and compile data and information from received statistical reports to build their own statistical reports;

b) Promptly request reporting units to correct erroneous data, supplement missing data or information, or explain and clarify related issues;

c) Where necessary, coordinate with relevant agencies and organizations to verify received statistical information or rely on other official sources to correct and supplement statistical data, ensuring the accuracy, comprehensiveness, and objectivity of statistical information and bearing responsibility for such corrections and supplements;

d) Fulfill other responsibilities as prescribed by laws on statistics.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The Department of Planning and Finance, Ministry of Justice assists the Minister of Justice in directing and organizing the implementation of this Circular nationwide.

2. Heads of Ministries, agencies at the ministerial level, and government agencies, Chairpersons of People's Committees at all levels within their assigned authority and tasks shall organize the implementation of this Circular; allocate appropriate conditions to ensure its implementation in compliance with the law.

3. Heads of units under the Ministry of Justice, Directors of Provincial Justice Departments, Heads of related agencies and organizations within their authority shall be responsible for organizing the implementation, monitoring, and urging the implementation of the reporting system stipulated in this Circular, ensuring that statistical activities comply with regulations.

4. During the implementation of this Circular, if there are difficulties or obstacles, they should be promptly reflected to the Ministry of Justice for research and resolution.

Article 6. Effectiveness

1. This Circular takes effect from November 1, 2025.

Specifically, the "Number of communes, wards, special administrative regions meeting legal access standards" category in Form 05c/TP/HGCS-TCPL (Results of grassroots mediation work; number of communes, wards, special administrative regions meeting legal access standards in the province/city) and the "subjects as prescribed by the Law on Juvenile Justice" category in Form 15a/TP/TGPL (Number of people who have been provided legal aid) will take effect from January 1, 2026.

2. Circular No. 03/2019/TT-BTP dated March 20, 2019, issued by the Minister of Justice, which stipulates certain contents regarding the statistical activities of the legal sector, shall cease to be effective from the date this Circular takes effect./.
