DECREE OF THE GOVERNMENT
Regulations on functions, tasks, authorities and organizational structure of the Government Office
||| Based on Resolution No. 02/2002/QH11 dated August 5, 2002 of the National Assembly of the Socialist Republic of Vietnam, the 11th session, first meeting, listing the Ministries and ministerial-level agencies of the Government;
THE GOVERNMENT
On the basis of Law on Government Organization dated December 25, 2001;
||| Based on Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, authorities, and organizational structure of Ministries and ministerial-level agencies;
||| At the proposal of the Minister and Head of the Government Office and the Minister of Home Affairs,
||| The Government Office is a ministerial-level agency, serving as the machinery for the Government and the Prime Minister.
DECREE:
Article 1. Position and functions:
||| The Government Office has the function of organizing common activities of the Government and the Prime Minister; advising the Prime Minister in directing and managing common activities of the state administrative apparatus; assisting the Prime Minister in coordinating and harmonizing the activities of Ministries, ministerial-level agencies, agencies under the Government, People's Councils, and People's Committees of provinces and centrally governed cities to implement the program and plan of work of the Government and the Prime Minister; building, managing, and implementing the working regulations, program, and plan of work of the Government and the Prime Minister; ensuring material and technical conditions for the activities of the Government and the Prime Minister.
||| Tasks and Authorities:
Article 2||| The Government Office is responsible for performing the tasks and authorities specified in Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government, stipulating the functions, tasks, authorities, and organizational structure of Ministries and ministerial-level agencies, and the following specific tasks:
||| 1. Building and managing the program, plan of work, and working regulations of the Government and the Prime Minister; monitoring, urging, and inspecting Ministries, ministerial-level agencies, agencies under the Government, and People's Committees of provinces and centrally governed cities to implement these programs, plans, and regulations.
||| 2. Advising the Prime Minister on selecting important issues regarding policies, laws, management mechanisms to be assigned to relevant Ministries and agencies for study and submission to the Government and the Prime Minister; receiving, examining (legality, compliance with regulations, and suitability with policies) and submitting to the Prime Minister for consideration and decision on regular matters submitted by Ministries, sectors, and localities within the Prime Minister’s authority.
||| 3. Assisting the Prime Minister in coordinating and harmonizing the programs and plans of work of Ministries, ministerial-level agencies, agencies under the Government, and People's Committees of provinces and centrally governed cities during the implementation of the Government and Prime Minister's programs and plans. Issuing documents to announce the Prime Minister's directives on matters within the Prime Minister's responsibility.
||| 4. Organizing and serving meetings of the Government, working sessions of the Prime Minister and Deputy Prime Ministers with Government agencies, political-social organizations, and local governments, including preparing content, schedules, material conditions, managing files, recording minutes, editing Resolutions, Directives, and conclusions of the Prime Minister and Deputy Prime Ministers.
||| 5. Organizing research and drafting projects assigned by the Prime Minister for submission to the Government and the Prime Minister for consideration and decision.
||| 6. Assisting the Government and the Prime Minister in urging Ministries, ministerial-level agencies, agencies under the Government, and People's Committees of provinces and centrally governed cities in preparing assigned projects and drafting accompanying legal regulatory documents. Being responsible for examining (administrative procedures, legality, alignment with Party and State policies, and alignment with Prime Minister directives), analyzing, synthesizing, providing independent evaluations of project contents, and making final revisions to draft legal regulatory documents accompanying projects to submit to the Government and the Prime Minister for decision.
||| 7. Uniformly managing the issuance of documents from the Government and the Prime Minister submitted by Ministries, ministerial-level agencies, agencies under the Government, and People's Committees of provinces and centrally governed cities.
||| 8. Organizing the publication and dissemination of Government Resolutions and Decrees, and Prime Minister Decisions; monitoring and inspecting the implementation of Resolutions, Decrees, and Decisions, and adherence to administrative discipline in Ministries, sectors, and localities to report and make recommendations to the Prime Minister on necessary measures to ensure the effectiveness of Government Resolutions and Decrees and Prime Minister Decisions.
||| 9. Under the delegation of the Prime Minister, the Minister and Head of the Government Office chairs meetings with Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally governed cities, and related agencies and organizations to unify opinions on inter-ministerial issues and issues where functional agencies have differing opinions, for submission to the Prime Minister for decision.
||| 10. Submitting to the Government and the Prime Minister for issuance or issuing within their authority regulations on administrative procedures in handling work and managing public documents in state administrative agencies.
||| 11. Providing professional guidance on office work to the Offices of Ministries, ministerial-level agencies, agencies under the Government, People's Councils, and People's Committees of provinces and centrally governed cities.
||| 12. Organizing the provision of operational information to support the Government and Prime Minister's directive work; managing and maintaining the continuous operation of the Government's wide-area network.
