Pursuant to the Law on Prevention and Control of Corruption dated November 20, 2018;

Decree No. Notification. Article 1 of the Government's Decree No. 86/2017/NĐ-CP dated July 26, 2017 detailing certain provisions and implementation measures of the Anti-Corruption Law;

Pursuant to the Government Decree number Government's Decree No. 86/2017/NĐ-CP dated July 26, 2017 on the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

Pursuant to the Government's Decree No. 134/2021/NĐ-CP dated December 30, 2021 amending and supplementing some articles of the Government's Decree No. 59/2019/NĐ-CP dated July 1, 2019 detailing certain provisions and implementation measures of the Anti-Corruption Law; number provisions and implementation measures of the Anti- General Corruption Law;

At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Inspector General of the Ministry;

The Minister of Planning and Investment issues this Circular detailing the list and periodic rotation term for job positions for civil servants and officials directly interacting with and handling investment-related tasks at local levels.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular details the list and periodic rotation term for job positions in the field of investment at agencies, organizations, and public service units under the jurisdiction of provincial and centrally-administered city People's Committees.

Article 2. This Circular applies to civil servants not holding leadership or management positions and officials directly interacting with and handling investment-related tasks.

Article 2. List of job positions in the field of investment subject to periodic rotation

1. Reviewing and issuing certificates for foreign investment in Vietnam and Vietnamese investment abroad.

2. Reviewing projects.

3. Tendering and managing tenders.

4. Preparing, allocating, and managing capital plans.

5. Managing planning.

6. Managing industrial zones - export processing zones - economic zones.

7. Managing enterprises and business registration.

8. Managing ODA and preferential loan funds.

Article 3. Periodic Term for Position Rotation

The periodic rotation term for job positions for civil servants not holding leadership or management positions and officials directly interacting with and handling investment-related tasks as stipulated in Article 2 of this Circular is from three to five years.

Article 4. Implementation provisions

Article 1. This Circular takes effect from September 30, 2022.

Article 2. Chairmen of provincial and centrally-administered city People's Committees and relevant organizations and individuals are responsible for implementing this Circular.

Article 3. In the course of implementation, if there are difficulties, agencies and units shall report to the Ministry of Planning and Investment for guidance./.
