DECREE

Regulations on functions, tasks, powers, and organizational structure

of the Ho Chi Minh Mausoleum Management Board

 

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to Decree No. 10/2016/NĐ-CP dated February 1, 2016 of the Government on agencies under the Government;

"Based on the proposal of the Minister of National Defense;"

The Government promulgates this Decree stipulating functions, tasks, authorities, and organizational structure of the Management Board of Ho Chi Minh Mausoleum.

Article 1. Position and Functions

The Ho Chi Minh Mausoleum Management Board (hereinafter referred to as the Management Board) is an agency under the Government, performing the function of preserving the remains of President Ho Chi Minh for the long term and ensuring absolute safety; managing and ensuring security, rituals, organizing activities at the Ho Chi Minh Mausoleum, Ba Dinh Square, Heroes' Memorial, Reception Area, and Ho Chi Minh Relics Site at Ba Vi Rock (also known as K9 Relics Site) in Ba Vi District, Hanoi City, and related structures; organizing the implementation of public services according to the law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. On strategy, program, planning, and plan

a) Submitting to the Government and the Prime Minister the strategy, planning, programs, long-term plans, five-year plans, annual plans, important projects, and proposals of the Management Board and implementing them after approval;

b) Participating in the appraisal of important projects and proposals within its management scope upon request of the Government and the Prime Minister;

c) Deciding on investment projects within its authority according to the law.

2. On preserving the remains of President Ho Chi Minh for the long term and ensuring absolute safety; ensuring security and safety in the area

a) Implementing medical tasks to preserve and maintain the remains of President Ho Chi Minh permanently;

b) Ensuring the safety of the remains of President Ho Chi Minh;

c) Managing and operating to ensure infrastructure and technical systems; renovating the Ho Chi Minh Mausoleum, Ba Dinh Square, Heroes' Memorial, Reception Area, K9 Relics Site, and related structures;

d) Studying, proposing, building, and implementing plans, measures to ensure security and safety in the areas of the Ho Chi Minh Mausoleum, Ba Dinh Square, Heroes' Memorial, K9 Relics Site, and other areas under its management.

3. Organizing activities in the areas under its management

a) Organizing reception, propaganda, service for the people and international guests visiting, commemorating President Ho Chi Minh, commemorating heroes and martyrs, political and cultural activities, and tours in the Ho Chi Minh Mausoleum, Heroes' Memorial, Ba Dinh Square, and K9 Relics Site;

b) Leading and coordinating with the Ho Chi Minh Museum and the Ho Chi Minh Relics Site at the Presidential Palace to guide, receive, and organize service activities for the people and international guests visiting and participating in political and cultural activities at the Ba Dinh Historical and Cultural Relics Complex;

c) Implementing military and state ceremonies at the Ho Chi Minh Mausoleum, Heroes' Memorial, and K9 Relics Site according to regulations;

d) Organizing production, caring for flowers and ornamental plants, decorating, and ensuring environmental sanitation.

4. On implementing public services

a) Organizing the implementation of public services assigned by the Government;

b) Inspecting the organization and implementation of public services by subordinate agencies and units of the Management Board.

5. On international cooperation

a) Signing, amending, supplementing, extending, terminating, or temporarily suspending the implementation of international agreements on behalf of the Management Board according to the law;

b) Organizing international cooperation in fields under the Management Board's jurisdiction according to the Prime Minister's assignment;

c) Organizing the implementation and inspecting the implementation of international funded programs and projects according to regulations;

d) Participating in conferences, seminars, international cooperation programs, and plans.

6. Deciding and directing the implementation of the administrative reform program of the Management Board according to the goals and contents of the State administrative reform program approved by the Prime Minister.

7. On information and reporting systems

a) Organizing information work, propaganda, and dissemination of major political tasks, policies, systems, and laws of the State in the fields under the Management Board's jurisdiction;

b) Implementing the reporting system to the Prime Minister and competent authorities according to regulations.

