DECREE

Regulations on material logistics standards for officers, non-commissioned officers, and soldiers serving in the People's Public Security Forces

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the National Security Law dated December 3, 2004;

Pursuant to the Law on the People's Public Security dated November 28, 2005;

The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.

The Government issues this Decree stipulating material logistics standards for officers, non-commissioned officers, and soldiers serving in the People's Public Security Forces,

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree sets out basic standards for material logistics for officers, non-commissioned officers, and soldiers serving in the People's Public Security Forces, including regular food standards and supplementary food allowances during training, combat, standby readiness, flood and storm prevention exercises, accident and injury prevention, search and rescue operations, treatment meal allowances at infirmaries and hospitals, recuperation meal allowances, uniform standards, essential goods standards, medical supplies and chemical usage standards, medical equipment standards, hygiene miscellaneous expense standards, recuperation and health recovery rest standards, material quotas to meet cultural and spiritual enjoyment needs, clean water usage quotas for daily life, office and living space area standards for collective barracks, official residences, guesthouses, recuperation facilities, and public living areas, equipment quota standards, electricity usage quotas, and telephone usage quotas.

Article 2. Applicability

Officers, non-commissioned officers, and soldiers serving in the People's Public Security Forces include: officers, non-commissioned officers, soldiers, and students currently working, studying, and training in the training institutions of the People's Public Security Forces and local public security units (hereinafter referred to as officers and soldiers).

Article 3. Principles for Ensuring Material Logistics Standards

1. Ensuring the satisfaction of regular living, study, training, education, combat readiness, and combat needs.

2. Ensuring suitability with the requirements of the tasks of the People's Public Security Forces, economic and social conditions, and the state budget capacity at each stage.

3. Being consistent with overall development and the specific characteristics of each region, locality, and individual category.

4. Material logistics standards for officers and soldiers serving in the People's Public Security Forces shall be ensured according to the principle: Taking quantitative standards as the main basis, in cases where standards are provided in cash, they will be converted equivalently depending on the type of item and the method of implementation (production or purchase for distribution). Cash distribution will be paid together with the salaries and allowances of officers and soldiers; in terms of value, calculated based on technical standards of each type of material and prices at each time point (average annual price) to determine the budget guarantee; equipment that must be purchased in foreign currency will be calculated based on the exchange rate of foreign currency at each time point; types of items that cannot be quantified will be adjusted according to the inflation index annually announced by the State based on the price at the time this Decree was issued.

For the standard of medical care for officers and soldiers, it is calculated equivalently with the medical insurance payment amount plus special factors in the field of public security activities. The Minister of Public Security shall decide on adjusting the "inflation index" for subordinate agencies and units under the Ministry of Public Security.

5. Encouraging the economical and rational use of material logistics standards for officers and soldiers serving in the People's Public Security Forces; units with favorable conditions should actively organize self-production to improve the living standards of officers and soldiers.

6. Strictly prohibiting any actions that take advantage of the provision of material logistics standards for officers and soldiers to seek personal gain or cause damage to state property, thereby reducing the combat capability of the People's Public Security Forces.

Chapter II
MATERIAL LOGISTICS STANDARDS FOR PUBLIC SECURITY OFFICERS AND SOLDIERS

POLICE OFFICER OF THE PEOPLE'S INTERNAL SECURITY FORCE

Article 4. Food Standards for People's Police Officers and Soldiers

1. Basic food standards for People's Police officers and soldiers.

The caloric intake per meal is 3,200 Kcal/person/day, with a reasonable proportion of various types of staple foods and foodstuffs, and a ratio of heat-producing substances (Protein from 14% to 16%, Lipid from 18% to 20%, Glucose from 64% to 68%).

2. Food standards for People's Police officers and soldiers performing particularly arduous and dangerous tasks, or arduous and dangerous tasks; those who are injured, sick and hospitalized at hospitals, infirmaries, convalescent homes; dietary allowance levels; when participating in training, combat, readiness duty, exercises, flood and storm prevention, accident and injury response, search and rescue operations, and other specific tasks:

a) The caloric intake, quantitative structure, and ratio of heat-producing substances shall be specified in accordance with the tasks of each category;

b) The food allowance for People's Police officers and soldiers performing particularly arduous and dangerous tasks, or arduous and dangerous tasks is calculated to be 1.3 to 3.5 times higher than that of People's Police officers and soldiers receiving living expenses. People's Police officers and soldiers who are injured, sick and hospitalized at hospitals, infirmaries, convalescent homes are provided food according to medical standards.

