Pursuant to the Inspection Law dated June 15, 2004;
Pursuant to Decree No. 55/2005/NĐ-CP-dated April 25, 2005 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;
Pursuant to Decree No. 115/2005/NĐ-CP dated September 5, 2005 of the Government stipulating the mechanism of self-management and self-responsibility of public scientific and technological organizations;
Pursuant to Decision No. 1963/2006/QĐ-TTCP dated October 20, 2006 of the Chief Inspector promulgating the Working Regulations of the Government Inspectorate;

Article 1. This Decision promulgates the "Regulations on Functions, Tasks, Powers, and Organization of Operation of the Institute for Inspection Science" attached hereto.
Article 2. This Decision takes effect from the date of signature and replaces Decision No. 776/TTNN dated July 3, 2003 of the State Inspector General regarding the issuance of the Organizational and Operational Regulations of the Institute for Inspection Science.
Article 3. The Heads of the Office, the Cadre and Civil Service Organization Department, the Director of the Institute for Inspection Science, and the Heads of units under the Government Inspectorate are responsible for implementing this Decision./.
REGULATIONS
FUNCTIONS, TASKS, POWERS AND ORGANIZATION OF OPERATION OF THE INSTITUTE FOR INSPECTION SCIENCE

Chapter I.
FUNCTIONS, TASKS, POWERS
Article 1. Position and Functions
The Institute for Inspection Science is a public service entity under the Government Inspectorate, having the function of conducting scientific research to serve the development of strategies, policies, and management of state administration in the inspection sector; researching scientific issues related to inspection, complaint resolution, accusation handling, and anti-corruption; assisting the Chief Inspector in organizing the management of scientific research activities in various fields of the inspection sector as prescribed by law; organizing the application of scientific research results in state administration, training, and cadre improvement.
The Institute for Inspection Science has its own seal and separate account, with its main office located in Hanoi City.
Article 2. Tasks and Authorities
The Institute for Inspection Science has the following tasks and powers:
1. Conducting scientific research in various fields of the inspection sector:
a. Researching issues to serve the development of strategies, policies, and systems in the inspection sector;
b. Conducting scientific research on inspection practices, complaint resolution, accusation handling, and anti-corruption;
c. Researching scientific topics according to plans approved by the Chief Inspector;
d. Cooperating with units to apply research results in inspection work, complaint resolution, accusation handling, anti-corruption, and cadre training and improvement;
đ. Researching the establishment of professional ethics and inspection culture systems;
e. Summarizing practical experiences in various fields of the inspection sector through different stages;
f. Advising the leadership of the Government Inspectorate on issues with differing opinions in inspection work, complaint resolution, accusation handling, and anti-corruption when requested by the leadership of the Government Inspectorate.
2. Managing scientific research activities:
a. Developing long-term and annual scientific research plans to be submitted to the leadership of the Government Inspectorate and the Ministry of Science and Technology;
b. Advising the leadership of the Government Inspectorate on the allocation or allocation within their authority of research topics and funds annually;
c. Implementing and guiding, supervising the implementation of approved research plans; organizing scientific seminars and finalizing research topics;
d. Guiding and coordinating with inspection units of ministries, sectors, and provinces, centrally-administered cities in scientific research activities in various fields of inspection, complaint resolution, accusation handling, and anti-corruption;
đ. Advising the leadership of the Government Inspectorate on the organization of the Government Inspectorate's Scientific Council; performing the permanent duties of the Scientific Council.
e. Organizing mid-term and final summaries of scientific research activities serving the management functions of the Government Inspectorate.
3. Information and library services:
a. Compiling and issuing information and reference materials on scientific research in various fields of the inspection sector in accordance with the law;
b. Building and managing databases of information and reference materials and libraries under the Government Inspectorate.
4. Providing scientific services in accordance with the functions and tasks of the Institute for Inspection Science as prescribed by law.
5. Providing advisory and knowledge enhancement services on inspection practices, complaint resolution, accusation handling, and anti-corruption for agencies, organizations, and units upon request.
6. Participating in developing training programs and curricula for inspection cadres.
7. Implementing international cooperation within the assigned authority for scientific research in the field of inspection, complaint resolution, accusation handling, and anti-corruption.
8. Managing personnel, civil servants, and employees of the Institute in accordance with the law and the delegation of the Chief Inspector.
9. Managing and using assets and finances allocated in accordance with the law and the Government Inspectorate.
10. Performing other tasks assigned by the Chief Inspector.
Chapter II.
