Regulations on Designating Telecommunication Equipment Testing Laboratories

 

THE MINISTER OF POSTS AND TELECOMMUNICATIONS

On the basis of the Quality of Goods Ordinance 04/01/2000;

Based on the Post and Telecommunications Ordinance dated 25/05/2002;

Pursuant to Decree No. 90/2002/NĐ-CP dated 11/11/2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Posts and Telecommunications Ministry;

Based on Circular No. 6120/VPCP-TCQT dated December 14, 2001 of the Government Office approving the Plan and Action Program to participate in the Mutual Recognition Arrangement (MRA) for Telecommunication Equipment Certification under the APEC TEL MRA and ATRC MRA;

At the proposal of the Director of the Science and Technology Department,

 

DECISION:

Article 1. This Decision annexes the "Regulations on Designating Telecommunication Equipment Testing Laboratories".

Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE.

Article 3. The Heads of the Office, Department of Science and Technology, heads of functional units, subordinate units of the Ministry of Posts and Telecommunications, telecommunication equipment testing laboratories, and related organizations and individuals are responsible for implementing this decision.

           

REGULATIONS

On Designating Telecommunication Equipment Testing Laboratories

(Annexed to Decision No. 171/2003/QĐ-BBCVT

dated October 29, 2003 of the Minister of Posts and Telecommunications)

 

PART I

GENERAL PROVISIONS

Article 1: This document stipulates the procedures, requirements, and necessary conditions for designating telecommunication equipment testing laboratories to conduct conformity assessment of telecommunication equipment, radio equipment, and electromagnetic compatibility (EMC) requirements of relevant equipment.

Article 2: The Ministry of Posts and Telecommunications (MPT) of Vietnam is the Designating Authority of Vietnam authorized to designate specialized telecommunication equipment testing laboratories (hereinafter referred to as testing laboratories) to assess the conformity of telecommunication equipment according to technical regulations of the Ministry of Posts and Telecommunications or technical regulations of the Parties participating in the Mutual Recognition Arrangement (MRA) for telecommunication equipment certification with Vietnam.

Article 3All telecommunication equipment testing laboratories operating in the field of telecommunications, as specified in Article 1, may be designated.

Article 4: In these provisions, terms are understood as follows:

1. Recognition: is the formal recognition by the Designating Authority or Recognizing Authority of a testing laboratory for meeting the standards and requirements to perform tests according to a standard or a set of standards.

2. Designation: is the delegation of authority by the Designating Authority to a testing laboratory to conduct conformity assessment of equipment according to the technical regulations of the Ministry of Posts and Telecommunications and MRA.

3. Designating Authority: is the authority with the power to designate, compile lists, audit compliance, restrict designation, or revoke designation of testing laboratories within its jurisdiction.

4. Mutual Recognition: is the acceptance by a Designating Authority of a Party to the MRA of a testing laboratory designated by another Designating Authority of a Party to the MRA.

5. Testing Laboratory: is the entity performing the function of testing telecommunication equipment, radio equipment, and EMC requirements.  

 

PART II

CONDITIONS AND PROCEDURES FOR DESIGNATION

Article 5: Conditions for testing laboratories to apply for designation include:

1. Legally established and operating in accordance with Vietnamese laws;

2. Possessing sufficient capability and technical capacity to perform measurements according to relevant technical regulations;

3. Having in-depth knowledge of all technical regulations as well as current management requirements related to equipment testing.

4. Testing laboratories applying for designation to participate in the MRA must be recognized by the National Accreditation Committee (VILAS) to comply with ISO/IEC 17025 standards in the field of telecommunications, EMC. The scope of recognition must be consistent with the type of equipment and technical regulations within the scope of application for designation. For cases where testing laboratories have not been recognized or other special cases, the Ministry of Posts and Telecommunications issues specific regulations to evaluate the capabilities of testing laboratories.

Article 6: Testing laboratories submit applications for designation to the Ministry of Posts and Telecommunications at the address:

, Clause 1, Clause 2 Article 7a of this Regulation.: Application documents for designation include:

1. Application form for designation (according to the model in the appendix). The application form for designation is provided by the Ministry of Posts and Telecommunications according to the address in Article 6, or at the website ;   

2. Decision on establishment or document establishing the testing laboratory in accordance with the law;

3. Recognition certificate issued by VILAS, clearly stating the scope of recognition, confirming that the testing laboratory has been recognized to comply with ISO/IEC 17025 standards for cases where the testing laboratory applies for designation to participate in the MRA;

4. Technical regulations, standards, or technical requirements within the desired scope of designation;

5. Organizational structure and personnel chart;

6. Diagram of testing rooms;

7. List of measuring equipment and measurement methods applied for each technical regulation, standard, or technical requirement;

8. Sample test report used by the testing laboratory.

Article 8: When submitting the application for designation, the testing laboratory must pay the evaluation fee and issuance fee for the designation certificate according to the regulations of the Ministry of Finance.

