DECREE

Regulations on training and capacity building for civil servants

Pursuant to the Government Organization Law on February 18, 2025;

Pursuant to the Law on Local Administration Organization dated June 16, 2025;

Based on the Civil Servants Law dated June 24, 2025;

Pursuant to the Education Law dated June 14, 2019;

Based on the Law on National Defense Education and Security dated June 19, 2013;

The Government issues this Decree to regulate training and capacity building for civil servants.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Decree stipulates principles, contents, programs, forms, and management and organization of training and capacity building for civil servants.

2. This Decree applies to civil servants in agencies of the Communist Party of Vietnam, State, Vietnam Fatherland Front, political-social organizations at central, provincial, and communal levels.

Article 2. Implementation Principles

1. Training and capacity building must be based on job positions linked with the use and management of civil servants, consistent with the training and capacity building plan and the need for human resource development, especially high-quality human resources, of the agency or unit.

2. Implement division of responsibilities in organizing capacity building according to job position requirements.

3. Enhance the application of science and technology, artificial intelligence in training and capacity building for civil servants.

4. Increase awareness of responsibility among civil servants regarding self-study, self-learning, and choosing capacity building programs according to job position requirements in specialized fields and professional tasks to improve their competence and ability to perform duties.

5. Ensure transparency, efficiency, and effectiveness.

Article 3. Responsibilities of civil servants when participating in training and capacity building

1. Implement regulations on training and capacity building for civil servants.

2. Continuously engage in self-study, self-learning, and proactively choose capacity building programs according to job position requirements in specialized fields and professional tasks to enhance their competence and ability to perform duties.

3. Complete the capacity building program according to job position requirements ensuring the minimum annual implementation time as prescribed.

4. Civil servants in leadership and management positions who participate in teaching courses for civil servant capacity building shall be counted towards the annual capacity building program time requirement for specialized fields and professional tasks as stipulated in Clause 3, Article 16 of this Decree.

5. Adhere to the training and capacity building regulations and be subject to management by educational institutions within the national education system during training courses and by the Ho Chi Minh National Academy of Politics, training institutions for cadres, civil servants, and public officials under ministries, ministerial-level agencies, the National Assembly, Supreme People's Court, Supreme People's Procuracy, Vietnam Fatherland Front, and political-social organizations at central level, and provincial political schools during capacity building courses.

6. Fulfill commitments regarding duty performance at the sending agency or unit after completing the training program and comply with regulations on compensating training costs.

Chapter II
TRAINING OF CIVIL SERVANTS

Article 4. Requirements for postgraduate training

1. Postgraduate training for civil servants aims to enhance qualifications, specialization, and professional skills to meet the needs of human resource development, particularly high-quality human resources, of the agency or unit. Priority should be given to training in areas such as science and technology, innovation, digital skills, and digital technology.

2. Postgraduate training for civil servants shall be conducted in accordance with laws on education and training.

Article 5. Conditions for sending to postgraduate training

1. Civil servants who have worked for at least three years, including two consecutive years immediately preceding the time they are sent for postgraduate training, and have performed their duties satisfactorily.

2. Civil servants must not exceed forty-five years old as of the time they are first sent for postgraduate training.

3. Civil servants must commit to performing their tasks and public service responsibilities at the agency or unit that sends them for postgraduate training for a period of at least three times the duration of the training program upon completion.

4. The field of study must be appropriate to the job position.

5. Civil servants sent for postgraduate training under programs cooperated with foreign countries signed by authorized agencies of the Party and State or joined on behalf of the Socialist Republic of Vietnam, in addition to the provisions of Clause 1, Clause 2, Clause 3, and Clause 4 of this Article, must also meet other requirements of the cooperation program.

Article 6. Compensation for Postgraduate Training Costs

Civil servants sent for postgraduate training funded by the state budget or the management agency's funds or the unit using civil servants must compensate for training costs if they fall into any of the following cases:

1. Voluntarily dropping out of school or work during the training period.

2. Being subject to disciplinary action resulting in dismissal according to regulations.

3. Not being granted a graduation certificate by the training institution.

4. Having completed the training program and been granted a graduation certificate but leaving work or being dismissed due to disciplinary action before fulfilling the committed service period as stipulated in Clause 3 of Article 5 of this Decree.

Article 7. Compensation Costs and Calculation Method for Compensation Costs

1. Compensation costs include tuition fees and all other expenses serving the training program, excluding salary and allowances (if any).

