Pursuant to Decree No. 90/2002/NĐ-CP dated 11/11/2002 based on the Government's Decision on the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

Pursuant to Decision No. 99/1998/QĐ-TTg dated 26/5/1998 of the Prime Minister on price and tariff management for postal and telecommunications services;

Pursuant to Circular No. 03/1999/TT-TCBĐ dated May 11, 1999 of the General Post Office guiding the implementation of Decree No. 109/1997/NĐ-CP dated November 12, 1997 of the Government on postal and telecommunications services and Decision No. 99/1998/QĐ-TTg dated May 26, 1998 of the Prime Minister on price and tariff management for postal and telecommunications services;

Considering the proposal of Saigon Postal and Telecommunications Joint Stock Company at Report No. 1566/CV-SPT 17/10/2003 regarding: Pricing plan for supplementary mobile phone CDMA service tariffs of SPT;

At the recommendation of the Director of the Planning and Finance Department,

DECISION:

Article 1. This decision attaches the tariff for postpaid mobile phone CDMA service package FREE 1.

Article 2. This decision takes effect from November 1, 2003.

Article 3. The Head of the Office, the Director of the Planning and Finance Department, Heads of units under the Ministry of Posts and Telecommunications, General Directors, Directors of telecommunications service enterprises, and Heads of related units are responsible for implementing this decision./.

MOBILE POSTPAID CDMA TARIFFS

PACKAGE SERVICE FREE 1

II- Specific Provisions

1- Network connection fee

- Charged once.

2-  Monthly subscription fee

2.1- Charged monthly.

2.2- For new customers signing up for service or terminating their contracts before the end of the month, the monthly subscription fee for that month shall be calculated as follows:

                                                               227,273 VND           

            Monthly subscription fee =   ––––––––––––––––   x number of days used in the month 

                                                                   30 days

Number of days used in the month:

+ For new customers signing up for service: the number of days used in the month is counted from the date the customer signs the usage contract until the end of the month.

+ For customers terminating their contracts: the number of days used in the month is counted from the first day of the month to the last day the termination contract becomes effective.  

3- Information charges

3.1- For calls originating from prepaid CDMA mobile package service FREE 1:

Free intra-zone and inter-zone calls to another prepaid CDMA mobile number registered with SPT. 

Charges are calculated based on the first minute and subsequent 10-second blocks. Calls lasting less than one minute are charged for one minute. Any remaining time less than 10 seconds at the end of a call is rounded up to one 10-second block.

The rates specified in points 4.1 and 4.2 of Section I apply to calls made from prepaid CDMA mobile package service FREE 1 to other CDMA mobile numbers not previously registered within the SPT network and to fixed-line and mobile numbers in other networks. The rate for calls to VSAT numbers is applied according to the current VSAT rate.

The rate for international calls from prepaid CDMA mobile package service FREE 1: is calculated as the sum of the prepaid CDMA mobile package service FREE 1 intra-zone charge and the current international call charge.

3.2. For calls to prepaid CDMA mobile numbers:

a. Calls originating from the fixed-line PSTN network:

Intra-zone information charge:           1,636 VND/minute.

Inter-zone information charge:           2,455 VND/minute.

The billing unit is minutes. Any remaining time less than one minute at the end of a call is rounded up to one minute.

b. Calls originating from the GSM mobile network: The rates and billing methods are applied according to the current decisions on GSM mobile service tariffs.

c. Calls originating from other networks: The rates and billing methods are applied as if the calls were made from those networks to GSM mobile numbers.

3.3- The tariff zones are defined as follows:

Zone 1: includes provinces and cities from Northern Vietnam to Quang Binh Province

Zone 3: includes provinces and cities: Quang Tri, Thua Thien-Hue, Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa, Gia Lai, Kon Tum, and Dak Lak.

Zone 2: includes the remaining central provinces and cities.

Intra-zone call rates apply to calls within each zone.

Inter-zone call rates apply to calls between zones:  From Zone 1 to Zone 2, Zone 3, and vice versa.

From Zone 2 to Zone 3, and vice versa.

1.11 Mobile prepaid information charges shall be collected from the calling subscriber.

The information fee shall be determined based on the actual location of the calling subscriber and the registered location of the called subscriber.

4- At public points (post offices, agents, communal post and culture stations, prepaid phone booths), in addition to the information fee specified in point 3.2 of Section II above, the enterprise managing the public point may collect an additional service fee. The amount of the additional service fee shall be decided by the enterprise managing the public point but shall not exceed the service fee for calls to other mobile networks.

5- Reduction of fees according to usage time during the day:

5.1- A 30% reduction in mobile information fees for outgoing calls from CDMA postpaid mobile subscribers, or from fixed-line PSTN subscribers to CDMA mobile subscribers, during the following periods:

From 23:00 on the previous day until 01:00 on the following morning, and from 05:00 to 07:00 in the morning for all days of the week.

From 07:00 in the morning until 23:00 on holidays and Sundays.

5.2- A 50% reduction in mobile information fees for outgoing calls from CDMA postpaid mobile subscribers, or from fixed-line PSTN subscribers to CDMA mobile subscribers, from 01:00 to 05:00 in the morning for all days of the week.

5.3- International call charges from CDMA mobile postpaid subscribers, in addition to the reductions in mobile information fees as stipulated in points 5.1 and 5.2 above, the reduction in international call charges shall be applied according to current regulations.

5.4- The reduction in fees for incoming calls to CDMA mobiles at public points (post offices, agents, communal post and culture stations, prepaid phone booths) from 23:00 on the previous day until 07:00 in the morning on the following day, on holidays and Sundays, shall be decided by the enterprise managing the public point. The reduction shall not exceed 30% of the fee specified in point 3.2 of Section II above and shall not be lower than the reduction for calls to other mobile networks.

6- For internal calls within the SPT CDMA mobile network of postpaid subscribers (excluding one-way subscribers) belonging to the same organization and using a common billing invoice, the following rates apply:

For organizations with 5 to 9 subscribers: a 20% reduction in communication fees with other subscribers within the same CDMA mobile network of SPT.

For organizations with 10 to 19 subscribers: a 30% reduction in communication fees with other subscribers within the same CDMA mobile network of SPT.

For organizations with 20 or more subscribers: a 40% reduction in communication fees with other subscribers within the same CDMA mobile network of SPT.

The rates specified herein shall be reviewed and adjusted (if necessary) by the Ministry of Posts and Telecommunications when the number of CDMA mobile subscribers of SPT reaches 200,000.

7- The rates specified above do not include value-added tax.

8- This mobile information tariff table applies uniformly to CDMA mobile postpaid subscribers under the FREE 1 package nationwide.

9- The mobile information fee shall be collected from the calling subscriber.
