Circular No. 18/2020/TT-NHNN Abolishes Certain Legal Normative Documents Issued by the Governor of the State Bank of Vietnam

CIRCULAR

Repealing certain regulatory legal documents issued by the Governor of the State Bank of Vietnam

 of Vietnam

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

On the basis of Law Issuing regulatory legal documents dated 22 June 2015;

Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;

Pursuant to the Law on Protecting State Secrets dated November 15, 2018;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some articles and implementing mechanisms for the Law on Issuing Regulatory Legal Documents;

Pursuant to Decree No. 16/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

Upon the proposal of the Head of the Legal Department;

The Governor of the State Bank of Vietnam issues this Circular to repeal certain regulatory legal documents issued by the Governor of the State Bank of Vietnam.

This Circular takes effect from January 25, 2026.

Repealing all regulatory legal documents issued by the Governor of the State Bank of Vietnam as follows:

1. Decision No. 61/2000/QĐ-NHNN dated February 23, 2000 of the Governor of the State Bank of Vietnam on the issuance of the Code of Conduct for officers, civil servants, and employees of the State Bank of Vietnam.

2. Decision No. 15/2000/QĐ-NHNN dated January 11, 2000 of the Governor of the State Bank of Vietnam on the issuance of the Inspectorate Regulation of the State Bank of Vietnam.

3. Decision No. 249/2000/QĐ-NHNN dated August 9, 2000 of the Governor of the State Bank of Vietnam on the implementation of democratic principles in the operations of units within the State Bank of Vietnam system.

4. Decision No. 1087/2003/QĐ-NHNN dated September 17, 2003 of the Governor of the State Bank of Vietnam on the issuance of the Regulation on Protecting State Secrets in the Banking Sector.

5. Decision No. 316/2004/QĐ-NHNN dated March 31, 2004 of the Governor of the State Bank of Vietnam on amending and supplementing certain provisions of the Regulation on Protecting State Secrets in the Banking Sector issued together with Decision No. 1087/2003/QĐ-NHNN dated September 17, 2003 of the Governor of the State Bank of Vietnam.

6. Decision No. 41/2006/QĐ-NHNN dated August 17, 2006 of the Governor of the State Bank of Vietnam on the operation of security forces within the State Bank of Vietnam system.

7. Decision No. 45/2007/QĐ-NHNN dated December 17, 2007 of the Governor of the State Bank of Vietnam on the classification level of each type of document and object carrying state secrets in the banking sector.

8. Circular No. 10/2009/TT-NHNN dated May 8, 2009 of the State Bank of Vietnam on amending and supplementing Decision No. 45/2007/QĐ-NHNN dated December 17, 2007 on the classification level of each type of document and object carrying state secrets in the banking sector.

Article 2. Effective Date

This Circular shall take effect from February 15, 2021

Article 3. Implementation Organization

The Head of the Legal Department, Heads of units under the State Bank of Vietnam, Governors of the State Bank of Vietnam branches in provinces and centrally governed cities; Credit organizations, foreign bank branches are responsible for implementing this Circular./.
