CIRCULAR
List of telecommunications enterprises, groups of telecommunications enterprises
holding a dominant position in the market for important telecommunications services
Pursuant to the Law on Telecommunications dated November 23, 2009;
Pursuant to the Electricity Law dated December 3, 2004, the Law Amending and Supplementing Certain Provisions of the Electricity Law;
BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;
Pursuant to Decree No. 50/2011/NĐ-CP dated June 24, 2011 of the Government amending Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to Decree No. 25/2011/NĐ-CP dated April 6, 2011, issued by the Government, detailing and guiding the implementation of certain provisions of the Law on Telecommunications;
At the proposal of the Director of the Telecommunications Administration,
The Minister of Information and Communications issues this Circular on the List of telecommunications enterprises, groups of telecommunications enterprises holding a dominant position in the market for important telecommunications services.
Article 1. Scope of Regulation
This Circular promulgates the List of telecommunications enterprises, groups of telecommunications enterprises holding a dominant position in the market for important telecommunications services that require state management of competition (as attached).
Article 2. Applicability
1. State management agencies related to the management of tariffs for telecommunications services.
2. Telecommunications enterprises.
Article 3. Implementation Provisions
1. This Circular takes effect from January 1, 2013, and replaces Decision No. 1622/QĐ-BTTTT dated October 29, 2008 of the Ministry of Information and Communications on the issuance of the list of services and telecommunications enterprises or groups of telecommunications enterprises holding a controlling market share.
2. The Director of the Ministry's Office, the Director of the Telecommunications Department, the Heads of ministries' agencies and units, the Directors of Provincial Departments of Information and Communications under central cities, the General Directors, and Directors of telecommunications enterprises, and other relevant organizations and individuals shall be responsible for implementing this Circular.
Clause 3. During implementation, if there are any difficulties, they should be reported to the Ministry of Information and Communications for consideration and resolution./.
