Decree No. 18/2024/NĐ-CP on the Ho Chi Minh Prize, State Prize, and other prizes for science and technology

DECREE

Regarding the Ho Chi Minh Award, the State Award

and other awards for science and technology

Pursuant to the Law on Government Organization dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Government Organization and the Law on Local Administration Organization dated November 22, 2019;

Pursuant to the Law on Competition and Reward dated June 15, 2022;

Pursuant to the Law on Science and Technology dated June 18, 2013;

Pursuant to the proposal of the Minister of Science and Technology;

The Government issues this Decree on the Ho Chi Minh Award, the State Award, and other awards for science and technology. 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree provides for:

1. The subjects, conditions, criteria, procedures, and formalities for conferring or posthumously conferring (hereinafter referred to as conferring) the Ho Chi Minh Award and the State Award for Science and Technology are prescribed in Article 68, Article 69, and Article 70 of the Law on Competition and Reward.

Article 2. Applicability

1. Authors and co-authors are Vietnamese or foreign nationals with scientific and technological works or clusters of scientific and technological works proposed for the Ho Chi Minh Award, the State Award, and sectoral and local awards for science and technology.

Scientific and technological organizations and individuals engaged in scientific and technological activities in Vietnam may receive awards from organizations and individuals for science and technology.

2. Organizations and individuals involved in activities related to establishing and conferring awards for science and technology to scientific and technological organizations and individuals engaged in scientific and technological activities in Vietnam.

3. State agencies, competent authorities, and organizations and individuals implementing the conferral of awards for science and technology and those related to such activities.

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

1. Scientific and technological works include:

a) Scientific research works are the results of exploration, discovery, understanding the nature, laws of natural, social, and mental phenomena; creative solutions applied in practice;

b) Technological development research works are works creating new technologies, new technical solutions, new materials, new breeds, new products;

c) Technological application works are works successfully applying new technologies, new technical solutions.

2. Clusters of scientific and technological works are combinations of multiple scientific and technological works, including:

a) A collection of scientific and technological works by the same author or co-authors identified within a field of science, technology, or application area;

b) A collection of scientific and technological works independently carried out by different authors resulting in the same outcome but using different methods, principles, and techniques. Scientific and technological works and clusters of scientific and technological works are hereinafter referred to as works.

3. The author of a work is the person directly creating the work; if two or more persons directly create the work, they are co-authors. Authors and co-authors of works are hereinafter referred to as work authors.

4. Establishing an award for science and technology is the act of founding an award for science and technology to be conferred on scientific and technological organizations and individuals engaged in scientific and technological activities in Vietnam who meet the conditions and criteria for receiving that award, aiming to encourage the development of science and technology in Vietnam.

5. Publishing a work is the act of presenting the work to the public in the form of publication, presentation, exhibition, demonstration, and other forms as prescribed.

6. Applying a work is using the work in practice to serve human and societal interests.

Article 4. Science and Technology Awards

Science and Technology Awards include the following awards:

1. Ho Chi Minh Award for Science and Technology to be considered for granting to authors whose works meet the conditions stipulated in Article 7 and the criteria specified in Articles 8, 9, and 10 of this Decree.

2. State Award for Science and Technology to be considered for granting to authors whose works meet the conditions stipulated in Article 7 and the criteria specified in Articles 11, 12, and 13 of this Decree.

a) Science and Technology Awards of ministries, sectors, and localities to be granted to authors whose works meet the conditions stipulated in Article 23 and the criteria specified in Article 24 of this Decree;

b) Science and Technology Awards established by organizations and individuals to be considered for granting to scientific and technological organizations and individuals engaged in scientific and technological activities in Vietnam.

Article 5. Principles for Naming and Proposing, Granting Science and Technology Awards

a) The name of a new award must not be identical or similar enough to cause confusion with the names of existing Science and Technology Awards;

b) The name of an organization or individual may not be used to name an award without their consent or that of their legal representative or competent state authority;

c) It must not violate the interests of the state, the rights and legitimate interests of organizations and individuals; it must not contravene moral standards and good customs of the nation.