2. Calculation method for compensation costs:

a) For cases specified in Clauses 1, 2, and 3 of Article 6 of this Decree, civil servants must pay 100% of the compensation costs;

b) For cases specified in Clause 4 of Article 6 of this Decree, the compensation cost is calculated using the following formula:

Where:

S is the compensation cost;

F is the total actual cost paid by the agency or unit sending the civil servant for training for one participant in the training program;

T1 is the required service period after completing the training program (or programs) counted in months rounded off;

T2 is the actual service period after training counted in months rounded off.

Example: Mr. A was sent for a two-year master's degree training program (24 months) costing 60 million VND. According to the commitment, Mr. A must serve for at least 72 months after returning from training. After graduating, Mr. A served the agency for 24 months before voluntarily leaving. The training cost Mr. A must compensate is:

Article 8. Conditions for Not Paying Compensation and Reducing Compensation Costs

1. Conditions for Not Paying Compensation

a) In cases where civil servants are sent for postgraduate training but fail to obtain a degree due to serious illness, natural disasters, or epidemics confirmed by authorized authorities, they are exempted from paying training costs.

b) In cases where civil servants are sent for postgraduate training by agencies or units but are subsequently transferred, rotated, detailed, or reassigned to another agency within the system of agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, central-level political-social organizations, provincial-level organizations, or communal-level organizations, they are exempted from paying training costs.

2. Conditions for Reducing Compensation Costs

If the civil servant is female or a member of an ethnic minority, each year of work (excluding the time worked after training) reduces the compensation cost by 1.5%. If the civil servant is neither female nor a member of an ethnic minority, each year of work (excluding the time worked after training) reduces the compensation cost by 1%.

Article 9. Compensation Review Board

1. The Compensation Review Board advises the head of the civil service management agency or the agency/unit authorized to manage civil servants in examining cases requiring compensation for costs and recommending compensation amounts for civil servants.

2. The Board operates on principles of transparency, democracy, and majority voting.

3. The Board ceases operations and dissolves itself upon completion of its tasks.

Article 10. Establishment of the Compensation Review Board

1. The head of the civil service management agency or the agency/unit authorized to manage civil servants establishes the Compensation Review Board.

2. The Compensation Review Board consists of the following members:

a) One representative from the Personnel Department (Division, Office) of the Ministry of Home Affairs or the agency/unit authorized to manage civil servants serving as Chairman of the Board;

b) One civil servant responsible for training and development from the Personnel Department (Division, Office) of the Ministry of Home Affairs or the agency/unit authorized to manage civil servants serving as Secretary of the Board;

c) One representative from the Party Committee of the unit employing the civil servant;

d) One representative from the financial-accounting department of the agency/unit paying for the training course expenses;

đ) One representative from the leadership of the unit employing the civil servant.

Article 11. Meetings of the Compensation Review Board

1. The Chairman of the Board is responsible for organizing the compensation review meeting. The Board's meeting can only be held when all members are present.

2. Meeting procedures:

a) The Board Secretary announces the decision to establish the Board;

b) The Chairman of the Board outlines the Board's tasks and work program;

c) The Board Secretary reads regulations related to compensating training costs;

d) A representative from the leadership of the employing unit reports on the civil servant's work process and identifies cases requiring compensation for training costs as stipulated in Article 6 of this Decree;

đ) A representative from the financial-accounting department specified in point d, Clause 2, Article 10 reports on the training course expenses;

e) The Board discusses the compensation case and compensation amount.

3. The Board's recommendation on compensation costs must be documented and sent to the head of the civil service management agency or the agencies/units authorized to manage civil servants within no later than three working days from the end of the meeting.

4. The meeting organization costs of the Compensation Review Board are sourced from the training and development budget of the civil service management agency.

Article 12. Compensation Decision

Based on the Board's recommendations, the head of the civil service management agency or the agency/unit authorized to manage civil servants issues a decision on compensating training costs.

Article 13. Payment and Recovery of Compensation Costs

1. Within no more than 120 days from receiving the decision on compensating training costs from the competent authority, the civil servant required to compensate must fully pay the compensation costs.

2. The compensation costs are paid to the agency/unit that covered the training course expenses according to regulations.

3. In cases where the civil servant fails to fulfill the obligation to compensate training costs as prescribed or there is disagreement between the management agency and the civil servant regarding the compensation of training costs, the parties involved have the right to lodge complaints or initiate legal proceedings in accordance with the law.

