THE MINISTER OF JUSTICE

Pursuant to Decree No. 62/2003/NĐ-CP dated June 6, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 08/2000/NĐ-CP dated March 10, 2000 of the Government on collateral transaction registration;

Pursuant to Decree No. 65/2005/NĐ-CP dated May 19, 2005 of the Government amending and supplementing certain articles of Decree No. 16/2001/NĐ-CP dated May 2, 2001 of the Government on the organization and operation of financial leasing companies,

Pursuant to Decision No. 104/2001/QĐ-TTg dated July 10, 2001 of the Prime Minister on the establishment of the National Office for Registration of Collateral Transactions under the Ministry of Justice;

Pursuant to Decision No. 171/QĐ-BTP dated March 24, 2005 of the Minister of Justice approving the Project on improving the organization and staff of the National Office for Registration of Collateral Transactions;

Considering the proposal of the Director of the National Office for Registration of Collateral Transactions and the Head of the Personnel Department, Ministry of Justice.

DECISION:

Article 1. Establish the Transaction Registration Center and Asset of the National Office for Registration of Collateral Transactions under the Ministry of Justice in Hanoi City (hereinafter referred to as Center No. 1). Cease the operation of the Transaction Registration Center and Asset of the National Office for Registration of Collateral Transactions.

The headquarters of Center No. 1 is located at No. 58-60 Tran Phu Street, Ba Dinh District, Hanoi City.

Center No. 1 is a self-financing public service unit with legal personality, its own seal, and separate account.

Article 2Center No. 1 has the following tasks and powers:

1. Registering collateral transactions using various types of assets, except for collateral transactions involving aircraft, ships, land use rights, and immovable property attached to land;

2. Registering financial lease assets;

3. Registering and providing information on other transactions and assets as prescribed by law;

4. Providing information on registered transactions and assets and information stored in the National Database of Collateral Transactions;

5. Promoting and disseminating laws on collateral transaction registration;

6. Performing other tasks assigned by the Director of the National Office for Registration of Collateral Transactions.

Article 3Center No. 1 shall carry out registration and provide information on transactions and assets specified in Clauses 1, 2, 3, and 4 of Article 2 of this Decision upon request of individuals and organizations throughout the country.

Article 4. The organization and operation of Center No. 1 shall comply with relevant legal provisions and regulations of the Ministry of Justice.

The staffing of Center No. 1 includes the Director, Deputy Directors, and specialized staff members, which shall be determined by the Director of the National Office for Registration of Collateral Transactions in coordination with the Head of the Personnel Department, to be submitted to the Minister of Justice for decision.

Article 5The operating budget of Center No. 1 shall be allocated by the Minister of Justice within the annual budget of the National Office for Registration of Collateral Transactions.

Article 6. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
