Issuing the fee rates for reviewing film scripts, films, and granting licensesfor cinematographic activities,
films and granting licenses for cinematographic activities
THE MINISTER OF FINANCE
Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on tasks, powersand responsibilities of ministries and ministerial-level agencies in managing affairs;
Pursuant to Decree No. 178/CP dated October 28, 1994 of the Government onthe duties, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government onfees and charges under the State budget;
Pursuant to Decree No. 48/CP dated July 17, 1995 of the Government on theorganization and operation of cinematography; Decree No. 87/CP dated December 12,1996 of the Government on strengthening management of cultural activities andcultural services, and intensifying efforts to eliminate serious social evils;
After reaching consensus with the Ministry of Culture and Information and uponthe proposal of the Director General of the Tax General Department,
DECISION:
Article 1.- Organizations and individuals subject to the competent state management agencyover cinematography for reviewing film scripts, films, and granting licenses forcinematographic activities must pay the fees as prescribed in this Decision.
Article 2.-The fee rates for reviewing film scripts, films, and granting licenses forcinematographic activities are stipulated as follows:
1.Reviewing film scripts, including those of film production companies, commissionedfilms, sponsored films, joint ventures with foreign countries, and film servicesthat involve foreign countries:
a.Film story scripts:
Length up to 100 minutes (one episode): VND 1,200,000 (one million two hundredthousand dong) per episode.
Length from 101 to 150 minutes (1.5 episodes): VND 1,800,000 (one million eighthundred thousand dong) per film.
Length from 151 to 200 minutes shall be calculated as two episodes.
b.Short film scripts, including documentary films, scientific films, animated films:
Length up to 60 minutes: VND 500,000 (five hundred thousand dong) per episode.
Length from 61 minutes onwards shall be charged as for feature films.
c.Film scripts produced through cooperation and provision of film services withforeign countries:
c1.Feature films:
Length up to 100 minutes (one episode): VND 2,000,000 (two million dong) perepisode.
Length from 101 to 150 minutes (1.5 episodes): VND 3,000,000 (three million dong)per film.
Length from 151 to 200 minutes shall be calculated as two episodes.
c2.Short films:
Length up to 60 minutes: VND 800,000 (eight hundred thousand dong) per episode.
Length from 61 minutes onwards shall be charged as for feature films.
2.Reviewing films:
a.Feature films:
Length up to 100 minutes (one episode): VND 600,000 (six hundred thousand dong)per episode.
Length from 101 to 150 minutes (1.5 episodes): VND 900,000 (nine hundred thousanddong) per film.
Length from 151 to 200 minutes shall be calculated as two episodes.
b.Short films (documentary, scientific, animated...):
Length up to 60 minutes: VND 350,000 (three hundred fifty thousand dong) perepisode.
Length from 61 minutes onwards shall be charged as for feature films.
3.Issue permits for cinematographic activities (including review of applicationforms):
Permit for film production activities (three years): VND 100,000 (one hundredthousand dong).
Temporary permit for film production (one film): VND 200,000 (two hundred thousanddong).
Permit for practicing as a director, cameraman...: VND 50,000 (fifty thousanddong).
The above-mentioned fee rates apply to each registration and issuance of permits.In cases where film scripts, film works... have complex issues requiring multiplerevisions before resubmission for review, subsequent submissions will be charged at50% (fifty percent) of the corresponding fee rates. For film scripts and film worksthat fail to meet the required conditions and thus are not granted productionpermits or cinematographic practice permits, the paid fees will not be refunded.
Article 3.- The fee collection agency is entitled to retain 90% (ninety percent) of thecollected fees prior to depositing them into the state budget for expenses relatedto reviewing film scripts, reviewing films, reviewing application forms, andorganizing fee collections; the remaining 10% (ten percent) of the collected feesmust be deposited into the state budget. The fee collection agency is responsiblefor collecting, depositing, and managing the use of collected fees in accordancewith Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Financeguiding the implementation of Decree No. 04/1999/NĐ-CP dated January 30, 1999 of theGovernment on fees and charges under the state budget.
Article 4.- The local tax authority where the fee collection agency is located isresponsible for guiding and supervising the implementation of fee collection inaccordance with this Decision and Circular No. 54/1999/TT-BTC dated May 10, 1999of the Ministry of Finance guiding the implementation of Decree No. 04/1999/NĐ-CPdated January 30, 1999 of the Government on fees and charges under the state budget.
Article 5.-This Decision takes effect fifteen days after its date of signature. Allprovisions regarding fees and charges for reviewing film scripts, reviewing films,and granting licenses for cinematographic activities that conflict with thisDecision are hereby abolished.
Article 6.-The subjects paying fees for reviewing film scripts, reviewing films, andgranting licenses for cinematographic activities, the agencies assigned the taskof organizing fee collection, and other relevant agencies responsible forimplementing this Decision./.
