DECREE

Regarding the amendment of certain clauses in Decree No. 4/CP dated January 18, 1993, detailing the implementation of the Ordinance on Entry into, Exit from, Residence, and Movement within Vietnam for Foreigners

THE GOVERNMENT

Pursuant to the Law on the Organization of the Government dated September 30, 1992;

Pursuant to the Ordinance on Entry into, Exit from, Residence, and Movement within Vietnam for Foreigners dated February 21, 1992;

At the proposal of the Minister of Interior and the Minister of Foreign Affairs,

 

DECREE:

Article 1. - Amend Clause 1, Article 2, Clause 3, Article 3, Chapter I and Chapter III of Decree No. 4/CP dated January 18, 1993 as follows:

1. Clause 1, Article 2 (amended): Foreigners who have urgent requests to enter Vietnam or are invited by domestic agencies, organizations, or individuals to enter Vietnam unexpectedly for diplomatic purposes, or to handle urgent matters such as technical support for investment projects, burial of relatives, medical treatment for seriously ill patients, rescue operations during natural disasters, epidemics, traffic accidents, etc., if they have been approved by the Ministry of Interior for entry but cannot obtain a visa at Vietnamese diplomatic missions, consular offices, or other authorized agencies abroad may be issued a visa for entry and exit at Vietnamese border gates.

2. Clause 3, Article 3 (amended): The exit and entry management agency shall issue an exit visa within fifteen days from the date of receiving complete valid application files.

3. Chapter III (amended):

Authorities responsible for handling entry, exit, residence, and movement procedures for foreigners in Vietnam.

Article 15.

1. The Ministry of Interior is the specialized state management agency for the entry, exit, residence, and movement of foreigners in Vietnam.

The Minister of Interior shall specify the organizational structure and specific tasks of the entry and exit management agencies under the Ministry of Interior at central and local levels, ensuring the fulfillment of duties and powers as prescribed by the Ordinance and this Decree.

2. The Ministry of Foreign Affairs is responsible for handling entry, exit, residence, and movement procedures in Vietnam for foreigners enjoying diplomatic privileges and immunities.

The Minister of Foreign Affairs shall specify the organizational structure and specific tasks of the agencies handling entry, exit, residence, and movement procedures in Vietnam for foreigners enjoying diplomatic privileges and immunities as prescribed by the Ordinance and this Decree.

3. Diplomatic missions, consular offices, or other authorized agencies of Vietnam abroad are responsible for handling entry and exit procedures for foreigners in Vietnam as stipulated in the Ordinance and Chapter I of this Decree.

Article 2. - This Decree takes effect from the date of issuance./.