2. Principles for proposing the granting of the Ho Chi Minh Award and the State Award for Science and Technology:

a) Proposals for award consideration are made on a voluntary basis;

b) Each work can only be proposed for one award in a single round of award consideration;

c) A work that has been awarded the Ho Chi Minh Award cannot be proposed for the State Award; a work that has been awarded the State Award cannot be proposed for the Ho Chi Minh Award.

3. Principles for awarding prizes for works related to state secrets For works related to state secrets, the award granting process follows the procedures and formalities stipulated in this Decree and complies with laws on protecting state secrets.

Article 6. Authority to Organize the Granting of Science and Technology Awards

1. The Ministry of Science and Technology is responsible for organizing the granting of the Ho Chi Minh Award and the State Award for Science and Technology.

Chapter II

HO CHI MINH AWARD, STATE AWARD FOR SCIENCE AND TECHNOLOGY

Section 1

CONDITIONS AND CRITERIA FOR GRANTING AWARDS

Article 7. Conditions for Granting the Ho Chi Minh Award and the State Award for Science and Technology

1. For authors: Directly creating and contributing to the scientific and technological value of the work; not violating the provisions of Article 8 of the Law on Science and Technology and meeting the following conditions:

a) For Vietnamese citizens: Adhering well to the Party's guidelines, state policies, and laws;

b) For foreign citizens: Respecting Vietnam's independence, sovereignty, unity, territorial integrity, laws, and fine traditions and customs.

2. For works:

a) Legitimate files, published according to regulations (except for works containing content related to state secrets), or applied in Vietnam;

b) The time from publication or application in practice of the work must be at least three years, or the innovative application of the work must have been effective for at least one year as of the date of submission of the proposal for the Ho Chi Minh Award and the State Award for Science and Technology.

Article 8. Criteria for awarding the Ho Chi Minh Prize to scientific research works

Scientific research works proposed for the Ho Chi Minh Prize must meet the following criteria:

1. Particularly outstanding work The results of the research must include new inventions or be prominent and exemplary scientific achievements leading to particularly important changes in understanding, production, national defense, security, and social life.

2. Work with very high scientific value:

a) Revealing the essence, laws of development of objects or phenomena, or meeting one of the following criteria: Establishing a new research direction; new ideas or concepts; new understanding; new approach; new theory; new method; new knowledge; new scientific and technological discoveries;

b) Published and cited in reputable domestic or international scientific journals.

3. Work with significant impact serving the revolutionary cause, having wide and long-lasting influence on people's lives, making a significant contribution to the country's economic and social development, science, technology, or applied in practice with one of the following effects:

a) Generating substantial economic benefits or rationally changing the structure of industries; reducing production costs; increasing labor productivity; minimizing negative environmental impacts;

b) Making a particularly important contribution to forecasting future trends, formulating and implementing Party policies and State laws;

c) Changing societal perceptions or having a particularly important impact on social life; raising public awareness; positively altering group or class behavior;

d) Having a significant educational effect, used in university and postgraduate research and training.

Article 9. Criteria for awarding the Ho Chi Minh Prize to technological research and development works

Technological research and development works proposed for the Ho Chi Minh Prize must meet the following criteria:

1. Particularly outstanding work

The results of the research must be prominent and exemplary scientific and technological achievements with particularly important innovation and creativity in technology or creating new technologies reaching international or regional advanced levels.

2. Work with very high scientific and technological value

a) Solving key issues to improve and innovate technology, create new products or obtain patents, utility models, or publish research results in reputable international specialized journals;

b) Making a particularly important contribution to transforming the production structure, creating conditions for the formation and development of new industries, enhancing the competitiveness of products and economic sectors.