Chapter III
STAFF DEVELOPMENT

Section 1
CONTENT, PROGRAM, CERTIFICATE OF DEVELOPMENT

Article 14. Content of Training

1. Political theory.

2. National defense and security knowledge.

3. State management knowledge and skills.

4. Knowledge and skills according to job position requirements.

5. Scientific and technological knowledge, innovation, digital skills, and digital technology.

Article 15. Training Programs and Materials

1. Political theory training programs and materials: Implemented in accordance with the regulations of the competent authority.

2. National defense and security knowledge training programs and materials: Implemented in accordance with the regulations of the competent authority.

3. State management knowledge and skills training programs and materials for leading and managing civil servants include:

a) Leadership and management training programs and materials at the department level and equivalent, with a duration of four weeks, including:

Department-level leadership and management training programs and materials at the commune level;

Department-level leadership and management training programs and materials at the provincial level and equivalent;

Department-level leadership and management training programs and materials at the ministry-level departments and equivalent;

b) Leadership and management training programs and materials at the provincial level and equivalent, with a duration of four weeks;

c) Leadership and management training programs and materials at the ministry-level departments and equivalent, with a duration of four weeks;

d) Deputy minister-level and equivalent leadership and management training programs and materials, with a duration of two weeks.

4. Job-specific professional and vocational training programs and materials, with a minimum implementation period of one week and a maximum of two weeks.

Article 16. Requirements for Participation in Training Programs

1. Civil servants must participate in political theory training programs and national defense and security knowledge training programs in accordance with the regulations and guidance of the competent authority.

2. Leading and managing civil servants must complete state management knowledge and skills training programs within twelve months from the effective date of their appointment decision.

3. Civil servants must participate in job-specific professional and vocational training programs in accordance with the requirements of the civil servant management agency, ensuring a minimum implementation time of one week (forty hours) per year.

Article 17. Issuance and Management of Training Programs

1. The competent authority of the Communist Party of Vietnam shall develop, issue, and manage political theory training programs and deputy minister-level and equivalent leadership and management training programs.

2. The Ministry of Home Affairs shall issue and manage state management knowledge and skills training programs for leading and managing civil servants: department level and equivalent, provincial level and equivalent, ministry-level departments and equivalent.

3. The Ministry of Defense shall take the lead and coordinate with the Ministry of Public Security to develop, issue, and manage national defense and security knowledge training programs.

4. The civil servant management agency shall develop, issue, and manage job-specific professional and vocational training programs for civil servants under its jurisdiction.

Article 18. Compilation of Training Programs and Materials

1. Training programs and materials must be compiled in accordance with job positions and practical requirements in each stage.

2. Program content and materials must ensure a combination of theory and practice; knowledge, experience, and practical skills; integration and embedding of similar training programs; no duplication; enhancement of new content on scientific and technological knowledge, innovation, digital skills, and digital technology. Programs and materials must be regularly updated and improved to meet needs, requirements, and actual conditions.

3. The Ho Chi Minh National Academy of Politics shall organize the compilation of state management knowledge and skills training programs for leading and managing civil servants: department level and equivalent, provincial level and equivalent, ministry-level departments and equivalent.

4. The agency responsible for job-specific professional and vocational training program management shall organize the compilation of training programs.

5. Agencies, organizations, and units entrusted with organizing training shall be responsible for compiling training materials.

Article 19. Reviewing and Approving Training Programs and Materials

1. The competent authority of the Communist Party of Vietnam shall review political theory training programs and deputy minister-level and equivalent training programs.

2. The Ministry of Home Affairs shall review training programs for civil servants' management knowledge and skills at the departmental and equivalent level, provincial and equivalent level, and directorate and equivalent level.

3. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Public Security to review national defense and security knowledge training programs.

4. The civil servant management agency shall approve training programs according to job requirements for specialized and vocational positions for civil servants under its jurisdiction before implementation.

5. Training institutions and organizations entrusted with compiling training materials shall organize reviews or approvals of such materials.

Article 20. Organizing Reviews of Training Programs and Materials

1. The competent authorities of the Communist Party of Vietnam and the Ministry of National Defense shall establish councils and organize reviews of training programs under their management.

2. The Ministry of Home Affairs shall establish councils and organize reviews of training programs for civil servants' management knowledge and skills at the departmental and equivalent level, provincial and equivalent level, and directorate and equivalent level.

