Amending and supplementing certain provisions of the Regulations on Admissions for Studying Abroad

issued together with Circular No. 06/2016/TT-BGDĐT

dated March 21, 2016, by the Minister of Education and Training

Pursuant to the Education Law dated June 14, 2019;

Decree No. 86/2022/NĐ-CP dated 24 the 10 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;22 of the Government This Circular stipulates standards and conditions for promotion to higher ranks of teaching positions for staff members in public universities and teacher training colleges, including public college teacher training institutions that offer Early Childhood Education at the college level (hereinafter referred to collectively as teacher training colleges).

Pursuant to Decree No. 86/2021/NĐ-CP dated September 25, 2021, of the Government stipulating the procedures for Vietnamese citizens to study, teach, conduct scientific research, and engage in academic exchanges abroad;

At the proposal of the Director of the International Cooperation Department;

The Minister of Education and Training issues this Circular amending and supplementing certain provisions of the Regulations on admissions for studying abroad issued together with Circular No. 06/2016/2022/TT-BGDĐT dated 21 the 3 Article 2. The receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations shall be carried out in accordance with Decree No. 20/2008/NĐ-CP dated February 14, 2008 of the Government on the receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations (amended and supplemented by Decree No. 48/2013/NĐ-CP dated May 14, 2013 on amending and supplementing certain articles of decrees related to administrative procedure control and Decree No. 92/2017/NĐ-CP dated August 7, 2017 on amending and supplementing certain articles of decrees related to administrative procedure control).6 of the Minister of Education and Training.

Article 1. Amending and supplementing certain provisions of the Regulations on Admissions for Studying Abroad issued together with Circular No. 06/2016/TT-BGDĐT dated March 21, 2016, by the Minister of Education and Training

1. Amending and supplementing Clause 1, Clause 2 of Article 1 as follows:

"1. These Regulations govern the admissions process for studying abroad under scholarship programs funded by the state budget managed by the Ministry of Education and Training, including: eligible candidates, admission criteria, principles and methods of admission, organization of admissions, and handling of admission results.

2. These Regulations apply to admissions for secondary general education, teacher training colleges, universities, master's, doctoral studies, internships, and foreign language training abroad."

2. Amending and supplementing Article 2 as follows:

"Article 2. Explanation of Terms

In these Regulations, the following terms shall be understood as follows:

1. Main Organizing Unit for Admissions is an agency or unit under the Ministry of Education and Training assigned the task of managing and supervising related work on admissions for studying abroad under scholarship programs approved by competent authorities.

2. Selection Committee is a committee established by the Minister of Education and Training based on the proposal of the Main Organizing Unit for Admissions to carry out the selection of candidates for studying abroad.

3. State Budget Scholarship is the scholarship defined in Clause 1, Article 3 of Decree No. 86/2021/NĐ-CP dated September 25, 2021, of the Government stipulating the procedures for Vietnamese citizens to study, teach, conduct scientific research, and engage in academic exchanges abroad (hereinafter referred to as Decree No. 86/2021/NĐ-CP), which is assigned to the Ministry of Education and Training to manage and use."

3. Amend and supplement Article 3 as follows:

"Article 3. Eligible Candidates and Admission Criteria

The eligible candidates for studying abroad are Vietnamese citizens who meet the criteria specified in Clause 1, Article 5 of Decree No. 86/2021/NĐ-CP."

4. Amending and supplementing Article 9 as follows:

"Article 9. Application Documents

Application documents for studying abroad shall be implemented according to the provisions of Clause 2, Article 5 of Decree No. 86/2021/NĐ-CP."

5. Amending and supplementing some points of Article 10 as follows:

a) Amend and supplement Point c Clause 1 as follows:

"c) Members of the Selection Committee: representatives from relevant units under the Ministry of Education and Training. Based on the specific requirements of each scholarship program, members of the committee may include representatives from other agencies and units.";

b) Amending and supplementing Point a, Point d and adding Point e of Clause 3 as follows:

"a) Unify the working principles and selection criteria suitable for each scholarship program;

d) Bear responsibility before the law and the Minister of Education and Training for the selection results of candidates;

e) Implement the regulations on protecting state secrets concerning candidate application information that needs protection.";

c) Adding Point h, Point i to Clause 4 as follows:

"h) Bear responsibility before the law and the Minister of Education and Training for the cross-checking information of candidates against their application documents provided by the candidates and related parties;

i) Implement the provisions at Point e, Clause 3 of Article 10 of these Regulations."

