Pursuant to Decree No. 30/2007/NĐ-CP dated March 1, 2007 of the Government on lottery business and Decree No. 78/2012/NĐ-CP dated October 5, 2012 of the Government amending and supplementing certain articles of Decree No. 30/2007/NĐ-CP dated March 1, 2007 of the Government on lottery business;
Pursuant to Decree No. 151/2018/NĐ-CP dated November 7, 2018 of the Government amending and supplementing certain Decrees stipulating conditions for investment and business under the management of the Ministry of Finance;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Department of Banking and Financial Institutions;
The Minister of Finance issues this Circular amending and supplementing certain articles of Circular No. 36/2019/TT-BTC dated June 17, 2019 of the Ministry of Finance guiding the operation of lottery number selection computerized lotteries.
Article 1. Amending and supplementing certain articles of Circular No. 36/2019/TT-BTC dated June 17, 2019 of the Ministry of Finance guiding the operation of lottery number selection computerized lotteries:
1. Amending and supplementing Clause 1, Article 17 as follows:
"1. The drawing of lottery number selection computerized lotteries shall be conducted at the headquarters of the lottery company or at other locations but must be within the administrative boundaries of the province or city where the lottery company's headquarters is located, or where the lottery company has a Branch."
2. Supplementing Clause 6, Article 29 as follows:
“6. Refunding the purchase price of lottery number selection computerized lotteries tickets:
a) The lottery company must refund the purchase price of lottery number selection computerized lotteries tickets to all participants in the following cases:
- The schedule for the drawing of lottery number selection computerized lotteries tickets is canceled due to technical failures or force majeure events such as natural disasters, epidemics, fires, but there is no rescheduled drawing date; or there is a rescheduled drawing date but the time of the drawing is later than 72 hours from the original schedule;
- The results of the drawing of lottery number selection computerized lotteries tickets have been canceled according to the conclusion of the competent state management agency (Ministry of Finance, police agency, inspection and audit agency).
b) The lottery company must specify the specific deadline for refunding the purchase price of lottery number selection computerized lotteries tickets in the Rules of Participation but not exceeding 60 days from the original drawing date or the date of announcement of cancellation of the drawing results by the competent authority;
c) Lottery number selection computerized lotteries tickets proposed for refund must meet the conditions specified for winning lottery tickets as stipulated in Clause 2 of this Article.”
Article 2. Implementation clause
This Circular takes effect from April 28, 2022.
During implementation, if any difficulties arise, organizations and individuals are requested to promptly reflect them to the Ministry of Finance for study and supplementary guidance./.
