Considering the proposal of the State Bank of Vietnam and the Ministry of Finance,

DECISION:

Article 1. Issued along with this Decision are the Working Regulations of the National Financial and Monetary Policy Advisory Council.

Article 2. This Decision shall take effect from the date of signing.

Article 3. Members of the National Financial and Monetary Policy Advisory Council and Ministers, Heads of relevant agencies shall be responsible for implementing this Decision./.

REGULATIONS

Working Regulations of the National Financial and Monetary Policy Advisory Council

PART I

GENERAL PROVISIONS

Article 1. The National Financial and Monetary Policy Advisory Council has the function of researching and advising the Government and the Prime Minister on major policies, programs, and other important issues in the field of finance and monetary policy at the macroeconomic level of the national economy.

Article 2. Principles and methods of operation of the National Financial and Monetary Policy Advisory Council:

1. The National Financial and Monetary Policy Advisory Council operates based on advisory principles.

2. The advisory opinions of the Council are discussed collectively and concluded by the chairperson of the meeting. The person chairing and concluding the Council meeting is the Chairman of the Council or the Vice-Chairman authorized by the Chairman.

3. For important issues concerning financial and monetary policy that may have significant and sensitive impacts on national defense, security, and socio-economic development, the composition of the meeting participants is proposed by the Standing Body of the Council and decided by the Chairman of the Council.

4. For large and complex projects, the Council organizes consultations with experts, business leaders, scientists, etc., before bringing them to the Council meetings for discussion.

5. In addition to organizing concentrated discussions for members to provide direct opinions at Council meetings, the Council can also seek written opinions from members.

Chapter II

TASKS, ORGANIZATIONAL STRUCTURE AND MANAGEMENT OF THE NATIONAL FINANCIAL AND MONETARY POLICY ADVISORY COUNCIL

Article 3. Tasks of the National Financial and Monetary Policy Advisory Council

The National Financial and Monetary Policy Advisory Council performs the tasks specified in Article 2 of Decision No. 175/2007/QĐ-TTg dated November 19, 2007 of the Prime Minister regarding the establishment of the National Financial and Monetary Policy Advisory Council. Specifically as follows:

1. Based on the annual work program of the Government, the National Financial and Monetary Policy Advisory Council proactively studies and proposes advisory opinions to the Government and the Prime Minister on the issues mentioned in Article 1 of these Regulations.

2. Study and advise on certain issues related to the implementation of financial and monetary policies, management and development of the financial market, and new issues arising in the field of finance and monetary policy according to the requirements of the Government, the Prime Minister, or the Chairman of the National Financial and Monetary Policy Advisory Council.

3. Study and participate in providing opinions on reports, projects, policies, and financial mechanisms proposed by ministries, sectors, and provincial people's committees to report to the Government and the Prime Minister for consideration and decision.

4. Organize discussions and collect contributions from experts, business leaders, and scientists both domestically and internationally on policies and solutions in the field of finance and monetary policy when necessary.

5. Conduct surveys and research on domestic and international practices to gather additional direct information to enhance the capacity and effectiveness of advisory services on issues within the Council's functions and tasks.

Article 4. The organizational structure of the National Financial and Monetary Policy Advisory Council includes:

1. Chairman of the Council: Deputy Prime Minister.

2. One Vice-Chairman of the Council dedicated to the position:

3. Council Members:

- Governor of the State Bank of Vietnam, a permanent member;

- Other members are leaders of relevant ministries and sectors and some experts deeply knowledgeable about the fields of finance and monetary policy.

4. Secretariat assisting the Council, including:

- The Secretary is a senior officer from the State Bank of Vietnam;

- Other members include officers from agencies such as the Ministry of Finance, the Government Office, the State Bank, and the National Financial Supervisory Authority.  

5. Members of the Council, except for the dedicated Vice-Chairman, assistive Secretariat members work on a part-time basis. Specific personnel for Council members are proposed by the Council and decided by the Prime Minister.

Article 5. Tasks and powers of the Chairman and Vice-Chairman of the Council

1. The Chairman of the Council decides on the organization and chairs meetings of the Council to discuss and conclude on issues to advise the Government and the Prime Minister, consults the opinions of experts, business leaders, and scientists both domestically and internationally, and compiles reports to submit to the Government and the Prime Minister or bring to the Council for consideration and opinion.