6. Amending and supplementing Clause 7 and adding Clause 11 of Article 11 as follows:

"7. Bear responsibility before the law and the Minister of Education and Training for organizing and implementing the admissions process for studying abroad and submitting the selection results for approval by the Minister of Education and Training;

11. Implement the provisions at Point e, Clause 3 of Article 10 of these Regulations."

7. Amending and supplementing Article 12 as follows:

"Article 12. Procedures for Applying and Selecting Candidates

1. Procedures for applying and selecting candidates shall be carried out in accordance with Clause 3, Article 5 of Decree No. 86/2021/NĐ-CP.

2. The Selection Committee organizes meetings to review and unify the list of qualified candidates for admission or those meeting preliminary selection requirements (for scholarship programs with preliminary selection). The Main Organizing Unit for Admissions completes the list of qualified candidates for submission to the Minister of Education and Training for consideration and approval."

8. Amending and supplementing Point a, Point b of Clause 2 of Article 16 as follows:

"a) For candidates currently employed at agencies, units, or localities selected to study abroad under state budget scholarships, the Ministry of Education and Training will issue a summons for studying abroad and a decision to send them abroad when receiving a consent letter from their direct management agency;

b) For candidates currently employed at agencies, units, or localities selected to study abroad under scholarships funded by foreign countries, the Ministry of Education and Training will notify the candidates and their direct management agencies of the admission results to handle the procedures for studying abroad;"

9. Amending and supplementing Article 18 as follows:

"Article 18. Candidates Requesting Withdrawal from Studying Abroad

1. Candidates who have been selected but do not go abroad must notify the Ministry of Education and Training and their direct management agency (if applicable).

2. Candidates who have been selected to study abroad but do not go abroad will not be allowed to apply for scholarship programs managed by the Ministry of Education and Training within one year from the date of notification of non-participation, except in cases of force majeure, which will be decided by the Minister of Education and Training."

10. Amending and supplementing Article 25 as follows:

"Article 25. Responsibilities of Units Under the Ministry of Education and Training

1. The International Cooperation Department:
a) Take the lead and coordinate with relevant units in issuing admission announcements, organizing admissions for studying abroad, and handling post-selection results for projects, programs, and scholarship schemes assigned by the Minister of Education and Training in accordance with these Regulations and related documents;
b) Coordinate with other units responsible for admissions to implement overseas study admissions for projects, programs, and scholarship schemes managed by those units according to the division of tasks assigned by the Minister of Education and Training;
c) Take the lead and coordinate with relevant units to develop overall plans, annual plans, and budget estimates to implement state budget scholarship programs;
d) Take the lead and coordinate with relevant units to compile and report statistics on overseas study admissions under scholarship programs;
đ) Take the lead and coordinate with relevant units to verify the quality and reputation of foreign educational institutions receiving students;
2. The Planning and Finance Department shall balance admission quotas and financial plans for overseas study admissions using state budgets;

3. All Directorates, Departments, and other units shall coordinate with the main admission unit to handle matters related to overseas study admissions according to their assigned functions and responsibilities.";

11. Amend Appendix III attached to the Overseas Study Admissions Regulation issued together with Circular No. 06/2016/TT-BGDĐT dated March 21, 2016, by the Minister of Education and Training;

Article 2. Replace, abolish certain phrases, clauses, articles, and appendices of the Overseas Study Admissions Regulation issued together with Circular No. 06/2016/TT-BGDĐT dated March 21, 2016, by the Minister of Education and Training;

1. Replace the phrase "International Cooperation Department" for the phrase "Overseas Training Department" in Clause 4, Article 13 of this Regulation and Article 3 of Circular No. 06/2016/TT-BGDĐT dated March 21, 2016, by the Minister of Education and Training; replace the phrase "direct management agency" for the phrase "direct supervisory agency" in Article 24 of this Regulation;

2. Abolish Article 17 of this Regulation;

3. Abolish Appendix I; items 5, 6, 7, and 8 of the List of Documents for Overseas Study Candidates at Appendix II issued together with Circular No. 06/2016/TT-BGDĐT dated March 21, 2016, by the Minister of Education and Training;

This Circular takes effect from December 25, 2025/.

The Head of the Office, the Director of the International Cooperation Department, the Heads of relevant units under the Ministry of Education and Training, and related agencies, organizations, and individuals are responsible for implementing this Circular;

Article 4. Effective date

This Circular takes effect from January 30, 2023./.
