BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;

Pursuant to Resolution No. 08/1997/QH10 on the Project to Plant Five Million Hectares of New Forests and Resolution No. 73/2006/QH11 on adjusting the targets and tasks of the Project to Plant Five Million Hectares of New Forests for the period 2006-2010;

Based on the Report No. 128/BC-CP dated August 9, 2011 of the Government, Report No. 243/BC-CP dated October 26, 2011 of the Government, the Audit Report No. 74/BC-UBKHCNMT13 dated October 24, 2011 of the Committee for Science, Technology and Environment of the National Assembly, and the opinions of the National Assembly deputies;

RESOLUTION:

Article 1: The National Assembly acknowledges that the Project to Plant Five Million Hectares of New Forests has basically completed its objectives under Resolution No. 08/1997/QH10 of the tenth session of the National Assembly and the adjusted targets and tasks under Resolution No. 73/2006/QH11 of the eleventh session of the National Assembly; the achievements, shortcomings, limitations, and the causes of these shortcomings and limitations in implementing the Project.

Article 2 Terminate the implementation of Resolution No. 08/1997/QH10 and Resolution No. 73/2006/QH11 of the National Assembly on the Project to Plant Five Million Hectares of New Forests.

Direct the Government to develop and implement a plan for protecting and developing forests for the period 2011-2020 under the mechanism of national target programs and report annually to the National Assembly on the implementation status.

Article 3 The Government shall organize the implementation of the following key tasks:

1. Promptly complete the settlement and auditing of the Project to Plant Five Million Hectares of New Forests in accordance with the provisions of the law;

2. Protect well the existing forest area, increase the coverage rate and improve the quality of the forest. Implement comprehensive solutions to address the problem of forest fires, illegal logging, and forest exploitation; in the short term, continue to implement policies to provide food aid to mountainous ethnic groups to prevent slash-and-burn practices. Integrate the implementation of the forest protection and development plan with economic and social development plans, other programs, and projects in the same area to enhance overall socio-economic efficiency, environmental protection, and ensure national defense and security;

3. Ensure funding for forest protection and development, particularly prioritizing border areas and coastal regions; increase the level of forest protection quotas and regeneration; increase investment in planting new protective and special-use forests and support for planting productive forests in difficult areas. Develop preferential policies for credit loans for productive forest planting; address employment issues and reorganize production when state land use purposes are changed; develop the forestry product market and wood processing industry;

4. Stabilize the land use planning for forestry; review and adopt reasonable measures for areas of forest already allocated or leased to ensure local people's needs for planting forests. Accelerate the progress of land allocation, forest allocation, and issuance of certificates of land use rights for forestry;

5. Reform the forest management model according to the functions of each type of forest; issue regulations on timber harvesting according to sustainable forest management schemes. Develop policies to ensure that local communities benefit directly from forest protection, regeneration, and planting; focus on exploiting the protective, environmental, scenic, and biodiversity values of forests to reinvest in forest planters;

6. Vigorously promote scientific research and technological application in seed selection, forest management, timber harvesting, and wood processing to increase the value of forestry products;

7. Strictly implement legal provisions on forest protection and development regarding the determination of forest prices, especially the prices of special-use forests and protective forests before converting them to productive forests or changing their use purposes to avoid wastage and loss of forest resources;

8. Strengthen propaganda, inspection, and supervision of the implementation of laws on forest protection and development; promptly and strictly handle violations of laws on forest protection and development.

Article 4: The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of the National Assembly, National Assembly deputies, and People's Councils at all levels shall supervise the implementation of this Resolution in accordance with their respective functions, duties, and authorities.