3. The Director of the Ho Chi Minh National Academy of Politics, heads of training institutions and organizations, and agencies and units shall establish or request the establishment of councils to review training materials entrusted to them for compilation.

4. The review council shall consist of five or seven members, including the Chairman of the Council, the Secretary of the Council, two members兼任反批评委员和其他委员。

5. Members of the council must be experienced, reputable managers, scientists, and experts with relevant professional qualifications and must not be the direct compilers of the reviewed programs and materials。

6. A council meeting can only be held if at least two-thirds of the total number of council members are present, and neither the Chairman nor the Secretary of the Council may be absent。

7. Within ten working days from the end of the review meeting, the review file for the program or material must be submitted to the competent authority. The file includes:

a) Comments, evaluations, and review forms of the council members;

b) Minutes of the review meeting, clearly recording the Chairman's concluding opinion; voting results minutes;

c) The reviewed program or material。

8. Based on the council's conclusion, the competent authority shall consider and decide on issuing or approving the program or material。

9. The cost of organizing the review shall be taken from the budget for civil servant training and development, which is included in the budget for compiling the program or material。

Article 21. Issuing Training Materials

1. The Minister, Heads of State agencies, leaders of the Vietnam Fatherland Front, central-level political-social organizations, and Chairmen of Provincial People's Committees shall issue decisions to promulgate training materials within their jurisdiction。

2. The Director of the Ho Chi Minh National Academy of Politics shall issue decisions to promulgate or submit to the competent authority for issuance of training materials entrusted to them for compilation。

3. Leaders of training institutions and organizations, and agencies and units shall issue decisions to promulgate or submit to the competent authority for issuance of training materials entrusted to them for compilation。

Article 22. Certificate for training programs

1. The Ho Chi Minh National Academy of Politics; training and retraining institutions issuing certificates for training programs shall be assigned to implement.

2. The Ministry of Home Affairs shall provide specific guidance on management, use, and certificate models.

Section 2
TRAINING ORGANIZATION

Article 23. Responsibilities for organizing training

1. The Ho Chi Minh National Academy of Politics shall organize training for the following programs:

a) Political theory training program as prescribed;

b) Training programs on knowledge and skills in state administration for leading and managing civil servants at the department level within provincial-level departments and equivalent levels, departments under ministries and equivalent levels, provincial-level departments and equivalent levels, ministerial departments and equivalent levels;

c) Training programs according to job requirements for specialized and vocational positions;

d) Other training programs assigned by competent authorities.

2. Provincial and centrally-administered city political schools shall organize training for the following programs:

a) Political theory training programs assigned for training as prescribed;

b) Training programs on knowledge and skills in state administration for leading and managing civil servants at the department level within commune-level departments;

c) Training programs according to job requirements for specialized and vocational positions;

d) Other training programs assigned by competent authorities.

3. Training and retraining institutions for cadres and civil servants of state agencies, Vietnam Fatherland Front, and central-level political-social organizations shall organize training for the following programs:

a) Training programs according to job requirements for specialized and vocational positions.

b) Other training programs assigned by competent authorities.

Article 24. Methods of training

Training shall be conducted through positive methods that promote self-awareness, initiative, and creative thinking of learners, enhance information exchange, knowledge, and experience sharing between lecturers and students, and among students; strengthen training through practical scenarios.

Article 25. Forms of organizing training

1. Concentrated.

2. Online.

3. Combination of direct and online forms.

Article 26. Evaluation of training quality

1. Evaluating training quality aims to provide information on the improvement of civil servants' capacity to perform their duties and public service tasks after training.

2. Evaluating training quality must ensure transparency, objectivity, and honesty.

3. Content of evaluating training quality includes:

a) Evaluating the quality of the training program;

b) Evaluating the quality of participants in the training course;

c) Evaluating the quality of lecturers participating in training;

d) Evaluating the quality of facilities serving the training course;

đ) Evaluating the quality of civil servant training courses;

e) Evaluating the effectiveness of civil servant training post-training.

4. Evaluation of training quality shall be organized and implemented by management agencies, using units, training and retraining institutions, or hired independent evaluation agencies.

