         Article 1. Amend and supplement Article 3 of Decision No. 62/2004/QĐ-TTg dated April 16, 2004 of the Prime Minister on credit for implementing the National Strategy on Clean Water Supply and Rural Environmental Sanitation as follows:"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation.""Article 3. Credit recipientsNo.          1. Households legally residing in rural areas that have not yet had access to clean water or have existing facilities that do not meet standards and sanitary requirements, and households that have fully repaid their previous loans and wish to borrow again to construct, improve, or upgrade existing water supply and environmental sanitation facilities that have been in use for many years and are now damaged, deteriorated, and do not meet national technical standards; those who submit loan applications for new construction or improvement of water supply and environmental sanitation facilities and commit to using the borrowed funds for their intended purpose, repaying the loan on time, and obtaining confirmation from the local commune authorities shall:"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."         a) Be eligible to borrow from the Vietnam Bank for Social Policies. l         b) The maximum loan amount for each type of facility is 6 million VND per household.

         c) Loan terms, conditions, procedures, and collateral requirements shall be carried out in accordance with the provisions of Decree No. 78/2002/NĐ-CP dated October 4, 2002 of the Government on credit for the poor and other policy beneficiaries.

         d) Risk management and loan interest rates shall be implemented according to the regulations of the Prime Minister for each period;

         đ) During the period of outstanding debt, households may not sell, transfer, or pledge the facilities to others without authorization.

         In cases where households sell or transfer houses or land that include these shared or individual facilities, they must provide a commitment to repay the debt (principal and interest), confirmed by the People's Committee of the commune and the Vietnam Bank for Social Policies, with the principle that the seller must be able to repay the debt.

         2. Economic organizations that are investors in new projects or improvements to water supply facilities in rural areas, which are supported by the Vietnam Development Bank with post-investment interest rate subsidies, shall follow the current state investment credit policies."

         Article 2. Implementation Provisions

         1. This Decision takes effect from May 1, 2014.

         2. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees, Chairmen of municipal People's Committees directly under the central government, General Directors of the Vietnam Development Bank, and General Directors of the Vietnam Bank for Social Policies are responsible for implementing this Decision./.

In the case where households sell or transfer houses and land that share or individually own these facilities, they must commit to repaying the debt (principal and interest), which commitment must be confirmed by the People's Committee of the commune and the Vietnam Social Policy Bank, with the principle that the seller must be able to repay the debt.

2. For economic organizations that are investors in new investment projects or upgrading and improving rural clean water supply facilities, which are provided loans by the Vietnam Development Bank and post-investment interest rate support according to current state credit investment policies.

Article 2. Implementation Provisions

1. This Decision takes effect from May 1, 2014.

2. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, General Directors of the Vietnam Development Bank, and General Directors of the Vietnam Social Policy Bank are responsible for implementing this Decision./.