ORGANIZATIONAL STRUCTURE, RESPONSIBILITIES, AND SCOPE OF WORK HANDLING
Article 3. Organizational Structure and Staffing
1. The leadership of the Institute for Inspection Science consists of the Director and Deputy Directors.
2. The functional departments of the Institute include:
2.1- Department of Scientific Research and Summary of Practical Inspection Work, Complaint Resolution, and Anti-Corruption Prevention and Struggle (shortened as the Research Department);
2.2- Department of Training and Cadre Improvement (shortened as the Training Department);
2.3- Department of Information and Library Services;
2.4- Department of Consolidation and Administration.
Specific tasks and powers of the departments are defined by the Director of the Institute for Inspection Science based on the assigned functions and tasks.
3. The staffing of the Institute for Inspection Science is scientific public service staffing determined by the Chief Inspector based on the proposal of the Director of the Institute for Inspection Science and the Head of the Cadre and Civil Service Organization Department.
Article 4. Duties and Powers of the Director
The Director of the Institute of Inspection Science shall have the following tasks and powers:
1. Serve as the permanent member of the Government Inspectorate's Scientific Council, advising the Chief Inspector on scientific research activities of the Government Inspectorate.
2. Organize the implementation of the Institute’s tasks as stipulated in Article 2 of this Regulation; be responsible under the law and to the Chief Inspector for the results of the Institute’s tasks.
3. Direct the development of the Institute’s work plan.
4. Assign tasks, coordinate activities, and monitor the performance of tasks by Deputy Directors, functional departments, and staff members within the Institute.
5. Maintain discipline, manage, evaluate, and implement commendation and reward activities for staff members within the Institute; develop and implement personnel planning and training plans for the Institute.
6. Establish scientific labor norms suitable for the Institute's requirements based on consultations with trade union organizations.
7. Decide on the use and management of the Institute’s budget and assets according to current state financial regulations.
8. Coordinate with Department Heads and Unit Chiefs under the Government Inspectorate to handle issues related to the Institute's functions and tasks, and perform common agency duties as prescribed in the Government Inspectorate's Operational Regulations.
9. Delegate the Director of the Institute of Inspection Science the authority to:
9.1- Decide on the recruitment of civil servants through competitive examinations or selection processes, after reporting (through the Organization and Cadre Affairs Department) and obtaining approval from the Chief Inspector; sign employment contracts with recruited individuals.
9.2- Decide on the appointment, reappointment, resignation, and removal of heads and deputy heads of subordinate units, after reporting (through the Organization and Cadre Affairs Department) and obtaining consent from the Chief Inspector for appointment.
9.3- Sign labor contracts and task assignment contracts to carry out tasks that do not require regular staffing as prescribed by law.
9.4- Decide on the arrangement and utilization of staff members in accordance with their capabilities and professional qualifications.
9.5- Decide on the transfer, secondment, retirement, termination of employment, and termination of labor contracts in accordance with the law.
9.6- Resolve complaints and accusations against managed staff members in accordance with the law.
9.7- Decide on salary grading for staff members recruited to work at the Institute; decide on timely and early salary grade promotions within the same rank (except for senior research officer ranks and equivalent); decide on appointments to civil servant ranks and transfers between civil servant ranks from senior research officer and equivalent ranks downwards.
9.8- Decide on commendations and disciplinary actions for managed staff members in accordance with the law.
9.9- Decide on sending staff members under the Institute's management to work assignments, scientific conferences, training, and overseas studies.
9.10- Decide on sending staff members to participate in teaching, scientific research, and other scientific services within the Institute's functions and tasks.
9.11- Establish and manage all personnel files of staff members and contractual staff of the Institute of Inspection Science (excluding the Director and Deputy Directors' files). Statistically report the personnel strength of managed staff members to the Government Inspectorate as prescribed.
Article 5. Tasks and Powers of Deputy Directors
1. Deputy Directors are leading cadres of the Institute, assisting the Director in managing and operating the Institute's affairs; directly managing certain areas of work as assigned by the Director and being accountable to the Director for the assigned tasks.
2. Deputy Directors shall exercise the Director's tasks and powers within the scope delegated by the Director.
Article 6. Duties and Authorities of the Department Heads and Deputy Department Heads under the Institute
1. The Department Head is responsible for managing and directing the work of the Department and is accountable to the Institute Director for the implementation of assigned tasks.
The Deputy Department Head assists the Department Head in managing and directing the work of the Department and is accountable to the Department Head for the implementation of assigned tasks.
2. Specific duties and authorities of the Department Heads and Deputy Department Heads shall be stipulated by the Institute Director.
Article 7. Duties and Authorities of Staff Members under the Institute of Inspection Science
Staff members of the Institute of Inspection Science are subject to general management by the Institute Director and their direct supervisors; they have rights and obligations as prescribed by laws on staff members and labor laws.
Chapter III.