8. On organizational structure and staffing

a) Submitting to the Prime Minister for the establishment, restructuring, dissolution, and renaming of subordinate agencies and units of the Management Board;

b) Managing organizational structure, civil servant staffing, number of employees, job positions, civil servant structure by rank and profession; organizing the implementation of personnel planning, training, recruitment, utilization, transfer, appointment, rotation, retirement, commendation, disciplinary actions, and other systems for civil servants, officials, and workers under its authority according to regulations;

c) Deciding and organizing the implementation of specific measures to strengthen administrative discipline among civil servants, officials, and workers under its authority; combating corruption, waste, bureaucracy, arrogance, and abuse of power in the activities of the Management Board;

d) Inspecting compliance with policies, laws, and assigned tasks by civil servants, officials, and workers under its authority; resolving complaints and reports related to civil servants, officials, and workers under its authority.

9. On financial management and assets

a) Preparing the annual budget estimate, three-year state financial-plan, and medium-term investment capital plan of the Management Board for submission to the competent state authority for decision;

b) Coordinating with relevant ministries and sectors to build financial mechanisms, standards, and budget expenditure norms for the Management Board in the assigned fields;

c) Implement investment management, finance, and accounting activities in accordance with regulations;

d) Managing and using state assets effectively.

10. Organizing research and application of science and technology in specialized fields serving assigned tasks.

11. Performing other tasks and powers assigned by the Government and the Prime Minister.

Article 3. Organizational Structure

1. The Office of the Ho Chi Minh Mausoleum Management Board.

2. Public service units

a) The Ho Ba Dinh Square Management Board;

b) The Science, Technology and Environment Center.

3. Specialized subordinate units

a) The Ho Chi Minh Mausoleum Protection Command, Ministry of National Defense;

b) The 375th Regiment, Security Command, Ministry of Public Security.

4. The Chairman of the Ho Chi Minh Mausoleum Management Board shall stipulate functions, tasks, powers, organizational structure, and working relationships; the authority and responsibility of the head; appointing, relieving from duty, and disciplining the head and deputy heads of agencies and units specified in Clause 1 and Clause 2 of this Article according to the law.

5. The Office of the Ho Chi Minh Mausoleum Management Board has its own seal, with an organizational structure consisting of 5 departments.

6. The number of deputy heads of agencies and units specified in Clause 1 and Clause 2 of this Article shall not exceed 3 persons.

Article 4. Heads and deputies of the Ho Chi Minh Mausoleum Management Board

1. The Chairman of the Ho Chi Minh Mausoleum Management Board is the head of the Management Board, also the Commander of the Ho Chi Minh Mausoleum Protection Corps appointed and relieved from duty by the Prime Minister; he is responsible before the Government, the Prime Minister, and the law for all aspects of the Management Board's activities.

2. The Deputy Director of the Ho Chi Minh Mausoleum Management Board is the deputy of the head of the Ho Chi Minh Mausoleum Management Board, including the Deputy Commander of the Ho Chi Minh Mausoleum Protection Command under the Ministry of National Defense and the Deputy Commander of the Security Guard Command under the Ministry of Public Security, appointed, relieved from duty, or dismissed by the Prime Minister upon the proposal of the Director of the Ho Chi Minh Mausoleum Management Board; responsible for assisting the Director of the Ho Chi Minh Mausoleum Management Board in directing and resolving certain areas of work according to the division of labor by the Director of the Ho Chi Minh Mausoleum Management Board and being accountable before the Director of the Ho Chi Minh Mausoleum Management Board and the law regarding assigned tasks; the number of Deputy Directors of the Ho Chi Minh Mausoleum Management Board shall not exceed two persons.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decree takes effect from the date of issuance and replaces Decree No. 37/2008/NĐ-CP dated April 1, 2008 of the Government on the functions, tasks, powers, and organizational structure of the Ho Chi Minh Mausoleum Management Board.

2. The Director of the Ho Chi Minh Mausoleum Management Board, Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, and Chairpersons of provincial/municipal People's Committees directly under the central government are responsible for implementing this Decree./
