THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Article 19 of Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Considering the proposal of the Director of the Department of Personnel Organization,
DECISION:
Article 1. Position and Functions
The Livestock Production Department is a subordinate agency under the Ministry of Agriculture and Rural Development, performing the function of advising the Minister in managing state affairs in the specialized sector and executing state management tasks in the livestock production field within the scope of the Ministry's state management.
The Livestock Production Department has legal personality, its own bank account and seal, and operates with funds as prescribed by law.
The headquarters of the Department is located in Hanoi City and its permanent branch in Central Vietnam and Ho Chi Minh City.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit draft laws, ordinances, and draft regulatory legal documents in the specialized field to the Ministry according to the annual legislative program and plan of the Ministry, and other projects and programs assigned by the Minister. Submit draft decisions, directives, and other documents within the Minister’s authority for guidance and management to the Minister.
2. Submit strategies, plans, and long-term, five-year, and annual development plans; regional strategic plans, inter-regional, and inter-provincial plans; and important programs, projects, and works in the specialized field managed by the Department as assigned by the Minister.
3. Issue individual documents and provide professional guidance on the specialized field and area entrusted with management. Announce detailed implementation plans for programs, projects, and initiatives managed by the Ministry for each locality and unit after the overall plan for the field under the Department's management has been approved by the Ministry.
4. Submit to the Ministry for publication strategies, plans, and development programs and organize guidance, inspection, and supervision of the implementation of regulatory legal documents, strategies, plans, programs, projects, standards, technical regulations, procedures, norms, and economic-technical standards in the specialized field that have been approved; direct and organize the dissemination, popularization, and education of laws in the specialized field under the Department's management.
5. Regarding agricultural animal breeding:
a) Lead in developing strategies, plans, and programs for the development of agricultural animal breeds in line with the overall national socio-economic development plan and each agricultural ecological region;
b) Submit to the Ministry for regulations on the use and exchange of genetic resources of agricultural animals; national technical standards for agricultural animal breeds;
c) Issue lists of permitted agricultural animal breeds for production and trade; lists of rare genetic resources of agricultural animals requiring conservation; lists of prohibited export and permitted foreign exchange agricultural animal breeds; lists of environments for mixing and preserving semen of agricultural animals permitted for production and trade in Vietnam, and other lists within the scope of agricultural animal breeding management; norms and procedures for testing new agricultural animal breeds pursuant to the Minister's authorization;
d) Manage and organize the testing, inspection, and certification of agricultural animal breeds, semen, embryos, eggs, and environments for mixing and preserving semen of agricultural animals; test and propose recognition of new agricultural animal breeds;
đ) Recognize and designate testing, inspection, and certification facilities for agricultural animal breeds;
e) Issue and revoke permits for exporting and importing agricultural animal breeds, semen, embryos, eggs, and environments for mixing and preserving semen of agricultural animals; certificates regarding agricultural animal breeds, semen, embryos, eggs, and environments for mixing and preserving semen of agricultural animals;
g) Direct the implementation of investment development programs for agricultural animal breeds and support programs for the production and supply of original agricultural animal breeds.
6. Regarding livestock feed:
a) Lead in developing and submitting to the Ministry for national technical standards on livestock feed and raw materials;
b) Issue lists of livestock feed and raw materials permitted for import into Vietnam pursuant to the Minister's authorization;
c) Manage and organize the testing of livestock feed and analysis of raw materials for livestock feed;
d) Recognize and designate laboratories and units for testing and analyzing livestock feed and raw materials; issue certificates to individuals collecting samples of livestock feed and raw materials;
đ) Issue and revoke permits for exporting and importing livestock feed and raw materials; certificates confirming the quality of livestock feed and raw materials; certificates for good manufacturing practices (GMP) for livestock feed production facilities.
7. Regarding livestock production guidance:
a) Guide localities in developing livestock production planning linked to slaughterhouse and processing systems for livestock and poultry. Guide the development, inspection, and implementation of plans for large-scale livestock farming regions, industrial livestock production, and safe livestock production;
b) Guide the implementation of production structures, livestock production techniques, feeding, and care of agricultural animals; standards and norms for livestock housing and facilities; propose measures to mitigate natural disasters and diseases in livestock production;
c) Lead in reviewing and managing the implementation of basic investigation projects on livestock production;
d) Develop, guide the implementation, and evaluate annual livestock production plans. Statistics and report on production progress. Participate in management of livestock product processing and preservation.
