On the establishment of Hue City under central administration
OF THE NATIONAL ASSEMBLY
On the basis of the Constitution of the Socialist Republic of Vietnam;
Pursuant to the Law on Local Administration Organization No. 77/2015/QH13, as amended and supplemented by Laws No. 21/2017/QH14, No. 47/2019/QH14, No. 31/2024/QH15, No. 34/2024/QH15, and No. 43/2024/QH15;
Considering the Report No. 616/TTr-CP dated October 7, 2024 of the Government, the Review Report No. 3355/BC-UBPL15 dated October 16, 2024 of the Committee for Legal Affairs, the Report No. 1106/BC-UBTVQH15 dated November 29, 2024 of the Standing Committee of the National Assembly explaining, adopting, and revising the draft Resolution on the establishment of Hue City under central administration, and the opinions of the National Assembly deputies,
RESOLUTION:
Article 1. Establishment of Hue City
Hue City shall be established as a city under central administration based on the entire natural area of 4,947.11 square kilometers and a population scale of 1,236,393 people of Thua Thien Hue Province.
Hue City borders Da Nang City, Quang Nam Province, Quang Tri Province; the Lao People's Democratic Republic, and the East Sea.
Article 2. Effective Date
This Resolution shall take effect from January 1, 2025.
Article 3. Implementation Organization
Clause 1. The Standing Committee of the National Assembly, within its scope of duties and powers, decides on the reorganization and establishment of district-level administrative units and commune-level administrative units in Hue City to ensure effectiveness from the same date as this Resolution takes effect.
Clause 2. Organizations and units with names attached to the name of Thua Thien Hue Province shall change their names to operate under the name of Hue City from the date this Resolution takes effect.
Clause 3. The Government, the People's Council, and the People's Committee of Thua Thien Hue Province (the People's Council and the People's Committee of Hue City from the date this Resolution takes effect), and relevant agencies and organizations shall be responsible for implementing this Resolution; reorganizing and improving local agencies and organizations; stabilizing the lives of local residents, ensuring requirements for socio-economic development, national defense, and security in the locality.
Clause 4. In cases where the People's Council of a district in Hue City does not have two-thirds of the total number of elected members as stipulated in Point a, Clause 1, Article 46 of the Law on Local Administration Organization, the Standing Body of the People's Council of Hue City shall appoint the Acting Chairman of the People's Council of the district upon the proposal of the Standing Body of the People's Council of Hue City in Thua Thien Hue Province to perform the tasks and powers prescribed in Clause 3, Article 138 of the Law on Local Administration Organization.
The Chairman of the People's Committee of Hue City shall appoint the Acting Chairman of the People's Committee, the temporary People's Committee of the district, and decide on the establishment of specialized agencies under the temporary People's Committee of the district. The temporary People's Committee of the district shall perform the tasks and powers of the People's Committee of the district according to the law and operate until the People's Committee of the district for the term 2026-2031 is established.
Clause 5. From the date this Resolution takes effect, in addition to the systems and policies for cities under central administration, special mechanisms, systems, and policies for Thua Thien Hue Province shall continue to be implemented in Hue City until the end of the application period or until there is a decision by the competent authority.
Clause 6. The Standing Committee of the National Assembly, the Ethnic Committee, the Committees of the National Assembly, the Delegation of National Assembly Members, and National Assembly deputies, within their scope of duties and powers, shall supervise the implementation of this Resolution.
Clause 7. The Vietnam Fatherland Front and its member organizations, within their scope of duties and powers, shall supervise and publicize, mobilize the people to implement this Resolution.
This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, the 15th term, the 8th session, on November 30, 2024.