3. Work with significant impact serving the revolutionary cause, having wide and long-lasting influence on people's lives, making a significant contribution to the country's economic and social development, science, technology, or applied in practice with one of the following effects:

a) Generating substantial economic benefits or producing national products, export brands, or replacing imported goods;

b) Changing traditional labor and production methods or improving working and production conditions or contributing to improving the quality of people's lives;

c) Developing technology reaching advanced levels in the region and globally for industries, fields, and localities.

Article 10. Criteria for awarding the Ho Chi Minh Prize for technology application projects

Technology application projects proposed for the Ho Chi Minh Prize must meet the following criteria:

1. Particularly outstanding work

The results of technology application must be outstanding achievements with special creativity, contributing to industrial-scale production of goods with high economic efficiency.

2. The project must have very high technological value, successfully applied and effective in national key projects, including one of the following cases:

a) Creating particularly innovative breakthrough technology;

b) Making significant technical and technological improvements that yield high efficiency;

c) Developing an overall plan with accompanying synchronized technical solutions.

3. Work with significant impact serving the revolutionary cause, having wide and long-lasting influence on people's lives, making a significant contribution to the country's economic and social development, science, technology, or applied in practice with one of the following effects:

a) Generating very large socio-economic benefits, making significant contributions to socio-economic development or national defense and security, or producing products and goods with high economic efficiency, replacing imports;

b) Making important contributions to the development of science and technology in the field.

Article 11. Criteria for awarding the State Prize for scientific research projects

Scientific research projects proposed for the State Prize must meet the following criteria:

1. The project must have high scientific value

a) Outstanding scientific research project: Supplementing new knowledge and ideas; making new scientific discoveries leading to new perceptions and approaches in science or having a significant impact on production and life;

b) Published and cited in reputable domestic or international scientific journals.

2. The project must have a significant social impact when meeting one of the following requirements:

a) Yielding economic benefits, significantly contributing to socio-economic development or rationally changing industry structures; reducing production costs; increasing labor productivity; minimizing negative environmental impacts;

b) Making important contributions to forecasting future trends, formulating and implementing Party guidelines and state policies;

c) Changing societal perceptions or having a significant impact on social life; raising public awareness; positively altering group and class behavior in society;

d) Being beneficial in education, used for research and higher education.

Article 12. Criteria for awarding the State Prize for technology development research projects

Technology development research projects proposed for the State Prize must meet the following criteria:

1. The project must have high scientific and technological value

a) Outstanding technology development research project, solving critical issues for technological improvement and innovation, creating new products;

b) Making a particularly important contribution to transforming the production structure, creating conditions for the formation and development of new industries, enhancing the competitiveness of products and economic sectors.

2. The project must have a significant social impact

a) Yielding economic benefits, significantly contributing to socio-economic development;

b) Changing traditional labor and production methods or improving working conditions and environments, or contributing to increased labor productivity and improved quality of life for the people.

Article 13. Criteria for awarding the State Prize for technology application projects

Technology application projects proposed for the State Prize must meet the following criteria:

1. The project must have high technological value

An outstanding technology application project, successfully applied and effective in national key projects, including one of the following cases:

a) Creating breakthrough technology;

b) Making significant technical and technological improvements yielding high efficiency;

c) Contributing to developing an overall plan with accompanying synchronized technical solutions.

2. The project must have a significant social impact:

a) Yielding economic benefits, significantly contributing to socio-economic development or national defense and security, or producing products and goods with high economic efficiency, replacing imports;

b) Making important contributions to the development of science and technology in the field.

Section 2

 PROCEDURES FOR AWARDING PRIZES, RIGHTS AND RESPONSIBILITIES OF AUTHORS OF AWARDED PROJECTS

Article 14. Time for Awarding the Ho Chi Minh Prize and the State Prize

1. The Ho Chi Minh Prize and the State Prize for Science and Technology shall be awarded and announced every five years on the occasion of the National Day of the Socialist Republic of Vietnam (September 2).

