THE MINISTER OF FINANCE
- Pursuant to the Government Decree No. 86/2002/NĐ-CP dated November 5, 2002 stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
- Pursuant to Decree No. 77/2003/ND-CP dated July 1, 2003 of the Government on the functions, tasks, powers and organizational structure of the Ministry of Finance;
- Pursuant to Circular No. 1912/BNV-TCCB dated August 15, 2003 of the Ministry of Home Affairs regarding agreement on establishing rooms at some units under the Ministry of Finance;
Considering the proposal of the Department Head of the Department of Organization and Civil Servants,
DECISION:
Article 1:
The Department of Organization and Civil Servants is a unit within the state management machinery of the Ministry of Finance, assisting the Minister of Finance in uniformly managing the organizational structure, staffing, salary, personnel, training and development of civil servants of the Ministry of Finance.
Article 2:
The Department of Organization and Civil Servants has the following tasks:
1. On organizational structure:
a. Submitting to the Ministry proposals for improving the organizational structure of the Ministry of Finance and its affiliated organizations and units;
b. Submitting to the Ministry draft documents defining the functions, tasks, powers, and organizational structure of the Ministry of Finance;
c. Reviewing and submitting to the Ministry draft documents defining the functions, tasks, powers, and organizational structure of organizations and units under the Ministry;
d. Submitting to the Ministry decisions on establishing, merging, dissolving, renaming, and defining the tasks, powers, and organizational structure of units within the organizational structure of organizations and units under the Ministry;
đ. Submitting to the Ministry issuance of guiding documents on tasks, powers, and organizational structures of financial management bodies of ministries, central agencies, and local authorities at all levels as prescribed by law;
e. Cooperating with related organizations and units under the Ministry to review and submit to the Ministry proposals for establishing, merging, dissolving, privatizing, restructuring, and reorganizing enterprises under the Ministry;
g. Submitting to the Ministry establishment of organizations with a definite term to implement specific tasks within the Ministry's authority;
h. Implementing and guiding, inspecting organizations and units under the Ministry in implementing regulations on organizational structure issued by the Government and the Ministry of Finance;
2. On staffing and salary management:
a. Submitting to the Ministry plans for building and allocating annual staffing quotas and salary funds for units funded from the state budget; submitting to the Ministry approval of staffing quotas or guidance on staffing standards for public service units;
b. Implementing and guiding, inspecting organizations and units under the Ministry in implementing state and Ministry regulations on staffing, labor, and salary management;
c. Participating in reviewing salary unit prices and ranking enterprises under the Ministry;
3. On personnel management:
a. Submitting to the Ministry issuance of documents on personnel management and decentralization of personnel management responsibilities, implementation, and uniform guidance in organizations and units under the Ministry;
b. Submitting to the Ministry issuance of documents defining job titles, professional standards, recruitment exams, promotion exams, civil servants, and officials according to state regulations;
c. Managing recruitment, appointment, promotion, transfer, salary increase, and salary supplements; managing identification numbers, codes, and insignias of civil servants and officials;
d. Submitting to the Ministry plans for recruiting, utilizing, developing human resources, planning and implementing rotation, retirement, resignation, or policy resolution for civil servants and officials under the Ministry's management according to state regulations and implementing after approval;
đ. Guiding organizations under the Ministry in planning cadres, drafting recruitment, deployment, utilization, retirement, resignation, or policy resolution plans for cadres, civil servants, and officials under their management; inspecting organizations in implementing these plans;
e. Submitting to the Ministry decisions or making decisions within their authority on recruitment, appointment, reappointment, dismissal, grading, promotion, disciplinary action, transfer, retirement, resignation, or policy resolution for cadres, civil servants, and officials under the Ministry's management;
g. Guiding and compiling periodic evaluations of cadres and civil servants as prescribed; statistically analyzing the composition and quality of the cadre and civil servant workforce for management and human resource development;
h. Submitting to the Ministry decisions on dispatching cadres, civil servants, and officials under the Ministry's management for domestic and international work, study, training, inspection, and survey missions; dispatching civil servants to perform tasks as required by the Government or the Ministry;
i. Organizing recruitment examinations and grade promotion examinations for civil servants as prescribed by the state;
k. Uniformly managing the comprehensive files of cadres and relevant documents related to their work and study processes under the Ministry's management; guiding units under the Ministry in managing, exploiting, using, and storing cadre files according to the law;
4. On training and development:
a. Based on cadre planning, submitting to the Ministry plans for training and developing cadres, civil servants, and officials of the Ministry of Finance and implementing after approval by the Ministry;
b. Establishing and allocating annual training quota plans for secondary, college, university, and postgraduate levels of training institutions under the Ministry, submitting to the Ministry for approval;
c. Submitting to the Ministry issuance of a framework training program for secondary level finance and accounting; content, program, and plan for secondary level training of schools under the Ministry;
d. Managing and guiding training, development, and scientific research institutions under the Ministry in implementing assigned tasks;
đ. Submitting to the Ministry regulations on decentralization of training and development of cadres and civil servants; guiding and inspecting organizations under the Ministry in implementing after issuance; guiding the implementation of cadre and civil servant training and development work according to state regulations;
e. Chairing the organization of reviews and approvals of regular training and development content and programs, position-specific training and development, grade promotion training and development, and specialized training and development for cadres and civil servants;
g. Chairing the implementation of the establishment and allocation of state-provided training and development funding budgets, submitting to the Ministry for approval; coordinating with units to inspect the management and use of such funds;
h. Manage the issuance of various training and development certificates according to the division of labor assigned by the Ministry.