5. The Ministry of Home Affairs shall provide specific guidance on evaluating the quality of civil servant training.

Section 3
TRAINING ABROAD FUNDED BY STATE BUDGET

Article 27. Requirements for overseas training

1. Selected countries for sending civil servants to study must meet the following requirements:

a) Countries with modern administrative systems, modern public governance, strengths, and management experiences in digital transformation, innovation, green economy, international integration, and other fields that can be studied, researched, and applied in Vietnam;

b) Training and retraining institutions must have learning and research conditions, teaching methods that meet the objectives, contents, and programs of the training course.

2. Organizing overseas training must ensure transparency, quality, and effectiveness.

3. Sending civil servants for overseas training must be appropriate to their job positions and the needs of the agency or unit.

Article 28. Conditions for Overseas Training

1. For training courses lasting less than one month, civil servants must have sufficient working age to work for at least eighteen months from the start of the training course.

2. For training courses lasting from one month up to less than twelve months, civil servants must have sufficient working age to work for at least twenty-four months from the start of the training course.

3. The specialty and vocational skills of the civil servant sent for training must be appropriate to the content of the training course.

4. Civil servants who are not under consideration or disciplinary action, or serving a disciplinary sanction of reprimand or higher, and who are not in cases where they are not allowed to exit or enter the country according to the provisions of the law.

5. Civil servants sent for training must be rated as having satisfactorily completed their tasks or better in the immediately preceding year.

6. Civil servants must have health that meets the requirements of the training course.

Chapter IV
INSTRUCTORS

Article 29. Lecturers for Civil Servant Training and Development

1. Lecturers of the National Academy of Political Science Ho Chi Minh, training and development institutions; part-time lecturers.

2. Invited guest lecturers.

Article 30. Standards, Tasks, Benefits, and Policies for Lecturers in Civil Servant Training and Development

1. Standard

a) Loyalty to the Communist Party of Vietnam and the Socialist Republic of Vietnam;

b) Firm political qualities, healthy lifestyle and moral conduct;

c) Meeting the qualification standards for professional training as prescribed;

d) Having theoretical political knowledge, computer skills, foreign language proficiency, and pedagogical expertise to meet the requirements of assigned tasks;

đ) Being in good health to perform duties;

e) A clear personal record meeting the political standard requirements.

2. Tasks

a) Preparing curricula, materials, and teaching according to regulations;

b) Conducting scientific and technological research;

c) Studying and enhancing professional qualifications.

3. Benefits and policies

a) Benefits and policies for lecturers of the National Academy of Political Science Ho Chi Minh are stipulated by the competent authority;

b) Lecturers and part-time lecturers of training and development institutions are entitled to benefits and policies of lecturers in higher education institutions.

4. The Ministry of Home Affairs shall provide detailed guidance on the standards, tasks, benefits, and policies for lecturers of training and development institutions under ministries, agencies with ministerial status, agencies of the National Assembly, the Supreme People's Court, the Supreme People's Procuracy, the Vietnam Fatherland Front, and central-level political-social organizations.

5. The National Academy of Political Science Ho Chi Minh shall provide detailed guidance on the standards, tasks, benefits, and policies for lecturers of provincial and centrally-administered city political schools.

Article 31. Standards, Tasks, Benefits, and Policies for Invited Guest Lecturers

1. REGARDING VIETNAMESE CITIZENS

a) Meeting the standards prescribed in points a, b, c, đ, e of Clause 1, Article 30 and having theoretical political knowledge, professional qualifications, and vocational skills to meet the requirements;

b) Fulfilling teaching tasks accurately according to the content of the signed contract;

c) Receiving benefits and policies based on the signed contract and legal provisions.

2. Regarding foreigners

a) Having a political attitude consistent with the political system of the Socialist Republic of Vietnam and complying with Vietnamese laws;

b) Meeting the requirements for knowledge and teaching ability;

c) Receiving benefits and policies based on the signed contract and legal provisions.

Chapter V
EXPENSES AND RIGHTS OF CIVIL SERVANTS SENT FOR TRAINING AND DEVELOPMENT

Article 32. Training and Development Funding

1. The funding for training and development of civil servants shall be provided from the state budget, the management agencies, units using civil servants, the civil servants themselves, and organizations and individuals both domestically and internationally in accordance with the provisions of the law.

