CIRCULAR

Guidelines for Implementing Tasks to Protect and Care for the Health of Cadres at Provincial and Municipal Levels Directly Under the Central Government

Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

To implement Directive No. 07-HD/BTCTW dated August 20, 2021 of the Central Organization Committee on the functions, tasks, powers, and organizational structure of the Cadre Health Protection and Care Board at provincial and municipal levels directly under the Central Government;

At the proposal of the Director of the Department of Personnel and Cadres and the Director of the Department of Medical Examination and Treatment, Ministry of Health;

The Minister of Health issues this Circular guiding the implementation of tasks to protect and care for the health of cadres at provincial and municipal levels directly under the Central Government.

Article 1. Scope of Regulation and Applicability

2. Applicability:

This Circular guides the implementation of tasks to protect and care for the health of cadres at provincial and municipal levels directly under the Central Government.

a) Departments of Health of provinces and municipalities directly under the Central Government;

b) Healthcare facilities assigned the task of protecting and caring for the health of cadres;

c) Relevant agencies, organizations, and individuals.

Article 2. Content of tasks to protect and care for the health of cadres

1. Advising on cadre health protection and care work:

a) Developing programs, projects, proposals, plans, directions, and tasks related to cadre health protection and care work, submitting them to the Cadre Health Protection and Care Board of the province or municipality for comments, and presenting them to competent authorities for consideration, approval, and implementation according to regulations and within their jurisdiction;

b) Guiding, inspecting, and supporting county, district, town, and city-level health protection and care work within the province or municipality;

c) Coordinating to advise on medical examination and treatment policies for cadres under management; policies for healthcare staff implementing cadre health protection and care work within the province or municipality;

d) Organizing mid-term and final reviews, reporting on the implementation of cadre health protection and care tasks within the province or municipality according to regulations.

2. Implementing tasks to protect and care for the health of cadres:

a) Health management: Establishing and managing health records for cadre subjects according to regulations and within their jurisdiction; coordinating with the specialized board for cadre health protection and care of the province or municipality in classifying the health status of managed cadres;

b) Receiving medical examinations, emergency care, outpatient and inpatient treatment, and transferring patients according to regulations; organizing regular health check-ups; promptly treating chronic diseases for managed cadres during outpatient treatment; home or workplace health consultations and follow-ups for cadres under joint management according to regulations;

c) Conducting pre-appointment, reappointment, and candidate recommendation health classifications for cadres under the management of the Provincial Party Committee Standing Committee and other subjects as specified by the Provincial Party Committee Standing Committee;

d) Implementing health communication, providing information, counseling, preventing infectious and non-infectious diseases, vaccinations, and enhancing the health of managed cadres;

đ) Taking the lead and coordinating with relevant agencies to develop and organize medical assurance plans and handle emergency situations for managed cadres according to their jurisdiction when participating in meetings, events, and work on the local territory;

e) Cooperating with relevant agencies to implement policies and benefits for cadre health protection and care; organizing convalescent treatment combined with disease treatment according to regulations and specific conditions of each locality.

3. Managing and mobilizing resources:

a) Compiling and managing lists of high-skilled medical personnel experienced in local medical examination and treatment activities to participate in specialized boards for consultation and emergency care when necessary;

b) Managing human, material, financial, and asset resources to ensure cadre health protection and care tasks according to regulations and within their jurisdiction;

c) Mobilizing or participating in mobilizing resources to address emergency situations involving central party and state leaders working in the locality and other managed cadres according to their jurisdiction.

4. Coordinating to protect and care for the health of cadres at bureau, department, institute, and equivalent levels of central agencies; senior cadres under central management who are working or retired in the locality.

5. Performing other tasks assigned by competent authorities.

Article 3. Implementation Organization

1. Departments of Health of provinces and municipalities directly under the Central Government shall be responsible for:

a) Serving as the focal point for organizing and implementing tasks as stipulated in Clauses 1, 3, 4, and 5 of Article 2 of this Circular; guiding and inspecting the implementation of tasks as stipulated in Clause 2 of Article 2 of this Circular;

b) Leading and coordinating with the Provincial Party Committee Organization Department, Municipal Party Committee Organization Department, Cadre Health Protection and Care Board of the province or municipality, and relevant agencies to submit to the Provincial Party Committee Standing Committee, Municipal Party Committee Standing Committee for consideration and decision on assigning healthcare facilities such as provincial or municipal general hospitals, central general hospitals (if available) located in the locality or other facilities (collectively referred to as units) to perform cadre health protection and care tasks suitable to the specific conditions of each locality;

c) Leading and coordinating with relevant agencies to advise and propose to competent authorities to ensure resources to meet the needs of cadre health protection and care work for specified subjects in the locality;

d) Advising the Cadre Health Protection and Care Board of the province or municipality on establishing specialized boards by field, comprising highly skilled medical personnel experienced in medical examination and treatment activities for consultation, treatment, and determination of medical measures. The tasks, working conditions, number, and standards for members of the specialized board shall be implemented according to the regulations of competent authorities;

đ) Implementing reports on the results of cadre health protection and care work in the locality according to regulations.

2. The head of the unit entrusted with the task of protecting and caring for the health of officials shall be responsible for:

a) Being the focal point for organizing and implementing the tasks as prescribed in Clause 2, Article 2 of this Circular; coordinating to implement the tasks as prescribed in Clauses 1, 3, 4, and 5 of Article 2 of this Circular;

b) Specifying or submitting to the competent authority for approval the form of organization to implement the dedicated task of protecting and caring for the health of officials, which may be the Provincial/City Health Protection Department, Provincial/City Health Protection Ward, or Provincial/City Health Protection Center; operating according to the principles of family medicine; the number of staff, personnel structure, occupational titles (job position list) within the total number of staff of the unit already approved by the competent authority;

c) Establishing regulations on coordination in carrying out the content related to protecting and caring for the health of officials for the target groups as classified: Organizing the scheduling of medical appointments, welcoming, examining, providing emergency care, transporting officials for specialized medical examinations, conducting ancillary clinical examinations, regular health check-ups, establishing and managing outpatient medical records, inpatient medical records in accordance with the provisions;

d) Organizing separate channels for receiving health examinations and checks for officials; arranging separate areas with appropriate conditions at the clinical and ancillary clinical departments of the unit to receive outpatient treatment and inpatient treatment for officials in accordance with the classification suitable for the actual conditions of each locality;

e) Timely reporting to the Provincial/City Health Protection Board about the health status, diseases, and health capacity to meet the requirements and tasks of managed officials as prescribed;

Article 4. Implementation provisions

This Circular takes effect from December 12, 2023.

Article 5. Responsibilities for Implementation

1. The Department of Medical Examination and Treatment under the Ministry of Health shall take the lead and coordinate with the Office of the Central Health Protection Board, relevant departments and units of the Ministry of Health, and related units to guide, organize the implementation, and inspect the implementation of this Circular.

2. The Health Departments of provinces and centrally-administered cities shall advise the People's Committees of provinces and centrally-administered cities to organize the implementation and inspection of the implementation of this Circular within their respective jurisdictions.

During the implementation process, if any issues arise, difficulties, or obstacles occur, it is requested that agencies, organizations, and individuals promptly report to the Ministry of Health (Department of Medical Examination and Treatment) for consideration and resolution./.
