Amending, Supplementing, and Repealing Certain Articles of Decision No. 39/2021/QĐ-TTg dated December 30, 2021 of the Prime Minister on Principles, Criteria, and Allocation Rates for Central Budget Funds and Local Budget Counterpart Funds to Implement the National Target Program for Socio-Economic Development in Ethnic Minority and Mountainous Areas for the Period 2021-2030, Phase I: From 2021 to 2025
Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to the Law on Public Investment dated June 13, 2019;
Pursuant to the State Budget Law dated June 25, 2015;
Pursuant to Resolution No. 120/2020/QH14 dated June 19, 2020 of the National Assembly approving the investment orientation of the National Target Program for socio-economic development in ethnic minority and mountainous areas for the period 2021-2030;
Pursuant to Resolution No. 973/2020/UBTVQH14 dated July 8, 2020 of the Standing Committee of the National Assembly stipulating principles, criteria, and allocation rates for capital investment from the state budget for the period 2021-2025;
At the proposal of the Minister, Head of the Committee for Ethnic Minorities;
The Prime Minister issues this Decision amending, supplementing, and repealing certain articles of Decision No. 39/2021/QĐ-TTg dated December 30, 2021 of the Prime Minister on principles, criteria, and allocation rates for central budget funds and local budget counterpart funds to implement the National Target Program for socio-economic development in ethnic minority and mountainous areas for the period 2021-2030, Phase I: from 2021 to 2025.
Article 1. Amending, supplementing, and repealing certain articles of Decision No. 39/2021/QĐ-TTg dated December 30, 2021 of the Prime Minister on principles, criteria, and allocation rates for central budget funds and local budget counterpart funds to implement the National Target Program for socio-economic development in ethnic minority and mountainous areas for the period 2021-2030, Phase I: from 2021 to 2025 as follows:
1. Amending and supplementing Point b Clause 1 Article 6 as follows:
"b) Localities shall allocate sufficient local budget funds for the period 2021-2025 to implement the approved goals and tasks. Localities receiving support from the central budget to implement the national target program shall be responsible for allocating local budget funds for the five-year period, ensuring that the annual local budget funds are not less than the required counterpart funds for implementing the Program at the locality according to point b, Clause 2, Article 6 of Decision No. 39/2021/QĐ-TTg."
2. Repeal the provision "allocating up to 17% of the total project fund to the Committee for Ethnic Minorities" stipulated in point a, Clause 2.1, Subproject 2: Supporting production development along value chains, medicinal herb cultivation areas, promoting business startups and attracting investment in ethnic minority and mountainous regions, Appendix III.
3. Amend and supplement point 1.1, Subproject 2: Investing in material infrastructure for public institutions in the field of ethnic affairs, Appendix IV as follows:
"1.1. Capital allocation: The Committee for Ethnic Minorities shall invest in the following Schools: Northern Vietnam High School, Central Pre-University Ethnic Minority School, Sam Son Pre-University Ethnic Minority School, Nha Trang Pre-University Ethnic Minority School, Ho Chi Minh City Pre-University Ethnic Minority School: The allocated funding shall not exceed 43% of the total project fund. The Ministry of Education and Training shall invest in the following Universities: Northwest University, West Highland University, Friendship 78 University, Friendship 80 University: The allocated funding shall not exceed 49% of the total project fund. The People's Committee of Tuyen Quang Province shall invest in Tan Trao University: The allocated funding shall not exceed 9% of the total project fund."
4. Amend and supplement point b, Clause 2.2, Subproject 2: Ethnic knowledge training; pre-university, university, and postgraduate education to meet human resource needs in ethnic minority regions, Appendix V as follows:
"b) Content 2. Pre-university, university, and postgraduate education: Pre-university education, allocating up to 20% of the content 2 project fund to the Committee for Ethnic Minorities."
5. Amend the total score of criterion number 2, point b, Clause 4.2, Subproject 4: Enhancing community and cadre capacity to implement the Program at all levels, Appendix V as follows:
"4.2 Allocation of public expenditure funds:
b) Allocation to localities: Apply the scoring method based on the following criteria:

Article 2. This Decision takes effect from the date of issuance.
Article 3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, relevant central agencies, Chairpersons of provincial and centrally-administered city People's Committees, Heads of units using state budget funds to implement the Program during the 2021-2025 period are responsible for enforcing this Decision.