2. The Vice-Chairman and the Permanent Member of the Council perform tasks assigned by the Chairman of the Council.

Article 6. Tasks and powers of Council members

1. Council members are responsible for fully participating in all Council meetings and activities, preparing to contribute opinions on issues listed in the agenda of the meeting. Absent members must submit their written opinions to the Council's Secretariat for consolidation and reporting to the Chairman of the Council. Members have the right to debate frankly, constructively, and retain their opinions.

2. Opinions of Council members during discussions, if different from the conclusions of the meeting chairperson, shall be reported fully to the Prime Minister.

3. Council members are provided with information and materials related to financial and monetary policies for study and contribution of opinions, while they must bear responsibility for the confidentiality of the provided information and materials according to the law and directives of competent authorities.

4. Members of the Council and staff of the Secretariat assisting the Council shall be entitled to a level of remuneration to encourage their contributions and responsibility for participating in the activities of the Council.

Article 7. Duties of the Secretariat assisting the Council

1. Prepare the annual work program of the Council and the agenda of each meeting of the Council for approval by the Chairman of the Council.

2. Urge relevant ministries and sectors to prepare reports on issues related to the requirements of the Chairman of the Council; send necessary documents to members of the Council; compile opinions from discussions among Council members, representatives of various departments, experts, enterprises, and scientists regarding issues and projects requiring consultation.

3. Prepare documents announcing the conclusions of meetings and comprehensive reports on the advisory opinions of the Council for approval by the Chairman of the Council.

4. Send notifications of conclusions and other contents of meetings to absent members; compile written opinions of absent members to report to the Council.

5. Participate with the Government Office in preparing Resolutions, Decrees, and Decisions of the Government and Prime Minister concerning financial and monetary matters for which the Council is responsible for advising.

6. Prepare periodic reports on the activities of the Council for approval by the Chairman of the Council to report to the Government and Prime Minister.

7. Carry out administrative and material conditions, including funding, for the activities of the Council and its members.

Article 8. Coordination and working relations between the National Financial and Monetary Policy Advisory Council and ministries and sectors

1. The National Financial and Monetary Policy Advisory Council shall coordinate with ministries and sectors in preparing reports and projects on financial and monetary policies, organizing, studying, and discussing these reports and projects to advise the Government and Prime Minister.

2. Ministries and sectors shall be responsible for providing information and documents related to projects to members of the Council through the Head of the Secretariat assisting the Council and directly reporting and explaining projects at Council meetings.

3. The Council shall be responsible for informing ministries and sectors that have submitted reports and projects of the Council's opinions and sending them to the Government Office.

4. Documents of the Council shall be signed by the Chairman using the seal of the Government, by the Vice-Chairman in charge using the seal of the Government Office, and by the Standing Member of the Council using the seal of the State Bank of Vietnam.

5. The Government Office shall provide documents, materials, information, and press related to the functions and duties of the Council and ensure material conditions, funding, and benefits as prescribed for the Vice-Chairman in charge; ensure conditions for serving meetings when the Council holds meetings at the Government Office premises.

Article 9. Contents of discussions of the Council, opinions from discussions of members, conclusions of Council meetings, and related documents must be kept confidential in accordance with the provisions of the law.

Article 10. Funding for the operation of the Council

1. The operational funding of the Council shall be provided by the State Bank and recorded as part of the operational expenses of the State Bank. This funding is used to cover needs for meetings, seminars, research, surveys both domestically and internationally, administrative work, material conditions, and allowances for members of the Council and the Secretariat assisting the Council.

2. The level of allowance for members of the Council and the Secretariat assisting the Council shall be determined by the Governor of the State Bank of Vietnam.

Chapter III

FINAL PROVISION

Article 11. This Regulation takes effect from the date of signature and replaces previous documents issued regarding the Operational Regulations of the National Financial and Monetary Policy Advisory Council.

Article 12. Any amendments or supplements to this Regulation shall be proposed by the National Financial and Monetary Policy Advisory Council and decided upon by the Prime Minister. /./