Article 5. Uniform Standards

1. Uniform standards for officers include personal uniforms managed and used regularly and shared uniforms, including ceremonial uniforms, regular uniforms, anniversary uniforms, cold-weather uniforms.

2. Uniform standards for non-commissioned officers, soldiers, and students of the People's Police include personal uniforms managed and used regularly and shared uniforms, including regular uniforms, anniversary uniforms, cold-weather uniforms.

3. Uniform standards for operational disguises are types of uniforms equipped for People's Police officers and soldiers to perform tasks based on the nature, characteristics, and requirements of each force.

4. Additional uniforms, combat uniforms, ceremonial uniforms, and other special uniforms are equipped for People's Police officers and soldiers to perform training, combat, and specialized work tasks.

Article 6. Standards for Dining Facilities, Kitchens, and Catering Equipment

1. Standards for dining facilities, kitchens, and catering equipment are equipped according to the types of kitchens for platoon, company, battalion, regiment, brigade, and equivalent units concentrated in camps; kitchens at schools, academies, prisons, detention centers, educational facilities, juvenile correctional schools, infirmaries, hospitals, guesthouses, convalescent homes, and rehabilitation centers; units stationed separately, working independently, during field trips, flood and storm prevention, rescue operations, riot prevention, and other tasks are equipped with individual kitchens.

2. Standards for dining facilities, kitchens, and catering equipment are equipped according to the types of kitchens for General Departments, Military Commands; Provincial Public Security Departments under the Central Government; Fire Prevention, Firefighting, Rescue, and Emergency Services Departments; independent-stationed Departments, Bureaus, and Offices; District, County, City, and Town Public Security Departments, and Ward Public Security Departments, depending on the unit's staffing scale.

Article 7. Essential Supplies Standards

Essential supplies standards include essential items for daily life and combat for the People's Police forces; for non-commissioned officers and soldiers, these are guaranteed through physical goods or can be provided in cash and paid together with salaries. For those receiving salaries, the essential supplies standards are included in their salaries. Ensuring a ratio of 10% compared to the minimum wage/person/month.

Article 8. Standards for medicines, bandages, and chemicals

The standards for medicines, bandages, and chemicals to be equipped include medicines and bandages for use at units; medicines and bandages for hospital beds; examination medicines, supplementary medicines for high-ranking officers and chronic diseases; supplementary medicines for forces engaged in particularly dangerous arduous work, for officers and soldiers serving combat operations when on duty at grassroots levels; medicines and chemicals for disease prevention and control, chemicals, and biological products for specialized operations.

The standards for medicines, bandages, and chemicals are allocated to each unit and to each category of officers and soldiers serving in the People's Public Security Forces.

Article 9. Standards for medical equipment and devices

1. The standards for initial medical equipment and devices and annual replacement equipment.

2. The standards for medical equipment and devices are allocated according to each type of healthcare facility within the People's Public Security Forces:

a) For Class I, II, and III Public Security Hospitals, they are equipped equivalently to Class I, II, and III General Hospitals of the Ministry of Health and the specific characteristics of Public Security healthcare.

b) For Public Security Provincial and Central City Hospitals, they are equipped equivalently to Class III General Hospitals of the Ministry of Health and the specific characteristics of Public Security healthcare.

c) For Public Security Provincial and Central City Health Stations; Health Stations under the Command, Departments, Bureaus; Health Stations of academies, schools; Health Stations of officers and soldiers in detention centers, educational facilities, training schools, the Minister of Public Security shall specify concretely in accordance with the regulations of the Ministry of Health.

3. Standards for repair, maintenance, and inspection of medical equipment are ensured according to each type of healthcare within the People's Public Security Forces.

