Circular No. 18/2005/TT-BKHCN guiding the implementation of the allowance system for leadership positions in scientific and technological organizations

CIRCULAR

GUIDELINES FOR IMPLEMENTING THE SUBSIDY SYSTEM FOR LEADERSHIP POSITIONS IN ORGANIZATIONS OF SCIENCE AND TECHNOLOGY

Pursuant to Decree No. 54/2003/ND-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/ND-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/ND-CP;

Implementing Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Officials, Civil Servants, and Military Personnel;

After reaching consensus with the Ministry of Home Affairs and the Ministry of Finance, the Ministry of Science and Technology hereby provides guidelines for implementing the subsidy system for leadership positions in state science and technology organizations as follows:

I. GENERAL PROVISIONS

This Circular applies to units under the Ministry of Education and Training; departments of education and training, education and training divisions; preschool education institutions, general education institutions, regular education institutions, teacher training colleges, college of education, universities, universities, academies, other educational institutions, and related organizations and individuals (hereinafter referred to collectively as agencies and units).

This Circular stipulates the coefficient for the subsidy for leadership positions applicable to officials appointed to leadership positions in state scientific research organizations, scientific research and technological development organizations, and scientific and technological service organizations (including scientific research organizations, scientific research and technological development organizations, and scientific and technological service organizations under universities).

2. The implementation of the subsidy system for leadership positions in the aforementioned science and technology organizations must comply with the provisions of Circular No. 02/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs guiding the implementation of the subsidy system for leadership positions for civil servants and officials, and Section II of Circular No. 83/2005/TT-BNV dated August 10, 2005 of the Ministry of Home Affairs guiding amendments and supplements to the promotion salary system and other salary subsidies for civil servants and officials.

3. The coefficient for the subsidy for leadership positions shall be based on the classification of science and technology organizations, while ensuring the general correlation among science and technology organizations.

4. The classification of science and technology organizations shall be determined according to the authority that decides the establishment of such organization.

II. SPECIFIC PROVISIONS

1. For science and technology organizations directly under the Government, the coefficient for the subsidy for leadership positions shall be implemented according to the table of subsidies for leadership positions issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government.

2. For science and technology organizations directly under Ministries, agencies equivalent to Ministries, the Vietnam Academy of Science and Technology, the Vietnam Social Sciences Academy, established by the Government's decision or specified in the Government's Decree stipulating the functions, tasks, and organizational structures of Ministries, agencies equivalent to Ministries, the Vietnam Academy of Science and Technology, and the Vietnam Social Sciences Academy, the coefficient for the subsidy for leadership positions shall be as follows:

For science and technology organizations directly under government agencies, established by the Government's decision or specified in the Government's Decree stipulating the functions, tasks, and organizational structures of government agencies; and science and technology organizations directly under General Departments, Class 1 Departments and equivalents under Ministries, agencies equivalent to Ministries, established by the Prime Minister's decision or specified in the Prime Minister's Decision stipulating the functions, tasks, and organizational structures of General Departments, Class 1 Departments and equivalents under Ministries, agencies equivalent to Ministries, the coefficient for the subsidy for leadership positions shall be as follows:

For science and technology organizations directly under Ministries, agencies equivalent to Ministries, government agencies, the People's Committee of Hanoi City, the People's Committee of Ho Chi Minh City, and established by those authorities, the coefficient for the subsidy for leadership positions shall be as follows:

For science and technology organizations directly under the organizations stipulated in Point 2, Section of this Circular, and science and technology organizations established by the remaining provinces and centrally governed cities, the coefficient for the subsidy for leadership positions shall be as follows:

For institutes directly under Ministries, agencies equivalent to Ministries, government agencies, established by the Government's decision or specified in the Government's Decree stipulating the functions, tasks, and organizational structures of Ministries, agencies equivalent to Ministries, government agencies, having affiliated institutes, the coefficient for the leadership position of the affiliated institute shall be applied as stipulated in Point 4, Section of this Circular.

III. IMPLEMENTATION PROVISIONS

1. This Circular shall take effect fifteen days after its publication in the Official Gazette.

The subsidy system for leadership positions of science and technology organizations stipulated in this Circular shall take effect from October 1, 2004.

2. This Circular replaces Circular No. 1819/TCCB dated November 1, 1993 of the Ministry of Science, Technology, and Environment (now the Ministry of Science and Technology) guiding the implementation of the subsidy system for leadership positions in science and technology organizations and other guiding documents implementing the subsidy system for leadership positions in science and technology organizations contrary to the provisions of this Circular.

3. Non-state science and technology organizations may apply these provisions if they find them appropriate.

4. The Minister, the head of an agency equivalent to a Ministry, the head of a government agency, and the Chairman of the People's Committee of a province or centrally governed city shall be responsible for directing and guiding science and technology organizations under their management to review their organizational structure and leadership positions in accordance with state regulations to uniformly implement the subsidy system for leadership positions as stipulated in Section II of this Circular.

Any issues arising during implementation should be reported to the Ministry of Science and Technology for study and resolution./.
