Pursuant to Decree No. 29/2004/NĐ-CP dated January 16, 2004 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Trade;
Pursuant to the Regulation on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government;
Pursuant to Decision No. 385/1999/QĐ-TTg dated March 9, 2006 of the Prime Minister on the establishment of the Management Board of the Chân Mây - Lăng Cô Economic Zone, Thừa Thiên Huế Province;
Based on the proposal of the People's Committee of Thừa Thiên Huế Province at Document No. 868/UBND-TH dated March 23, 2006,
Delegates authority to the Management Board of the Chân Mây - Lăng Cô Economic Zone, Thừa Thiên Huế Province (hereinafter referred to as the Management Board) to manage import and export activities and trade activities for foreign-invested enterprises and joint ventures based on business cooperation contracts for investment within the Chân Mây - Lăng Cô Economic Zone, Thừa Thiên Huế Province (hereinafter referred to as foreign-invested enterprises).

Article 1. The Management Board shall examine and approve the import plans and manage the trade activities of foreign-invested enterprises as follows:
Article 2. 1. Approve the import plans of foreign-invested enterprises, ensuring compliance with the Law on Foreign Investment in Vietnam dated November 12, 1996, the Law Amending and Supplementing Certain Provisions of the Law on Foreign Investment in Vietnam dated June 19, 2000, Decree No. 24/2000/NĐ-CP dated July 31, 2000, Decree No. 27/2003/NĐ-CP dated March 19, 2003; Decree No. 149/2005/NĐ-CP dated December 8, 2005 detailing the implementation of the Law on Export Tax and Import Tax; Decree No. 12/2006/NĐ-CP dated January 23, 2006 detailing the implementation of the Law on Commerce regarding international goods trading activities and related activities such as agency buying, selling, processing, and transiting foreign goods, and other relevant legal documents consistent with the Investment License, Business License, Economic and Technical Justification, and Technical Design.
The examination and approval of import plans include the following contents:
1.1- Approving the import plan and confirming exemption from import tax for machinery, equipment, transportation means, construction materials, spare parts for installation to create fixed assets, including financial leasing imports.
1.2- Approving the temporary import plan for machinery, equipment, transportation means leased from abroad that are not part of the production line to serve the operation of the enterprise.
1.3- Approving the import plan for raw materials and supplies for the production and business activities of the enterprise.
2. Approving the liquidation of machinery, equipment, transportation means, materials, and raw materials of foreign-invested enterprises according to Circular No. 01/2005/TT-BTM dated January 6, 2005 of the Ministry of Trade.
3. Approving the import plan for finished products to be combined with the export products of foreign-invested enterprises.
Quarterly, the Management Board shall report to the Ministry of Trade on the implementation of export and import activities of foreign-invested enterprises in accordance with the guidance provided by the Ministry of Trade in Circular No. 22/2000/TT-BTM dated December 15, 2000 of the Ministry of Trade.
Article 3. The Ministry of Trade shall periodically organize inspections of the implementation of the provisions in this delegation decision in accordance with the law.

Article 5. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