5. Regarding inspection of organizational and personnel work:
a. Assist the Minister in regularly inspecting the implementation of state regulations and those of the Ministry concerning organizational work, staffing, labor, salary, personnel, and training and development of civil servants and public officials of all units under the Ministry, promptly report to the Ministry and propose measures to prevent violations; guide units with delegated authority on organizational and personnel work to inspect state and Ministry regulations on organizational work, staffing, labor, salary, personnel, and training and development of civil servants and public officials;
b. Handle cases of violation of state and Ministry regulations on organizational work, staffing, labor, salary, personnel, and training and development of organizations under their management within their authority or refer them to the Ministry for handling;
c. Handle cases of violation within their authority and urge and inspect units under the Ministry in resolving complaints and reports related to organizational and personnel work and training and development;
6. Organize statistical work, synthesis, and analysis of organizational and personnel work and training of the Ministry of Finance; implement statistical work and reporting on organizational work, staffing, labor, salary, personnel, and training and development in accordance with state and Ministry regulations;
7. Propose and organize the implementation of international cooperation and integration tasks in the field of organization, personnel, training, and development according to the division of labor assigned by the Ministry;
8. Organize scientific research or cooperate in scientific research with units inside and outside the sector according to the plan and content of topics approved by the Ministry;
9. Serve as a permanent member of recruitment examination boards, promotion examination boards, and other boards related to personnel and civil servant work of the Ministry; participate in other boards as assigned by the Ministry;
Article 3:
The Director of the Personnel Department has the right:
1. To sign memorandums, decisions regarding organization, staffing, labor, salary, personnel, and training and development of cadres and civil servants according to the division of labor and delegation of authority by the Ministry;
2. To request units under the Ministry to submit ad hoc and periodic reports on areas managed by the Department as stipulated; to receive all files, documents, regulatory texts, and other relevant documents concerning the performance of assigned functions and tasks;
3. To sign documents explaining, responding, or relating to work within the purview of the Department;
Article 4:
The Personnel Department consists of a Director and several Deputy Directors assisting the Director.
The Director is responsible for comprehensive management of the Department's work as prescribed; is accountable to the Minister for all activities of the Personnel Department.
Deputy Directors are accountable to the Director for the tasks assigned to them.
The Personnel Department includes the following divisions:
1. Division of Organization - Staffing
2. Human Resources Division 1
3. Human Resources Division 2
4. Training Division
Specific tasks of the divisions are defined by the Director of the Personnel Department.
The Personnel Department operates under a specialist system combined with divisional organization. For tasks performed under the specialist system, the Director of the Personnel Department is responsible for organizing work and assigning tasks to civil servants in accordance with their job titles, standards, and professional capabilities, ensuring the fulfillment of assigned tasks.
The staffing of the Personnel Department is determined by the Minister of Finance.
Article 5:
This Decision takes effect from the date of signing. Decree No. 611 TC/QĐ/TCCB dated July 10, 1996, issued by the Minister of Finance on the establishment of the Regulations on the organization and operation of the Personnel Department and Training is hereby abolished.
The Director of the Personnel Department, the Head of the Office of the Ministry of Finance, and the Heads of units and organizations under the Ministry are responsible for implementing this Decision./.
