CIRCULAR
Regulations on the delineation of authority for two levels of local government in the field of population

Pursuant to the Law on Government Organization 2025;
Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;
Pursuant to Decree No. 42/2025/NĐ-CP dated February 27, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Population Agency;
The Minister of Health issues this Circular to regulate the delineation of authority for two levels of local government in the field of population.
Article 1. Budgeting funds for implementing support policies
The authority to budget funds for implementing support policies as stipulated in point b, Clause 2, Article 10 of Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH dated April 15, 2016, issued by the Ministers of Health, Finance, and Labor, Invalids and Social Affairs detailing Decree No. 39/2015/NĐ-CP dated April 27, 2015, of the Government on support policies for poor women from ethnic minorities who give birth according to population policy, which has been amended and supplemented in 2018, shall be carried out by the People's Committee at the commune level.
Article 2. Consolidating the budget for implementing support policies
The authority to consolidate the state budget for implementing support policies as stipulated in Clause 2, Article 8 of Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH, which has been amended and supplemented in 2018, shall be carried out by the People's Committee at the provincial level.
Article 3. Allocating funds for implementing support policies
The authority to allocate funds for implementing support policies for the commune level as stipulated in point c, Clause 2, Article 10 of Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH, which has been amended and supplemented in 2018, shall be carried out by the People's Committee at the provincial level.
Article 4. Receiving reports on the implementation of support policies for poor women from ethnic minorities who give birth according to population policy
1. The authority to receive reports on the implementation of support policies as stipulated in point b, Clause 2, Article 9 of Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH, which has been amended and supplemented in 2018, shall be carried out by the health sector agency under the People's Committee at the provincial level.
2. The procedure for receiving reports is as follows:
Before October 15 each year, the People's Committee at the commune level shall prepare and submit reports to the health sector agency under the People's Committee at the provincial level.
Article 5. Regarding encouragement to maintain a stable replacement fertility rate for groups
1. The authority to award commendations for cases stipulated in item 2, point a, Clause 1, Article 3 of Circular No. 01/2021/TT-BYT dated January 25, 2021, issued by the Minister of Health guiding certain contents for localities to formulate commendation and support policies for groups and individuals who perform well in population work, shall be carried out by the People's Committee at the commune level.
2. The authority to award commendations for cases stipulated in items 3 and 4, point a, Clause 1, item 1, point a, Clause 2, Article 3 of Circular No. 01/2021/TT-BYT shall be carried out by the People's Committee at the provincial level.
Article 6. Regarding encouragement to control gender imbalance at birth for groups
The authority to award commendations for cases stipulated in Clause 1, Article 4 of Circular No. 01/2021/TT-BYT shall be carried out by the People's Committee at the provincial level.
Article 7. Regarding encouragement to improve the quality of the population
The authority to award commendations for cases stipulated in item 1, point a, Clause 2, Article 5 of Circular No. 01/2021/TT-BYT shall be carried out by the People's Committee at the provincial level.
Article 8. Reporting System for Specialized Population Statistics
1. The authority to receive specialized population statistics reports at the commune level as stipulated in point d, Clause 1, Article 4 of Circular No. 01/2022/TT-BYT dated January 10, 2022, issued by the Minister of Health on initial recording and reporting systems for specialized population statistics shall be carried out by health sector agencies under the People's Committee of the province.
2. The authority to receive specialized population statistics reports from healthcare facilities providing population services within the commune as stipulated in item 1, point d, Clause 2, Article 4 of Circular No. 01/2022/TT-BYT shall be carried out by the People's Committee of the commune.
3. The authority to receive specialized population statistics reports from the focal units responsible for population work at the commune level as stipulated in point a, Clause 1, Article 4 and healthcare facilities (including non-public healthcare facilities) providing population services as stipulated in item 2, point d, Clause 2, Article 4 of Circular No. 01/2022/TT-BYT within the province shall be carried out by health sector agencies under the People's Committee of the province.
Article 9. Implementation Provisions
Article 32. Responsibilities of Agencies
2. This Circular shall cease to be effective from March 1, 2027.
3. Circular No. 10/2011/TT-BYT dated February 25, 2011, issued by the Minister of Health guiding the staffing of Population and Family Planning Centers at district, town, city-level districts, and provincial cities shall cease to be effective from the date this Circular takes effect.
4. During the period this Circular is in effect, if the provisions regarding authorities and responsibilities for state management in this Circular differ from those in other Circulars issued by the Minister of Health before July 1, 2025, then the provisions in this Circular shall apply.
In the course of implementation, if there are any difficulties, organizations and individuals should promptly report them to the Ministry of Health (National Population Agency) for consideration and resolution./.
