DECISION OF THE MINISTER OF POSTS AND TELECOMMUNICATIONS

Provisions on the recognition of Testing Laboratories that have been designated by the Parties participating

in the Mutual Recognition Arrangement (MRA) on conformity assessment of telecommunications equipment

with Vietnam Male designated

 

THE MINISTER OF POSTS AND TELECOMMUNICATIONS

On the basis of the Quality of Goods Ordinance 04/01/2000;

Pursuant to the Post and Telecommunications Ordinance dated 25/05/2002;

Pursuant to Decree No. 90/2002/NĐ-CP dated 11/11/2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Posts and Telecommunications Ministry;

Pursuant to Circular No. 6120/VPCP-TCQT dated December 14, 2001 of the Government Office approving the Plan and Action Program for participation in the Mutual Recognition Arrangement (MRA) on certification of conformity of telecommunications equipment under the APEC TEL MRA and ATRT MRA;

At the proposal of the Director of the Science and Technology Department,

 

DECISION:

Article 1.Issued together with this Decision is the "Provisions on the recognition of Testing Laboratories that have been designated by the Parties participating in the Mutual Recognition Arrangement (MRA) on conformity assessment of telecommunications equipment with Vietnam designated".

Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE.

Article 3. The Heads of the Office, Department of Science and Technology, heads of functional units, subordinate units of the Ministry of Posts and Telecommunications, Testing Laboratories for telecommunications equipment, and related organizations and individuals are responsible for implementing this decision.

 

REGULATIONS

On the recognition of Testing Laboratories that have been designated by the Parties participating

in the Mutual Recognition Arrangement (MRA) on conformity assessment of telecommunications equipment

with Vietnam Male designated

PART I

GENERAL PROVISIONS

Article 1: This document sets out the procedures, requirements, and necessary conditions for recognizing Testing Laboratories that have been designated by the Parties participating in the Mutual Recognition Arrangement (MRA) on conformity assessment of telecommunications equipment with Vietnam designated to test telecommunications equipment, radio equipment, and electromagnetic compatibility (EMC) requirements of related equipment according to Vietnam's technical regulations.

Article 2: The Ministry of Posts and Telecommunications (MPT) of Vietnam is the Designating Authority of Vietnam authorized to recognize specialized telecommunications Testing Laboratories (hereinafter referred to as Testing Laboratories) that have been designated by the Parties participating in the Mutual Recognition Arrangement (MRA) on conformity assessment of telecommunications equipment (hereinafter referred to as MRA) with Vietnam. 

Article 3: Foreign Testing Laboratories operating in the field of telecommunications, as stipulated in Article 1, which have been designated by the Parties participating in the MRA with Vietnam may be recognized in accordance with the provisions of the MRA.

Article 4: In these provisions, the terms shall be understood as follows:

1. Recognition: is the formal acknowledgment by the Designating Authority or Recognizing Authority of a Testing Laboratory for meeting the standards and requirements to conduct tests according to a standard or a set of standards.

2. Designation: is the delegation of authority by the Designating Authority to a Testing Laboratory to carry out conformity assessment of equipment according to the regulations of the Ministry of Posts and Telecommunications and the MRA.

3. Designating Authority: is the authority with the power to designate, list, audit compliance, limit designation, or revoke designation of Testing Laboratories within its jurisdiction.

4. Recognition: is the acceptance by a Designating Authority of a Party to the MRA of a Testing Laboratory designated by another Designating Authority of a Party to the MRA.

5. Testing Laboratory: is an entity performing the function of testing telecommunications equipment, radio equipment, and electromagnetic compatibility requirements.

CONDITIONS AND PROCEDURES FOR RECOGNITION

Article 6: To be recognized, foreign Testing Laboratories must meet the following requirements:

1. Be recognized as complying with the ISO/IEC 17025 standard - General Requirements for the Competence of Testing Laboratories;

2. Be designated by a Party to the MRA;

3. The scope of designation and recognition of the Testing Laboratory must include all or part of Vietnam's technical regulations and standards that the Testing Laboratory wishes to be recognized.

Article 7: The application for recognition submitted by the foreign Designating Authority to the address specified in Article 5 includes:

1. Application for recognition (according to the model in the Appendix);

2. Recognition request letter from the Party to the MRA;

3. Copy of the recognition certificate along with the scope of recognition.

Article 8: When a Testing Laboratory is recognized, the Ministry of Posts and Telecommunications sends a confirmation letter of recognition to the foreign Designating Authority. The confirmation letter clearly states the standards and technical regulations within the scope of recognition. At the same time, the Testing Laboratory is added to the list of recognized Testing Laboratories on the Internet at the address .

Article 9: The maximum period for considering recognition is 60 days from the date the Ministry of Posts and Telecommunications receives the complete application for recognition. In case of non-recognition, within 60 days from the date of receiving the complete application, the Ministry of Posts and Telecommunications will officially reply in writing with reasons for non-recognition and request the Designating Authority and the designated Testing Laboratory to complete the required requirements. The Designating Authority and the designated Testing Laboratory have at least 60 days from the date of receipt of the completion request to resolve any issues and meet the requirements of the Ministry of Posts and Telecommunications.

Article 10: The Ministry of Posts and Telecommunications does not disclose the status of recognition requests to third parties before completing the recognition process.

Article 11: The duration of recognition by the Ministry of Posts and Telecommunications is equal to the duration designated by the foreign Designating Authority.

CHAPTER III

RIGHTS AND OBLIGATIONS OF RECOGNIZED TESTING LABORATORIES

Article 12: Recognized Testing Laboratories have the following rights:

1. Test results within the scope of recognition are recognized by Vietnam for issuing certificates of conformity for imported equipment.

2. Other rights as provided for in the MRA. 

Article 13: Recognized Testing Laboratories have the following obligations:

1. Comply with the provisions of the MRA.

2. Fully bear responsibility for any impact or consequences caused by the recognized Testing Laboratory when conducting tests.

 

PART IV

SUSPENSION AND REVOCATION OF RECOGNITION

Article 14: The Ministry of Posts and Telecommunications receives notifications from foreign Designating Authorities about changes that may affect the continued operation within the scope of recognition of Testing Laboratories. These changes include changes in the scope of recognition and designation of Testing Laboratories.

Article 15: The Ministry of Posts and Telecommunications will suspend recognition for a Testing Laboratory if it finds that the Testing Laboratory is not complying with the requirements of these provisions. The Testing Laboratory must immediately rectify the situation to meet the requirements of the Ministry of Posts and Telecommunications.

Article 16: The Posts and Telecommunications Ministry shall revoke recognition if it finds that the Testing Room does not comply with Article 6 of this regulation.

Article 17: The Posts and Telecommunications Ministry shall suspend or revoke recognition in cases where the Testing Room is suspended or has its designation certification revoked by a foreign designated authority.

Article 18: A Testing Room whose recognition is suspended or revoked will be removed from the list of recognized Testing Rooms.

CHAPTER V

IMPLEMENTING PROVISIONS

Article 19: Heads of agencies and units under the Posts and Telecommunications Ministry, Testing Rooms, and related organizations and individuals are responsible for implementing this Regulation. Previous regulations that conflict with this Regulation are hereby abolished.

Article 20: During implementation, any difficulties should be promptly reported to the Posts and Telecommunications Ministry for review, supplementation, and amendment.