2. The Ministry of Science and Technology shall notify the plan and deadline for awarding the Prizes in the second quarter of the year immediately preceding the year in which the awarding takes place.

3. The Minister, the head of a ministry-level agency, an agency under the Government, a central state agency, the Chairman of the People's Committee of provinces and centrally governed cities shall base on the plan for organizing the awarding of the Prizes by the Ministry of Science and Technology and the regulations on the budget for organizing the awarding of the Prizes stipulated in the Decree detailing the implementation of certain provisions of the Law on Competition and Reward to incorporate into the science and technology plan of the ministry, sector, or locality and notify organizations and individuals within their management scope to implement.

Article 15. Procedures and Time Limit for Awarding the Ho Chi Minh Prize and the State Prize

The awarding of the Prizes shall be carried out at three levels, with the procedures and time limits for completing the awarding process at each level (excluding holidays and public holidays) as follows:

第一级：基层单位

a) The author of the work or the lawful representative of the author submits the application dossier for the awarding of the Prize to the agency or organization directly managing the author of the work. In case the author of the work does not have an agency or organization directly managing them, the submission shall be made to the Department of Science and Technology where the author resides.

For foreign authors with works researching Vietnam, the work dossier shall be submitted to a scientific and technological organization. Such organization shall be responsible for guiding the author of the work and the awarding process according to the regulations.

b) The work shall be reviewed by the Awarding Council at the grassroots level established by the head of the agency or organization directly managing the author of the work, the Director of the Department of Science and Technology where the author or the lawful representative of the author resides, or the head of the scientific and technological organization.

The procedures for awarding the Prize at the grassroots level shall be carried out in accordance with Article 17 of this Decree. The awarding of the Prize shall be completed within thirty days from the end date of receiving the application dossiers for the awarding of the Prize.

The head of the agency or organization establishing the Awarding Council at the grassroots level shall send the dossier to the head of the agency establishing the Awarding Council at the ministry, sector, or provincial level to proceed with subsequent procedures. For scientific and technological organizations, the head of the organization establishing the Awarding Council at the grassroots level shall send the dossier to the head of the agency at the ministry or provincial level issuing the registration certificate for scientific and technological activities to the organization.

2. At the ministry, sector, and provincial levels:

The work shall be reviewed by the Awarding Council at the ministry, sector, or provincial level established by the Minister, the head of a ministry-level agency, an agency under the Government, a central state agency, or the Chairman of the People's Committee of provinces and centrally governed cities.

The procedures for awarding the Prize at the ministry, sector, or provincial level shall be carried out in accordance with Article 18 of this Decree. The awarding of the Prize shall be completed within thirty days from the end date of receiving the application dossiers for the awarding of the Prize from the grassroots level. The head of the agency establishing the Awarding Council at the ministry, sector, or provincial level shall send the dossier to the Ministry of Science and Technology to proceed with subsequent procedures.

3. At the national level, it is implemented in two steps:

a) Step 1: Review by the National Specialized Awarding Council established by the Minister of Science and Technology.

The procedures for awarding the Prize at the National Specialized Awarding Council shall be carried out in accordance with Article 19 of this Decree. The organization of the awarding of the Prize shall be completed within ninety days from the end date of receiving the application dossiers for the awarding of the Prize from the ministry, sector, or provincial level. The Minister of Science and Technology shall send the dossier to the National Council for consideration and selection.

b) Step 2: Review by the National Awarding Council established by the Prime Minister based on the proposal of the Minister of Science and Technology. The Council shall have a working team assisted by the Minister of Science and Technology.

The procedures for awarding the Prize at the National Awarding Council shall be carried out in accordance with Article 20 of this Decree. The organization of the awarding of the Prize shall be completed within thirty days from the date the National Awarding Council receives the application dossiers for the awarding of the Prize.

The results of the review of the Prize shall be sent by the National Awarding Council to the Ministry of Home Affairs for verification and submission to the Prime Minister.

