CIRCULAR

 Amending and supplementing certain Articles of Circular No. 19/2018/TT-NHNN dated August 28, 2018 of the Governor of the State Bank of Vietnam guiding foreign exchange management for cross-border trade activities between Vietnam and China

Pursuant to the Law on the State Bank of Vietnam No. 46/2010/QH12;

Pursuant to the Law on Credit Organizations No. 32/2024/QH15;

Pursuant to the Foreign Exchange Decree No. 28/2005/PL-UBTVQH11 amended and supplemented by Decree No. 06/2013/PL-UBTVQH13;

Pursuant to the Government's Decree No. 14/2018/NĐ-CP dated January 23, 2018 detailing cross-border trade activities, amended and supplemented by the Government's Decree No. 122/2024/NĐ-CP dated October 4, 2024;

On the basis of The Government's Decree No. 26/2025/NĐ-CP dated February 24, 2025 stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

Implementing the Border Trade Agreement signed on September 12, 2016 between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China and the Settlement and Cooperation Agreement signed on May 26, 1993, amended on October 16, 2003 between the State Bank of Vietnam and the People's Bank of China;

At the proposal of the Director of the Foreign Exchange Management Department;

The Governor of the State Bank of Vietnam promulgates this Circular amending and supplementing certain Articles of Circular No. 19/2018/TT-NHNN dated August 28, 2018 of the Governor of the State Bank of Vietnam guiding foreign exchange management for cross-border trade activities between Vietnam and China.

Article 1. Amending, supplementing certain Articles of Circular No. 19/2018/TT-NHNN dated August 28, 2018 of the Governor of the State Bank of Vietnam guiding foreign exchange management for cross-border trade activities between Vietnam and China

a) Amending and supplementing Point c Clause 2 as follows:

"Article 4. Payment Methods

1. Bank payment, including:

a) Payment in freely convertible foreign currency through authorized banks according to current foreign exchange management regulations;

b) Payment in CNY through border branch banks;

c) Payment in VND through border branch banks.

2. Netting payment (payment of the difference in netting transactions of export goods and services with import goods and services in cross-border trade activities between Vietnam and China) through authorized banks."

2. Amend and supplement Clause 3 of Article 9 as follows:

"3. Netting payment (payment of the difference in netting transactions of export goods and services with import goods and services in cross-border trade activities between Vietnam and China) through authorized banks."

3. Amending and supplementing Clause 2 Article 21 as follows:

"2. Quarterly, before the twentieth day of the first month of each quarter, the authorized bank with a border branch shall submit reports according to Model II, Model III, and Model IV issued together with this Circular to the State Bank of Vietnam (Department of Foreign Exchange Management) and the State Bank of Vietnam Branch in the Border Area."

4. Amending and supplementing Clause 4 Article 22 as follows:

"4. Heads of relevant units under the State Bank of Vietnam, authorized banks, and related organizations and individuals are responsible for implementing this Circular."

Article 2. Replacing and abolishing certain phrases, points, clauses, Articles, and Appendices of Circular No. 19/2018/TT-NHNN dated August 28, 2018 of the Governor of the State Bank of Vietnam guiding foreign exchange management for cross-border trade activities between Vietnam and China

1. Abolish Article 5.

2. Abolish point b Clause 1 Article 6.

3. Abolish point a(ii) Clause 1 Article 11.

4. Abolish Clause 1 Article 17.

5. Replace the phrase "State Bank of Vietnam Branch in the border province" with the phrase "State Bank of Vietnam Branch in the Border Area" in the name of Article 18 and in Clause 2 Article 18.

6. Abolish Appendix No. 01 promulgated together with Circular No. 19/2018/TT-NHNN.

7. Replace Appendix No. 02, Appendix No. 03, and Appendix No. 04 promulgated together with Circular No. 19/2018/TT-NHNN with Appendix II, Appendix III, and Appendix IV promulgated together with this Circular.

This Circular takes effect from December 25, 2025/.

Heads of relevant units under the State Bank of Vietnam, authorized banks, and related organizations and individuals are responsible for implementing this Circular.

Article 4. Implementation provisions

This Circular takes effect from September 15, 2025./.
