Regulations on the functions, tasks, powers, and organizational structure of the Livestock Raising Department

 

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

 

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Article 19 of Decree No. 86/2002/NĐ-CP dated November 5, 2002, of the Government, stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decision No. 254/2005/QĐ-TTg dated October 13, 2005, of the Prime Minister, adjusting some subordinate organizations under the Ministry of Agriculture and Rural Development;

These regulations are hereby promulgated along with this Decision "Regulations on the Transfer, Rotation, and Temporary Assignment of Officials and Civil Servants of the Government Inspectorate."

 

DECISION:

 

Article 1. Position and Function

1. The Livestock Raising Department is established based on restructuring the Agricultural Department pursuant to Clause 1 of Article 1 of Decision No. 254/2005/QĐ-TTg dated October 13, 2005, of the Prime Minister, adjusting some subordinate organizations under the Ministry of Agriculture and Rural Development.

2. The Livestock Raising Department is a subordinate agency under the Ministry of Agriculture and Rural Development, performing specialized state management functions for livestock raising throughout the country.

3. The Department has legal personality, receives operational funding, uses its seal, and opens a separate account at the State Treasury in accordance with the provisions of the law.

The headquarters of the Livestock Raising Department is located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Livestock Raising Department is assigned by the Minister to perform state management tasks in the specialized field of livestock raising within the scope of the Ministry's state management.

1. Drafting projects for laws, ordinances, and draft regulatory legal documents within the specialized management scope of the Department to be submitted to the Minister.

2. Submitting strategies, plans, policies, annual and long-term programs, projects, proposals, standards, procedures, regulations, economic and technical norms related to livestock raising within the Department’s management scope, as assigned by the Minister.

3. Issuing documents on management practices and providing guidance on professional and technical matters within the specialized field according to the Minister's classification.

4. Directing, guiding, inspecting, and being responsible for implementing approved regulatory legal documents, plans, programs, projects, proposals, standards, procedures, regulations, economic and technical norms, and disseminating, popularizing, and educating about policies and laws in the specialized management field of the Department.

5. Regarding agricultural animal breeds:

a) Managing state affairs concerning agricultural animal breeds in accordance with the law;

b) Developing strategies, plans, and annual development programs for agricultural animal breeds that align with national and local overall socio-economic development plans;

c) Conducting surveys and statistics on breed usage; developing procedures, regulations, techniques, and technologies for agricultural animal breeds;

d) Managing the quality and activities related to testing, inspection, and certification of agricultural animal breeds; conducting tests and recommending recognition of new agricultural animal breeds;

đ) Issuing and revoking permits and certificates regarding agricultural animal breeds within the authorized scope;

e) Submitting to the Minister for issuance of a list of agricultural animal breeds permitted for production and business in Vietnam;

g) Managing systems for breeding, testing, producing, and trading agricultural animal breeds;

h) Building and managing databases on agricultural animal breeds;

i) Managing the export and import of agricultural animal breeds.

6. Technical management of livestock raising:

a) Uniformly managing livestock raising techniques, animal care and feeding, herd movement, and herd structure;

b) Uniformly managing standards and norms for planning, housing; participating in reviewing land use plans and changes in land use purposes for agricultural livestock raising;

7. Management of livestock feed:

a) Uniformly managing the quality and use of livestock feed;

b) Managing registration, testing of livestock feed and raw materials for livestock feed production;

c) Issuing and revoking permits and certificates regarding livestock feed within the authorized scope;

d) Submitting to the Minister for issuance of a list of livestock feed and raw materials for livestock feed production permitted for production and business in Vietnam;

đ) Building and managing databases on livestock feed;

8. Directing livestock production:

a) Building and directing implementation of annual livestock production plans;

b) Reviewing investment projects for livestock farming regions linked to processing according to planning; participating in management of livestock product processing and preservation; proposing measures to mitigate natural disasters and diseases in livestock production nationwide;

c) Managing state affairs concerning livestock extension services;

d) Statistics, reporting progress in production, and building databases on livestock raising;