4. Professional medical uniforms:

The standards for professional medical uniforms are equipped in accordance with the regulations of the Ministry of Health.

Article 10. Standards for miscellaneous hygiene supplies

The standards for miscellaneous hygiene supplies are allocated according to each type of healthcare facility within the People's Public Security Forces and classified according to different regions and areas.

Article 11. Standards for recuperation and health recovery leave

The insurance, recuperation, and health recovery leave system for officers and soldiers of the Public Security after treatment due to illness, work-related accidents, occupational diseases, or weak health after maternity leave (including miscarriage cases) is implemented in accordance with the detailed regulations and guidance for implementing certain provisions of the Compulsory Social Insurance Law for military personnel, public security officers, and civil servants enjoying benefits equivalent to military personnel and public security officers as stipulated in Decree No. 68/2007/ND-CP dated April 19, 2007 of the Government, and Decision No. 243/2005/QD-TTg dated October 5, 2005 of the Prime Minister promulgating the Action Program of the Government to implement Resolution No. 46-NQ/TW dated May 23, 2005 of the Politburo on health care and improvement of people's health in the new situation.

Article 12. Material quotas ensuring cultural and spiritual enjoyment needs

The material quotas ensuring cultural and spiritual enjoyment needs in the People's Public Security Forces include quotas for allocating paper and pens for political study; quotas for allocating books for libraries, reading rooms, bookshelves; quotas for allocating press; decoration quotas for conference halls, meeting rooms; quotas for equipping means for cultural, artistic, physical education, and sports activities.

Article 13. Standards for Clean Water Usage in Daily Life

1. The standard for clean water usage in daily life to ensure compliance with criteria is 130-150 liters of clean water per person per day, applicable in areas with access to clean water sources.

2. Units stationed in areas without shared clean water sources shall be equipped with machinery, equipment, and chemicals to exploit and treat water sources or provided with funds to purchase water, ensuring each person receives 130-150 liters of clean water per day.

3. The standard for clean water usage for hospitals within the Public Security system to meet criteria is 250 liters per hospital bed per day-night period.

Article 14. Standards for Office Building Area, Collective Housing, Official Housing, Guest Houses, Rest Houses, Public Living Spaces, and Other Ancillary Facilities in Camps

1. The standards for office building area include the standards for office space for commanding officers at various levels in the Public Security force and the standards for office space for specialized officers and non-commissioned officers.

2. The standards for collective housing area in camps are divided according to rank from lieutenant to senior lieutenant, non-commissioned officers; soldiers, students in the Public Security force, ensuring a minimum average living area of 4.5 m² and a maximum of 6 m² per person.² and a maximum of 6 m²² for one person.

3. The standard for official housing for incumbent officers who have been relocated due to policy and rotation without their own housing and require accommodation is one official housing unit as stipulated in Decision No. 09/2008/QĐ-TTg dated January 11, 2008, issued by the Prime Minister on Principles of Design and Usage Standards for Official Housing. Official housing for officers is implemented according to the Law on Housing and guiding documents. For official housing units developed by units under the Ministry of Public Security as the main investors, the Minister of Public Security will specify the eligible tenants; design, construction, management, and usage regulations for official housing, and the design and investment construction procedures for official housing within the Public Security force.

4. The standards for some public facilities and ancillary facilities in camps are categorized based on specific Public Security units.

5. The standards for guest houses, rest houses, and convalescent homes in the Public Security force.

6. The standards for collective dining hall areas in camps, schools, and hospitals are divided according to categories, including soldiers, non-commissioned officers; officers of the rank of captain, major (or those with a salary level from lieutenant to major); colonel (or those with a salary level of colonel) and above.

7. Sanitary facilities in collective housing and public office buildings are allocated according to the number of personnel, and for Public Security units with female members, separate facilities must be arranged for men and women.

Article 15. Standards for Equipment and Supplies

The standards for equipment and supplies in the Public Security force are divided according to the usage standards for equipment and supplies in collective housing camps, office spaces for different categories, duty rooms, meeting rooms, briefing rooms, reception rooms, tradition rooms, interrogation rooms, archive rooms, security rooms, dining rooms, and classrooms.