Article 9: Evaluation and Approval Procedures:

1. Evaluation and approval are based on reviewing and evaluating the application for designation. If necessary, the Ministry of Posts and Telecommunications will conduct an assessment of the testing laboratory's capacity at the testing rooms and workplace.

2. The maximum time for designation review is 60 days from the date the Ministry of Posts and Telecommunications receives the complete application for designation.

3. The Ministry of Posts and Telecommunications issues the designation certificate to testing laboratories that meet all designation requirements. The designation certificate specifies the scope of designation according to Vietnamese technical regulations.

4. The Ministry of Posts and Telecommunications introduces to the MRA Parties those testing laboratories that meet the designation requirements to participate in the MRA. When the testing laboratory is recognized by the MRA Parties, the Ministry of Posts and Telecommunications issues an additional designation certificate. This certificate specifies the scope of designation according to Vietnamese technical regulations and the scope of recognition according to the technical regulations of the MRA Parties.  

Article 10: The designation certificate is valid for three years. For testing laboratories participating in the MRA, the designation certificate remains valid only if the testing laboratory continues to be recognized by VILAS.

Article 11: When the designation certificate expires, to continue receiving the designation certificate, the testing laboratory must complete all procedures as when applying for designation.

CHAPTER III

RIGHTS AND OBLIGATIONS OF DESIGNATED TESTING LABORATORIES  BE DIRECTED

Article 12: Designated testing laboratories have the following rights:

1. The measurement and testing results within the designated scope shall be recognized for issuing a conformity certification for domestic equipment.

2. For Measurement and Testing Laboratories recognized by the Mutual Recognition Arrangement (MRA) Parties, the measurement and testing results shall be recognized by the MRA Parties in accordance with the provisions of the MRA. 

Article 13: Measurement and Testing Laboratories designated shall have the following obligations:

1. Ensure the maintenance of VILAS recognition during the validity period of the designation certificate for Measurement and Testing Laboratories participating in the MRA;

2. Ensure that equipment measurements comply strictly with procedures, rules, and regulations of the Ministry of Posts and Telecommunications or the requirements of the MRA;

3. Provide a list of measuring instruments, measurement records, and other information when requested by the Ministry of Posts and Telecommunications;

4. Immediately notify the Ministry of Posts and Telecommunications in the following cases:

Changes in organizational structure, operations, or working address;

Changes in recognition status;

Other changes affecting continued compliance with standards or requirements set forth by the Ministry of Posts and Telecommunications or the MRA.

5. Adhere to the conditions of designation announced by the Ministry of Posts and Telecommunications at different times;

6. Operate within the designated scope and fully bear legal responsibility for measurement services provided.

PART IV

POST-DESIGNATION SUPERVISION

Article 14: The Ministry of Posts and Telecommunications shall conduct supervision and evaluation of designated Measurement and Testing Laboratories to ensure full compliance with established requirements.

Article 15: The Ministry of Posts and Telecommunications shall suspend or revoke the designation certificate of designated Measurement and Testing Laboratories in the following cases:

1. Designated Measurement and Testing Laboratories participating in the MRA have their recognition certificates revoked by VILAS;

2. MRA Parties no longer recognize the designated Measurement and Testing Laboratory. In this case, the old designation certificate will be replaced by a new one excluding the name of the MRA Party that no longer recognizes the laboratory;

3. Measurement and Testing Laboratories fail to fully comply with the requirements stipulated;

4. There are valid reasons.

Article 16: Designated Measurement and Testing Laboratories suspended or having their designation certificates revoked shall be removed from the list of designated laboratories.

CHAPTER V

IMPLEMENTING PROVISIONS

Article 17: Heads of agencies and units under the Ministry of Posts and Telecommunications, designated Measurement and Testing Laboratories, and related organizations and individuals are responsible for implementing these Regulations. Previous regulations inconsistent with these Regulations are hereby abolished.

Article 18: During implementation, if there are difficulties, agencies, organizations, and individuals should promptly report to the Ministry of Posts and Telecommunications for review, supplementation, and amendment.