11. Organize the provision of management information to serve the directive work of the Government and the Prime Minister; manage and maintain the continuous operation of the Government's wide-area learning network.
Regularly provide information to the heads of government agencies under the Government, Chairpersons of Provincial People's Committees directly under the Central Government, and Party and State agencies on the general situation of the country's socio-economic development; activities of state management by the Government and guidance and administration by the Prime Minister and Deputy Prime Ministers; provide information to the press on the main activities and important decisions of the Government and the Prime Minister, significant economic-political-social events, and matters of public concern.
12. Assist the Prime Minister in implementing the regulations on cooperation in work between the Government and Party agencies, the National Assembly, the Central Committee of the Vietnam Fatherland Front, and central agencies of people's mass organizations, the Supreme People's Procuracy, and the Supreme People's Court.
13. Manage, publish, and distribute the Official Gazette of the Socialist Republic of Vietnam; manage the Government’s website published on the Internet.
Ensure material and technical conditions for the operation of the Government, the Prime Minister, and advisory organizations and inter-ministerial coordination bodies set up by the Prime Minister at the Government Office. Manage the organizational structure, staffing, officials and civil servants, budget, assets, projects, scientific research tasks assigned according to State regulations.
15. Implement management over areas of work and other tasks assigned by the Government and the Prime Minister.
Article 3The organizational structure of the Government Office:
a. Departments, Bureaus, units performing functions of the Government Office:
1. General Department.
2. Legal Affairs Department.
3. Comprehensive Economic Department.
4. Industry Department.
5. Agriculture Department.
6. Oil and Gas Department.
7. Department for Monitoring Business Reform and Development (referred to as the Business Reform Department).
8. International Relations Department (including the Management Board for Projects of the Government Office).
9. Internal Affairs Department.
10. Department for Monitoring Anti-Corruption, Smuggling, and Commercial Fraud Activities (referred to as Department I).
11. Complaints and Accusations Handling Department (referred to as Department II).
12. Department for Coordinating Work Between the Government and Agencies of the National Assembly, People's Councils, the Central Committee of the Vietnam Fatherland Front, and Central Agencies of People's Mass Organizations (referred to as Department III).
13. Department for Monitoring Work Areas in the South (referred to as Department IV).
14. Localities Department.
15. Education and Science Department.
16. Cultural and Social Department.
17. Administrative Reform Department.
18. Cadres and Civil Servants Organization Department.
19. Administrative Department (including: Document Room, Typing Room, Archive Room).
20. Administration and Finance Bureau (including: Level I Financial Room, Level II Financial Room, Administration Room, Reception Room, Government Working Building Management Room, Security Room, Health Room, Vehicle Unit, and revenue-generating units: 37 Hung Vuong Guest House, International Conference Center, La Thanh Hotel).
21. Administrative and Management Bureau II (in Ho Chi Minh City, including: Administrative and Organizational Room, Management Room, Financial Room, Security Room, Vehicle Unit, and revenue-generating units: Tao Dan Guest House, Thong Nhat Conference Hall).
b. Non-profit organizations under the Government Office:
1. Press Information Center.
2. Computer Center.
Article 4Implementation clause:
This Decree takes effect fifteen days from the date of publication in the Official Gazette and replaces Decree No. 50/ND-CP dated August 6, 1993 of the Government on the functions and tasks of the Government Office; all other provisions contrary to this Decree shall be abolished.
The Minister, Head of the Government Office, shall stipulate the functions and tasks of units under the Government Office (as provided for in Article 3) and the operational regulations of the Government Office.
Article 5The Minister, Head of the Government Office, ministers, heads of ministries equivalent to ministries, heads of government agencies, chairpersons of provincial people's committees directly under the Central Government are responsible for enforcing this Decree./.
