ABOLISHING PART OF THE CIRCULAR NO. 04/2020/TT-BNV DATED OCTOBER 13, 2020 ISSUED BY THE MINISTER OF HOME AFFAIRS PROVIDING GUIDELINES AND DETAILING IMPLEMENTATION OF CERTAIN PROVISIONS OF THE DECREE NO. 93/2019/NĐ-CP DATED NOVEMBER 25, 2019 OF THE GOVERNMENT ON THE ORGANIZATION AND OPERATIONS OF SOCIAL FUNDS AND CHARITABLE FUNDS

Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;

Pursuant to Decree No. 93/2019/NĐ-CP dated November 25, 2019 of the Government on the organization and operations of social funds and charitable funds;

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain provisions of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Issuing Legal Normative Documents;

Pursuant to Decree No. 63/2010/NĐ-CP dated June 8, 2010 of the Government on administrative procedure control;

Pursuant to Decree No. 92/2017/NĐ-CP dated August 7, 2017 of the Government amending and supplementing certain provisions of related decrees concerning administrative procedure control;

At the proposal of the Director of the Department of Non-Governmental Organizations;

The Minister of Home Affairs hereby issues this Circular to abolish part of Circular No. 04/2020/TT-BNV dated October 13, 2020 issued by the Minister of Home Affairs providing guidelines and detailing implementation of certain provisions of Decree No. 93/2019/NĐ-CP dated November 25, 2019 of the Government on the organization and operations of social funds and charitable funds.

Article 1. Abolish part of Circular No. 04/2020/TT-BNV dated October 13, 2020 issued by the Minister of Home Affairs providing guidelines and detailing implementation of certain provisions of Decree No. 93/2019/NĐ-CP dated November 25, 2019 of the Government on the organization and operations of social funds and charitable funds.

Abolish Article 2 and Article 3 of Circular No. 04/2020/TT-BNV dated October 13, 2020 issued by the Minister of Home Affairs providing guidelines and detailing implementation of certain provisions of Decree No. 93/2019/NĐ-CP dated November 25, 2019 of the Government on the organization and operations of social funds and charitable funds.

Article 2. Implementation clause

1. This Circular shall take effect from February 1, 2024.

2. The Minister, Heads of Ministries equivalent to Ministries, agencies under the Government, Chairmen of Provincial People's Committees, municipal people's committees directly under the Central Government, social funds, charitable funds, and individuals and organizations related thereto shall be responsible for implementing this Circular./.