For each standard, it is specifically divided according to each level of officer or soldier or according to the level of unit within the Public Security force.

Article 16. Electricity Consumption Standards

1. The electricity consumption standards for the People's Public Security include standards for electricity usage for daily activities and work; electricity usage standards for command and combat readiness; electricity usage standards for warehouse operations; electricity usage standards for training; electricity usage standards for disease prevention and control, medical examination and treatment; and electricity usage standards for other tasks.

Units stationed in areas without national power grid connections shall be equipped with generator systems with sufficient capacity to meet operational, combat, lighting requirements, and be compatible with the number of personnel assigned to each unit. The minimum operating time for generators is six hours per day. For technical units, detention centers, and temporary detention facilities, the generator operating time must be twenty-four hours per day.

2. The Minister of Public Security shall specify in detail:

a) Electricity usage for the export, import, storage, maintenance, repair, and sealing of weapons, auxiliary tools, professional materials and equipment, transportation means, and transportation parts at stations, workshops, warehouses, and technical zones.

b) Electricity consumption standards for each specific unit as detailed in Section V of Appendix VIII "Electricity Consumption Standards" issued together with this Decree.

c) Provision of generator systems for units stationed in areas without national power grid connections.

Article 17. Telephone Usage Standards

The telephone usage standards for the People's Public Security ensure the provision of official telephones for offices and private residences, mobile phone usage standards, and other communication means.

Article 18. Detailed Appendices on Material后勤标准

1. The following detailed appendices on certain basic material后勤标准for officers and soldiers serving in the People's Public Security force are promulgated along with this Decree:

a) Appendix I: Uniform standards for non-commissioned officers, soldiers, and students of public security;

b) Appendix II: Uniform standards for public security officers;

c) Appendix III: Medical supplies, bandages, chemicals usage standards in public security healthcare;

d) Appendix IV: Equipment standards for public security hospitals and health facilities, and medical uniforms;

đ) Appendix V: Sanitation magazine standards;

e) Appendix VI: Work area, collective dormitory, official residence, guesthouse, rest and recuperation facility, communal living, and other ancillary construction standards within camps;

g) Appendix VII: Equipment standard quotas;

h) Appendix VIII: Electricity consumption standards;

i) Appendix IX: Telephone usage standards;

k) Appendix X: Essential goods standards.

2. The Minister of Public Security shall specify in detail the following material后勤标准:

a) Meal allowances and supplementary food quantities for officers and soldiers undertaking particularly arduous, dangerous, or heavy and dangerous tasks;

b) Regular uniform, disguise uniform, additional uniform, combat uniform, ceremonial uniform, and special uniform standards for the People's Public Security force;

c) Canteen and kitchen equipment and catering utensil standards in public security agencies and units;

d) Rest and recuperation standards, locations, and times for officers and soldiers in the People's Public Security force;

đ) Material后勤保障标准to meet cultural and spiritual enjoyment needs in public security agencies and units;

e) Size and model standards for various equipment provided in public security agencies, units, and training institutions;

g) Business telephone usage standards to ensure operations and combat; communication equipment provision standards throughout the People's Public Security force.

Chapter III
IMPLEMENTING PROVISIONS

Article 19. Effective Date

This Decree takes effect from April 10, 2013, replacing Government Decree No. 25/2006/NĐ-CP dated March 10, 2006, which stipulates material后勤标准for officers, non-commissioned officers, and soldiers serving in the People's Public Security force.

Article 20. Guidance on Implementation

1. The Ministry of Public Security shall take the lead and coordinate with the Ministry of Finance, the Ministry of Planning and Investment, and other relevant ministries and sectors to guide the application of logistical material standards according to specific levels and for different categories of police officers serving in various regions, in accordance with the special circumstances within the People's Public Security force. The Ministry of Public Security shall annually develop plans and budgets to ensure the provision of materials as stipulated in this Decree.

2. The Minister of Planning and Investment and the Minister of Finance shall compile budget estimates and allocate the budget based on the annual state budget balance capacity to ensure the implementation of logistical material standards in accordance with the State Budget Law.

Article 21. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of provincial People's Committees under the central city shall be responsible for implementing this Decree./.