2. The State shall have policies to support funding for training and development for female civil servants, prioritizing females who participate in training and development while carrying children under thirty-six months old, and ethnic minority civil servants. State agencies, the Vietnam Fatherland Front, political and social organizations at the central level, and provincial People's Committees shall proactively allocate from regular expenditure funds and other sources to support female civil servants, prioritize females participating in training and development while carrying children under thirty-six months old, and ethnic minority civil servants who are assigned to participate in training and development in accordance with the laws on gender equality and ethnic affairs.

3. The Ministry of Finance shall guide the preparation of budgets, management, utilization, and settlement of accounts for training and development funding in accordance with each form of training and development organization and the support policies for female civil servants, prioritizing females participating in training and development while carrying children under thirty-six months old, and ethnic minority civil servants who are assigned to participate in training and development.

Article 33. Benefits for Civil Servants Assigned to Training and Development

1. For civil servants assigned to domestic training and development:

a) Shall be allocated time and funding according to regulations by the managing and using agencies;

b) Shall have their training and development time counted towards continuous service time;

c) Shall enjoy benefits and allowances as prescribed by law;

d) Shall be recognized and rewarded for outstanding results in training and development.

2. Civil servants assigned to overseas training and development shall enjoy benefits as prescribed by law and the regulations of the agency or unit.

3. Female civil servants and ethnic minority civil servants, in addition to the benefits stipulated in Clause 1 and Clause 2 of this Article, shall also enjoy other benefits as prescribed by laws on gender equality and ethnic affairs.

Chapter VI
MANAGEMENT OF TRAINING AND DEVELOPMENT

Article 34. Tasks and Authorities of the Ministry of Home Affairs

1. To draft and submit to competent authorities for issuance or issue within its authority legal normative documents on training and development of civil servants.

2. To draft and submit to competent authorities for approval or issue within its authority strategies, programs, and plans for training and development of civil servants.

3. To draft programs and plans for overseas training and development of civil servants for submission to competent authorities for issuance; to guide and organize the implementation of overseas training and development courses funded by the state budget for civil servants of state agencies, the Vietnam Fatherland Front, political and social organizations at the central level, and provinces and cities in accordance with approved programs, plans, and projects.

4. To issue and manage training programs for civil servants within its authority.

5. To inspect and supervise the implementation of regulations on training and development of civil servants.

Article 35. Tasks and Authorities of Central State Agencies, the Vietnam Fatherland Front, and Political and Social Organizations

1. To draft, issue, and implement programs and plans for training and development for civil servants under their jurisdiction; to propose training and development funding to the Ministry of Finance for consolidation and submission to competent authorities for approval.

2. To draft and issue training and development regulations, create conditions for civil servants to continuously study, enhance their sense of responsibility in self-study and self-improvement, and improve their work competence and responsibility of leadership and management cadres at all levels participating in teaching courses on civil servant training and development within their authority and responsibilities.

3. To select appropriate training and development programs that meet the requirements and needs of civil servants under their management to enhance the quality of human resources.

4. To organize overseas training and development courses for civil servants within their authority.

5. To manage and organize the compilation of training programs for civil servants within their authority.

6. To manage training institutions and the teaching staff within their authority.

7. To inspect the implementation of regulations on training and development of civil servants within their authority.

Article 36. Tasks and Authorities of the Ministry of Finance

1. To aggregate, balance, allocate training and improvement funds both domestically and abroad for submission to the competent authority for approval; send to the Ministry of Home Affairs for monitoring and implementation within its authority.

2. To guide and inspect the management and use of training and improvement funds.

Article 37. Tasks and Authorities of the People's Committee of Provinces and Central Cities

1. To develop and submit to the Provincial People's Council for promulgation of resolutions on systems and policies encouraging civil servants to continuously study and improve their qualifications and capabilities; allocate funds to ensure effective implementation of training and improvement activities according to regulations.

2. To develop and promulgate training and improvement regulations, creating conditions for civil servants to continuously study and enhance their sense of responsibility in self-study and self-improvement of their qualifications and capabilities, and the responsibilities of leadership and management staff at all levels participating in teaching courses for civil servant improvement programs within the scope of local authority and responsibility.

3. To develop, promulgate and organize the implementation of plans and programs for training and improvement for civil servants under their management.

4. To select appropriate training and improvement programs that meet the requirements and needs of civil servants under their management to enhance the quality of human resources.

5. To manage and organize the compilation of training and improvement programs and materials within their authority.

6. To manage training institutions and the teaching staff within their authority.

7. To inspect the implementation of regulations on civil servant training and improvement activities within their authority.

