Regulations on the organization and operation of grassroots sports clubs

Pursuant to the Law on Physical Education and Sports No. 77/2006/QH11 dated November 29, 2006;
“1. Position
Article 1. Other types of artistic performances
The Ministry of Culture, Sports and Tourism hereby stipulates the model for the organization and operation of grassroots sports clubs as follows:
Article 1. Scope and Objects Regulated
Article 1. This Circular stipulates the model for the organization and operation of grassroots sports clubs.
Article 2. This Circular applies to organizations and individuals participating in the organization and operation of grassroots sports clubs.
Article 3. Sports clubs established in accordance with Articles 49, 55, and 56 of the Law on Physical Education and Sports and laws on associations are not subject to the provisions of this Circular.
Article 2. Position, functions, and tasks of grassroots sports clubs
1. Position
a) Grassroots sports clubs are voluntary organizations established at agencies, organizations, military units, schools, enterprises, production and business establishments, and service providers (hereinafter referred to as agencies).
b) Grassroots sports clubs are subject to state management in physical education and sports by People's Committees of communes, wards, and towns (hereinafter referred to as commune level).
c) Grassroots sports clubs may apply for seals for transactions and open bank accounts in accordance with the law.
2. Functions
Promote and mobilize people with similar interests to voluntarily organize and disseminate physical education and sports activities to satisfy the need for physical training, entertainment, health improvement, cultural and spiritual enhancement, and athletic achievement.
Article 3. Tasks of grassroots sports clubs:
a) Mobilize people with similar interests to voluntarily participate in physical education and sports activities.
b) Regularly organize physical education and sports training to improve health, physical strength, stature; enhance cooperation, exchange, and understanding of physical education and sports among participants.
c) Organize and participate in mass sports competitions and cultural and sports activities at local levels and units.
d) Promote and educate members to comply with the law, Party policies, and State guidelines.
đ) Manage and develop membership.
e) Accept, manage, and utilize financial support from domestic and foreign organizations and individuals in accordance with the law.
g) Develop operational regulations, submit them for approval by the competent authority, and implement them.
Article 4. Recognition and dissolution of grassroots sports clubs
2. Recognition of a community sports club
a) Decision on establishment.
b) List of Board Members.
c) List of members.
d) Training location.
đ) Operational regulations.
3. In case the community sports club operates contrary to the provisions of the law, the authority issuing the recognition decision shall decide to dissolve the community sports club. If the sports club dissolves itself, it must report to the Chairman of the People's Committee at the commune level who issued the recognition decision.
Within seven working days from the date of receipt of complete application files as stipulated in Clause 1 of this Article, the Chairman of the People's Committee at the commune level shall issue a decision recognizing the club. In case of non-recognition, a written explanation of the reasons must be provided.
Article 4. In cases where grassroots sports clubs operate contrary to the law, the authority issuing the recognition decision shall decide to dissolve the club. If the sports club dissolves itself, it must report to the Chairman of the People's Committee at the commune level who issued the recognition decision.
Article 5. Organization of grassroots sports clubs
1. The Board consists of the Chairperson and Deputy Chairpersons elected or appointed by members.
2. Members of the club.
3. The name of the grassroots sports club must be appropriate to its activities and national traditions.
Article 5. Activities of grassroots sports clubs
1. Grassroots sports clubs operate on a self-managed basis and are responsible for their actions under the law.
2. The financial resources of grassroots sports clubs include:
a) Revenue from contributions of members, sponsorships, and support from organizations and individuals;
b) Expenditures for club activities that are agreed upon and publicly disclosed by members.
3. The activities of grassroots sports clubs are based on programs and plans that have been established.
Article 6. Implementation Organization
1. The General Department of Physical Education and Sports shall be responsible for guiding and inspecting the implementation of this Circular.
2. The Director of the Department of Culture, Sports and Tourism of the provincial-level city directly under the Central Government is responsible for organizing the implementation of this Circular.
3. State management agencies for culture, sports and tourism at district, county, town, and city levels under provinces shall direct the People's Committees at the commune level to implement this Circular.
Article 7. Implementation Provisions
This Circular takes effect from January 25, 2012, and replaces Decision No. 1589/2003/QĐ-UBTDTT dated September 19, 2003, issued by the Minister and Chairman of the Sports Management Committee on the regulations governing the organization and operation of grassroots sports clubs.
During the implementation process, if any difficulties arise, it is requested that relevant agencies, organizations, and individuals promptly report them to the Ministry of Culture, Sports and Tourism (through the General Department of Sports) for timely review, amendment, and supplementation./.
