On some measures to accelerate the completion of issuing certificates of land use rights for agricultural land, forestry land, and rural residential land by the year 2000

As of now, the work of allocating agricultural land according to Decree No. 64/CP dated September 27, 1993 of the Government has been completed nationwide, but only over 73% of households with nearly 71.5% of the area of agricultural land have received certificates of land use rights. In particular, many provinces such as Lai Chau, Bac Giang, Ha Tay, Thua Thien Hue, Quang Ngai, Gia Lai have only reached a ratio below 20%; provinces and cities such as Hanoi, Ha Nam, Thai Binh, Phu Tho, Hoa Binh, Son La, Quang Binh, Quang Tri, Kon Tum have only reached a ratio below 50%, causing many difficulties in implementing the rights of land users as prescribed by law, especially the transfer, joint venture, and mortgage of land use rights for borrowing to promote production development.
To ensure the basic completion of issuing certificates of land use rights for agricultural land in 1999, forestry land, and rural residential land in 2000 as decided by the National Assembly and the Government, the Prime Minister requests the Director General of the Land Administration General Department and the Chairmen of the People's Committees of the provinces and centrally-administered cities to specifically direct and strictly implement Directive No. 10/1998/CT-TTg dated February 20, 1998 of the Prime Minister and immediately carry out the following actions to speed up the issuance of certificates of land use rights in 2000:
1. Based on existing materials and diagrams in the allocation of land to households, where households are using land without disputes, they self-declare and bear responsibility for the area of land their household is currently using, then they will be issued certificates of land use rights. Subsequently, measurements will be conducted to determine the official data to be supplemented into the certificate of land use rights.
2. Allow exemption from the fee for issuing certificates of land use rights for the people in 1,715 poor communes, remote areas, highland regions, and border communes.
3. The People's Committees of the provinces may use local contingency funds to promptly address the needs to speed up the issuance of certificates of land use rights; for localities facing difficulties with contingency funds, specific negotiations should be held with the Ministry of Finance to resolve according to general regulations.
4. For agricultural land in cities, towns, and townships, although there are plans for urban expansion, industrial zones, and residential areas, if construction has not yet commenced in the coming years, certificates of land use rights for agricultural land must still be issued to ensure the people's peace of mind for production.
5. For urban residential land and rural residential land, related to changes in land use rights without payment of land use fees and land transfer taxes to receive certificates of land use rights, allow the People's Committees of the provinces and cities to record debts for land use fees and land transfer taxes on the certificates of land use rights, and households receiving certificates of land use rights must gradually repay or pay in full if they exercise rights according to Decree No. 17/1998/NĐ-CP dated March 29, 1999 of the Government.
The Director General of the Land Administration General Department is responsible for assisting the Government in directing and providing specific guidance on the implementation of this Directive at local levels and reporting to the Prime Minister every three months on the progress of implementation until the end of 2000; coordinating with the Ministry of Finance to guide localities in using contingency funds to speed up the issuance of certificates of land use rights, exempting collection of land administration fees for issuing certificates of land use rights for households in poor communes and border communes, and recording debts for land use fees and land transfer taxes on certificates of land use rights.
The Chairmen of the People's Committees of the provinces and cities must directly direct the implementation of this Directive and report to the Prime Minister the results of implementation in their locality every six months until the end of 2000.