đ) Summarizing and evaluating annual production situations;

e) Reviewing and managing the implementation of basic investigation projects on livestock raising;

9. Regarding science and technology:

a) Uniformly managing state affairs concerning livestock genetic resources and microorganisms used in livestock raising in accordance with the law;

b) Preparing programs, plans, proposals, projects, and research topics on scientific studies and technological advancements; managing and organizing the implementation of scientific research results and technological advancements within the Department's specialized management scope;

c) Submitting to the Minister for issuance of quality standards for agricultural animal breeds, livestock products, livestock feed, technical supplies, and housing standards serving livestock raising within the Minister's authority;

d) Managing information on livestock raising science and technology;

đ) Establishing and managing a specialized scientific review council to assess breeding and livestock feed testing results to be submitted to the Minister for issuance to include in the list of permitted agricultural animal breeds and livestock feed for production and business in Vietnam.

10. Participating in training and professional skill enhancement in the specialized field of livestock raising as assigned by the Ministry.

11. Regarding livestock trade promotion:

a) Participating in building forecasts and directions for the development of export markets for livestock products, import substitution, and domestic consumption;

b) Participating in building policies for the development of livestock product consumption markets and international integration;

c) Directing the organization of livestock exhibitions and fairs.

12. Building cooperation programs and negotiation projects to sign and join international treaties and international organizations on livestock raising; organizing the implementation of international treaties and international cooperation projects according to the Minister's management classification.

13. Manage and direct certain State-owned enterprises and public services under the Ministry related to animal husbandry according to the division of labor assigned by the Minister.

14. Participate in managing the activities of associations, unions, and non-governmental organizations in the field of animal husbandry according to the division of labor assigned by the Minister.

15. Conduct inspections and investigations; resolve complaints and denunciations; combat corruption and handle violations in the field of animal husbandry within the scope of authority.

16. Develop and implement the administrative reform program of the Bureau in accordance with the objectives and content of the Ministry's administrative reform program.

17. Manage the organizational structure and staffing of the Bureau in accordance with regulations; implement salary systems and incentive policies, rewards, and disciplinary measures for civil servants and officials under the Bureau's jurisdiction.

18. Manage finances, assets, and other resources allocated; organize the implementation of the budget as prescribed.

20. Perform other tasks assigned by the Minister.

Article 3. Organization of the Bureau

1. Leadership of the Bureau:

The Bureau leadership consists of the Director and Deputy Directors appointed by the Minister of Agriculture and Rural Development in accordance with regulations.

The Director oversees the operations of the Bureau and is responsible before the law and the Minister for all activities of the Bureau assigned.

Deputy Directors assist the Director and are responsible before the Director and the law for the performance of their assigned tasks.

2. Management Structure of the Bureau:

a) Administrative and General Affairs Department,

b) Planning and Finance Department;

c) Legal and Inspection Department;

d) Large Livestock Department;

đ) Small Livestock Department;

e) Animal Feed Department;

g) Permanent Office in Ho Chi Minh City.

h) Permanent Office in Binh Dinh:

3. Subordinate units:

a) Livestock Testing and Certification Center.

b) Subordinate units managed according to the decision of the Minister.

The Director of the Livestock Service defines the functions and responsibilities, appoints staff for the departments, sections, and subordinate units; establishes the Bureau's operational regulations to be approved by the Minister.

Civil servants of the Bureau are part of the administrative establishment and receive salaries from the state budget.

Article 4. Effective date

This Decision takes effect fifteen days after its publication in the Official Gazette of the Government and abolishes previous provisions that conflict with this Decision.

Article 5. Responsibilities for Implementation

1. The Director of the Agricultural Bureau shall transfer duties and relevant matters to the Director of the Livestock Service.

2. The Head of the Office, Heads of the Cadre and Civil Servant Department, the Director of the Agricultural Bureau, Heads of relevant agencies and units under the Ministry, Chairpersons of People's Committees of provinces and centrally governed cities, and the Director of the Livestock Service are responsible for implementing this Decision./.