Article 38. Responsibilities of Units Employing Civil Servants

1. Implement regulations on training and capacity building for civil servants.

2. To propose and select appropriate training and improvement programs that meet the job position requirements of civil servants and the needs of the unit.

3. To create conditions for civil servants to participate in training and improvement courses as prescribed; to encourage self-study and self-improvement of their qualifications.

Article 39. Reporting System for Civil Servant Training and Improvement Activities

1. State agencies, Vietnam Fatherland Front, central-level political and social organizations, and provincial People's Committees have the responsibility to submit annual reports on the results of civil servant training and improvement activities to the Ministry of Home Affairs before January 31 of the following year or as required by the competent authority.

2. Personnel Departments of state agencies, Vietnam Fatherland Front, central-level political and social organizations, and Provincial Home Affairs Departments are the focal units assisting the Minister, Heads of state agencies, leaders of Vietnam Fatherland Front, central-level political and social organizations, and Chairmen of provincial People's Committees in managing civil servant training and improvement activities, responsible for compiling the results of civil servant training and improvement activities and submitting them to the Ministry of Home Affairs and the competent authority for consolidation and monitoring.

Chapter VII
IMPLEMENTING PROVISIONS

Article 40. Application Provisions

1. Individuals working within the authorized establishment quota assigned by the competent authority for tasks assigned by the Party and State shall apply the provisions on civil servant training and improvement.

2. The Ho Chi Minh National Academy of Politics shall organize leadership and management cadre improvement programs for commune-level cadres in accordance with the provisions of the competent authority, applying the provisions of this Decree.

Article 41. Implementation Organization

1. This Decree takes effect from July 1, 2025.

2. This Decree abolishes the provisions on civil servant training and improvement set forth in Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on training and improvement of cadres, civil servants, and public officials, and Decree No. 89/2021/NĐ-CP dated October 18, 2021 of the Government amending and supplementing certain articles of Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on training and improvement of cadres, civil servants, and public officials.

3. Training and improvement institutions currently implementing programs under Clause 3, Article 17 in the content of Clause 4, Article 1 of Decree No. 89/2021/NĐ-CP shall complete the improvement course and issue certificates to students before December 31, 2025.

4. Civil servants holding certificates for completing improvement programs under Point a, Clause 5, Article 17 in the content of Clause 4, Article 1 of Decree No. 89/2021/NĐ-CP or who were appointed to leadership and management positions before June 30, 2025, are not required to participate in the management knowledge and skills improvement program for leadership and management civil servants as stipulated in Clause 3, Article 15 of this Decree.

5. From the date this Decree takes effect, civil servants currently being sent for training and improvement under Decree No. 101/2017/NĐ-CP, if the competent authority plans to assign them to positions commensurate with their training and improvement qualifications, will continue to enjoy the training and improvement benefits until completion of the training and improvement courses as prescribed. In cases where civil servants are currently undergoing training and improvement under the regulations but have been decided by the competent authority to implement policies and benefits under Decree No. 178/2024/NĐ-CP dated December 31, 2024 of the Government on policies and benefits for cadres, civil servants, public officials, workers, and armed forces in organizational restructuring (amended and supplemented by Decree No. 67/2025/NĐ-CP dated March 15, 2025 of the Government) and Decree No. 154/2025/NĐ-CP dated June 15, 2025 of the Government on streamlining the establishment, they will not continue to enjoy the training and improvement benefits under this Decree.

6. Civil servants sent for training at secondary, college, university, and postgraduate levels as prescribed, who have not completed the training course or obtained certification or served the agreed service period but have been decided by the competent authority to implement policies and benefits under Decree No. 178/2024/NĐ-CP (amended and supplemented by Decree No. 67/2025/NĐ-CP) and Decree No. 154/2025/NĐ-CP, will not be required to reimburse training costs. In cases where civil servants have completed the probation period or are currently undergoing probation according to the Law on Cadres and Civil Servants 2008 (amended and supplemented by the Law Amending and Supplementing Certain Articles of the Law on Cadres and Civil Servants and the Law on Public Officials 2019), the probation period will not be counted towards the work period for cost reduction purposes.

Article 42. Responsibility for Implementation

The Ministers, Heads of State agencies, leaders of the Vietnam Fatherland Front and political-social organizations at the central level, Chairpersons of People's Committees of provinces and centrally governed cities, and related agencies, organizations, and individuals shall be responsible for implementing this Decree.