WORKING REGIME
Article 8. Principles of Work
The Institute of Inspection Science operates under the head system, ensuring the principle of democratic centralism, emphasizing individual responsibility and discipline, and promoting initiative and creativity in scientific research activities of all staff members within the Institute.
Article 9. Planning System
1. Based on the scientific research program and key tasks of the Government Inspectorate, the Institute Director decides on the Institute's work plan (including plans for implementing scientific projects and other work plans) and provides guidance and organizes inspections for the implementation of these plans.
2. In necessary cases, the Institute Director promptly reports and seeks opinions from the Government Inspectorate Leadership to adjust the Institute's work plan to suit actual conditions.
Article 10. Reporting and Information System
1. Periodic and ad hoc reporting of the Institute's work is carried out according to the Working Regulations of the Government Inspectorate.
Plans and reports of units under the Institute are regulated by the Institute Director.
2. The Institute has the responsibility to inform staff members about the following information:
- Policies and guidelines of the Party, State, and Government Inspectorate related to the functions and tasks of the Institute and the sector;
- Internal regulations and working regulations of the Government Inspectorate and the Institute;
- Work programs of the Government Inspectorate and the Institute;
- Financial income and expenditure activities of the Institute of Inspection Science;
- Recruitment, study abroad, commendation, disciplinary actions, salary increments, rank promotions, and appointments and dismissals of staff members under the Institute;
- Conclusions on the resolution of complaints and denunciations related to staff members under the Institute;
- Other information as directed by the Chief Inspector.
3. The exchange and provision of information by staff members under the Institute must be conducted in accordance with the provisions of the law, the sector of the Inspectorate, and the Government Inspectorate agency.
Article 11. Management and Use of Finance and Assets of the Institute
The management and use of finance and assets of the Institute are implemented in accordance with the provisions of Decree No. 115/2005/NĐ-CP dated September 5, 2005, of the Government on the mechanism of self-management and self-responsibility of public science and technology organizations and guiding documents.
Chapter IV.
WORK RELATIONSHIPS
Article 12. Implementation of Directives of the Government Inspectorate Leadership
The Institute of Inspection Science is subject to leadership and direct directives from the Chief Inspector and the Deputy Chief Inspector responsible for scientific research and is responsible for:
1. Strictly implementing directives;
2. Reporting the results of directive implementation fully and promptly.
Article 13. Work Relations with Departments and Units under the Government Inspectorate
1. The relationship between the Institute of Inspection Science and departments and units under the Government Inspectorate is one of coordination, exchange, and mutual support to complete tasks.
2. When the Institute of Inspection Science is assigned the main responsibility to coordinate with departments and units within the agency to implement assigned tasks, the Institute of Inspection Science is responsible for actively discussing and reaching consensus with coordinating units to resolve related issues. When submitting matters related to other departments and units to the Chief Inspector, written opinions of those departments and units must be included.
Article 14. Relations with the Ministry of Science and Technology and other competent agencies
The Institute of Inspection Science is responsible for assisting the Chief Inspector in implementing systems for building and protecting research programs and serving scientific research, and implementing information and reporting systems with the Ministry of Science and Technology and other competent agencies as prescribed by law.
Article 15. Relations between Institute Leadership and Party Committees and Leadership of Mass Organizations
1. Institute leadership creates conditions for the Party organization and mass organizations to operate according to their charters, purposes, and objectives; coordinates with Party committees and leadership of mass organizations to create conditions for party members and staff members of the Institute to enhance political and professional qualifications, work effectively; ensures the implementation of grassroots democracy regulations in the Institute's operations, builds a culture in the research environment, and maintains organizational discipline.
2. Institute leadership is responsible for providing full and timely information about the Institute's activities and staff benefits to Party committees and leadership of mass organizations; consults with Party committees and leadership of mass organizations before making decisions on measures for leading ideological education, internal protection, consolidating unity, and caring for the lives of staff members in the Institute; regarding the Institute's personnel organization work.
Chapter V.
IMPLEMENTATION
Article 16. Responsibility for Implementation
1. The Institute Director, Deputy Directors, and all staff members of the Institute of Inspection Science are responsible for implementing this Regulation. The Institute Director is responsible for disseminating this Regulation to all staff members of the Institute to organize its implementation.
2. Matters related to the functions, tasks, authorities, and organization of the Institute that are not covered in this Regulation shall be implemented in accordance with the Working Regulations of the Government Inspectorate and current laws.
3. The Institute Director of the Institute of Inspection Science, the Department Head of the Organization and Cadre Department, and the Office Director are responsible for monitoring, inspecting, and urging the implementation of this Regulation; collecting comments, researching, and promptly proposing supplements and amendments to the Regulation, consistent with the requirements of the Institute of Inspection Science and the Government Inspectorate./.
