THE MINISTER OF JUSTICE

Pursuant to Decree No. 16/2001/NĐ-CP dated May 2, 2001 of the Government on the organization and operation of financial leasing companies;

Pursuant to Decree No. 08/2000/NĐ-CP dated March 10, 2000 of the Government on registration of secured transactions;

Pursuant to Decree No. 16/2001/NĐ-CP dated May 2, 2001 of the Government on the organization and operation of financial leasing companies;

Pursuant to Decision No. 104/2001/QĐ-TTg dated July 10, 2001 of the Prime Minister on the establishment of the National Office for Secured Transactions under the Ministry of Justice;

Pursuant to Decision No. 171/QĐ-BTP dated March 24, 2005 of the Minister of Justice approving the Project on improving the organizational structure and staff of the National Office for Secured Transactions;

Considering the proposal of the Director of the National Office for Secured Transactions and the Head of the Personnel Department, Ministry of Justice.

DECISION:

Article 1. Establish the Transaction Registration Center and Asset of the National Office for Secured Transactions under the Ministry of Justice in Ho Chi Minh City (hereinafter referred to as Center No. 2) based on the Branch of Transaction Registration and Asset of the National Office for Secured Transactions under the Ministry of Justice in Ho Chi Minh City.

The headquarters of Center No. 2 is located at No. 333B Minh Phung Street, Ward 2, District 11, Ho Chi Minh City.

Center No. 2 is a self-financing public service unit with legal personality, its own seal and separate account.

Article 2Center No. 2 has the following tasks and powers:

1. Registering secured transactions using various types of assets, except for secured transactions using aircraft, ships, land use rights, and immovable property attached to land;

2. Registering leased assets;

3. Registering and providing information on other transactions and assets as prescribed by law;

4. Providing information on registered transactions and assets and information stored in the National Database of Secured Transactions;

5. Promoting and disseminating laws on transaction registration;

6. Performing other tasks assigned by the Director of the National Office for Secured Transactions.

Article 3. Center No. 2 shall carry out registration and provide information on transactions and assets mentioned in Clauses 1, 2, 3, and 4 of Article 2 of this Decision upon request of individuals and organizations throughout the country.

Article 4. The organization and operation of Center No. 2 shall comply with relevant legal provisions and regulations of the Ministry of Justice.

The staffing of Center No. 2 includes the Director, Deputy Director, and specialized staff members, which shall be determined by the Director of the National Office for Secured Transactions in coordination with the Head of the Personnel Department, to be decided by the Minister of Justice.

Article 5. The operating budget of Center No. 2 shall be allocated by the Minister of Justice within the annual budget of the National Office for Secured Transactions.

Article 6This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

This Decision replaces Decision No. 01/2002/QĐ-BTP dated January 2, 2002 of the Minister of Justice on the establishment of the Branch of Transaction Registration and Asset of the National Office for Secured Transactions in Ho Chi Minh City.