8. Environmental protection in livestock production:
a) Lead in developing and submitting to the Ministry for issuance of national technical standards applicable to livestock waste treatment;
b) Guide, supervise, and inspect the implementation of environmental control work in livestock production;
c) Supervise and inspect the implementation of national standards and technical regulations on the environment in livestock production. Coordinate with other environmental management agencies to assess environmental quality and propose solutions to protect the environment in livestock production.
9. Management of product quality and food safety in the livestock production sector from the production input stage:
a) Develop and organize the implementation of programs and plans for ensuring quality and food safety in livestock production activities and submit them to the Ministry.
b) Draft, submit to the Ministry consolidated documents of legal regulations, mechanisms, and policies; propose the construction of national technical standards and norms on production quality assurance and food hygiene and safety in the livestock sector;
c) Propose plans for building and developing safe livestock zones;
d) Supervise and inspect the implementation of management regulations for safe livestock production zones and facilities; technical standards and norms for livestock production ensuring food hygiene and safety;
10. Propose to the Ministry a list of investment programs and projects in the livestock sector. Lead the review and perform the role of the main investor for programs and projects assigned by the Ministry;
11. Organize and direct statistical investigations and manage databases on livestock production according to regulations;
12. Science and technology:
a) Participate in managing the gene fund for agricultural livestock and microorganisms used in agricultural livestock farming;
b) Propose and submit to the Ministry scientific research programs, plans, and topics; applications of technological advancements and specialized techniques;
c) Lead the review of research outlines and topics; commission organizations and individuals to implement them; accept and manage research results and direct the application of technological advancements and specialized techniques within the scope of the Bureau's management;
d) Manage scientific and technological information related to the specialized field;
đ) Lead the drafting and submission to the Ministry of national technical standards concerning livestock housing for raising livestock and poultry; about specialized materials for livestock farming. Participate in drafting draft national standards and technical standards within the scope of the Ministry's state management as assigned by the Minister;
e) Lead the review of breeding stock varieties testing results; semen preparation and storage environments for agricultural livestock breeding stock; livestock feed to be included in the list of permitted breeding stock varieties for production and business in Vietnam; lists of permitted semen preparation and storage environments for agricultural livestock breeding stock for production and business in Vietnam; lists of imported livestock feed and raw materials for livestock feed and advancements in livestock farming techniques;
13. Direct the implementation of agricultural extension activities in the livestock sector;
14. Participate in trade promotion activities in the specialized livestock sector as assigned by the Minister;
15. Regarding international cooperation:
a) Draft and submit to the Ministry international cooperation programs and projects within the scope of the Bureau's management;
b) Organize the implementation of international cooperation, funded international programs and projects according to the classification of the Minister;
16. Regarding administrative reform:
a) Draft and organize the implementation of administrative reform plans according to the Ministry's plan and the Minister's directives;
b) Direct the review, systematization, and proposal for the establishment of institutional and legal systems within the Bureau's management scope;
c) Direct the completion of functions, tasks, and authorities of subordinate organizations under the Bureau in accordance with division and delegation; submit to the Ministry for delegation of management tasks to local governments;
d) Direct the implementation of regulations on self-management, self-responsibility for task execution, organizational structure, staffing, finance, and administrative procedure reform, work method innovation, office modernization, and information technology application to serve the Bureau's operations;
17. Regarding state management of organizations providing public services within the Bureau's management scope:
a) Submit to the Ministry mechanisms, policies, and technical standards for public service provision; regarding the socialization of public service activities in the industry and sector;
b) Issue economic and technical quotas, timeframes for providing public services within the industry and sector;
c) Guide, inspect, and support organizations providing public services within the industry and sector according to legal provisions;
18. Regarding state management of the activities of associations and non-governmental organizations within the Bureau's management scope as assigned by the Minister:
a) Guide and facilitate associations and non-governmental organizations to participate in activities within the Bureau's management scope; organize the collection of opinions and feedback from associations and non-governmental organizations to improve regulatory management;
b) Recommend measures to address violations of laws by associations and non-governmental organizations operating within the industry and sector;
19. Regarding organizational structure, staffing, and cadres, civil servants, and public officials:
a) Draft proposals for the functions, tasks, authorities, and organizational structure of the Bureau; propose the establishment and restructuring of subordinate organizations under the Bureau;
b) Decide on the establishment of working groups of the Bureau; specify details on autonomous tasks, organizational charters, and activities for state-owned enterprises under the Bureau according to regulations;
c) Submit to the Ministry annual staffing plans of the Bureau; decide on the allocation of administrative staffing for agencies under the Bureau;
d) Decide on sending cadres, civil servants, and public officials abroad for study and work according to the Ministry's cadre management classification;
đ) Specify the authority and responsibility of heads of organizations under the Bureau;
e) Decide and implement specific measures to strengthen administrative discipline; organize the implementation of anti-corruption, thrift, and anti-bureaucracy, arrogance, favoritism, and arbitrary power in units under the Bureau;
g) Implement recruitment, employment, transfer, retirement, salary systems, rewards, and other systems for cadres, civil servants, and public officials under the Bureau's management according to legal provisions and the Ministry's classification; provide professional training according to the Minister's assignment;
h) Draft professional standards for civil servant and public official positions within the industry and sector according to the Minister's assignment;
i) Report on the implementation of organizational and personnel work and staffing according to regulations;
20. Regarding inspection and supervision:
a) Guide and inspect the implementation of policies and laws within the Bureau's management scope according to regulations;
b) Resolve or participate in resolving complaints, reports, and suggestions from organizations and citizens related to the Bureau's management scope; organize citizen reception according to legal provisions;
c) Inspect and supervise the implementation of sectoral and field management delegation within the scope of the Bureau's management. Conduct inspections and supervision according to the annual plan assigned by the Ministry and carry out surprise inspections as required by the Ministry.
21. On financial and asset management:
a) Submit the annual budget estimate and the medium-term budget plan of the Bureau to the Ministry;
b) Be responsible for finalizing accounts of funds directly managed by the Bureau; manage and be accountable for state assets allocated to the Bureau according to the delegation of the Minister and the provisions of the law.
22. Perform other tasks as prescribed by specialized laws and the delegation and delegation of the Minister.
Article 3. Organizational Structure
1. Bureau leadership:
The Bureau leadership consists of the Director and Deputy Directors appointed and relieved from duty by the Minister of Agriculture and Rural Development in accordance with regulations.
The Director manages the Bureau's operations, is accountable to the Minister of Agriculture and Rural Development and the law for the Bureau's activities.
The Deputy Director assists the Director in overseeing and directing certain aspects of work as delegated by the Director and is accountable to the Director for the assigned tasks.
2. Management structure:
a) Large Livestock Department;
b) Small Livestock Department;
c) Feed Department;
d) Livestock Environment Department;
đ) Planning and Finance Department;
e) Inspection and Legal Affairs Department;
g) Bureau Office;
h) Permanent unit in Central Region;
i) Permanent unit in Ho Chi Minh City.
3. Subordinate units:
a) Center for Livestock Breeding, Testing, and Certification of Feeds;
b) Other public service units established based on the Project developed by the Bureau and approved by the Ministry.
The Director of the Livestock Service shall define the functions and responsibilities of the Bureau's management structure and subordinate units, appoint staff according to the delegation of the Ministry, and issue the Bureau's Operational Regulations.
Article 4. Effective date
This Decision takes effect fifteen days after its publication in the Official Gazette. Decree No. 71/2005/QĐ-BNN dated November 10, 2005, issued by the Minister of Agriculture and Rural Development, which stipulates the functions, tasks, authorities, and organizational structure of the Livestock Service, and any previous regulations of the Ministry that conflict with this Decision are hereby repealed.
Article 5. Responsibilities for Implementation
The Director of the Livestock Service, the Head of the Ministry's Office, the Heads of Departments, other Bureau Directors, the Inspector General of the Ministry, and the Heads of related agencies and units are responsible for implementing this Decision./.