Article 16. Award Granting Councils at Various Levels

1. Composition of the Award Granting Councils at Various Levels

a) The Award Granting Councils at various levels consist of the Chairperson, Vice-Chairpersons, and other members. The Council assigns two members with deep expertise in the scientific and technological field of the project to serve as review committee members for each project and one member to serve as the scientific secretary (except for the National Award Granting Council).

Members of the Award Granting Councils at various levels must not have projects participating in the award granting process; they must not have any rights, interests, or other reasons that could affect the impartiality of the award granting process.

b) The Award Granting Council at the grassroots level shall have from seven to nine members. The Award Granting Council at the ministry, sector, and local level shall have from nine to eleven members. Members of the Council include managers, reputable scientists with appropriate professional qualifications, and those knowledgeable about the scientific and technological field of the project.

In necessary cases, the entity establishing the Award Granting Council at the grassroots and ministry, sector, and local levels may invite representatives from organizations that have applied the results of the project to attend the Council's meeting to provide additional opinions on the project.

c) The National Professional Award Granting Council shall have from eleven to thirteen members. Members of the Council are reputable scientists whose works are in the same field as one of the projects proposed for the award.

The Chairperson or Vice-Chairperson of the National Professional Award Granting Council is a member of the National Award Granting Council.

d) The National Award Granting Council shall have from twenty-one to twenty-five members, including reputable scientists from various fields of science and technology.

2. Principles of Operation of the Award Granting Councils at Various Levels

The Council evaluates fairly, democratically, and objectively, votes by secret ballot, and decides according to the ratio specified for each award granting level.

The Council only considers project files that fully meet the required components as stipulated, specifically:

a) The National Award Granting Council only considers projects recommended by the National Professional Award Granting Council. The Council's session must have at least 90% of its members present, including the Chairperson or Vice-Chairperson (authorized in writing by the Chairperson). The number of sessions, procedures, and working methods of the Council are decided by the Minister of Science and Technology based on the number and scale of the projects proposed for the award.

b) The National Professional Award Granting Council only considers projects recommended by the Award Granting Council at the ministry, sector, and local level; the Award Granting Council at the ministry, sector, and local level only considers projects recommended by the Award Granting Council at the grassroots level.

The number of Council sessions depends on the number of scientific and technological fields and the scale of the projects proposed for the award, decided by the permanent agency organizing the award based on the proposal of the Chairperson.

The Council's meeting must have at least three-quarters of its members present, chaired by the Chairperson or Vice-Chairperson (authorized in writing by the Chairperson), including two review committee members and the scientific secretary.

When necessary, the Award Granting Council may request the head of the agency deciding to establish the Council to invite independent experts to provide additional opinions on the project.

For the National Professional Award Granting Council: The number of National Professional Award Granting Councils depends on the number of scientific and technological fields of the projects proposed for the award. The first session of the Council shall be organized within fifteen days from the date of the decision to establish the Council. In necessary cases, the Award Granting Council may request the head of the agency deciding to establish the Council to organize on-site surveys to obtain additional grounds for reviewing and evaluating the project. The Council members participating in the survey include: the Chairperson or Vice-Chairperson, Review Committee Members, Scientific Secretary, and Administrative Secretary (a member of the Working Group assisting the Minister of Science and Technology in implementing the organization of the award granting process, established by the Minister of Science and Technology).

3. Responsibilities of Members of the Award Granting Councils at Various Levels

a) For the Award Granting Councils at the grassroots, ministry, sector, and local levels, and the National Professional Award Granting Council:

The Chairperson of the Award Granting Council is responsible for all activities of the Council, ensuring progress, timeframes, and results of the award granting process in the Council's field; the Vice-Chairperson is responsible for performing tasks when authorized by the Chairperson.

Council members are responsible for researching, commenting, and evaluating project files proposed for the award in writing; absent members must submit their comments and evaluations of the project proposed for the award to the Chairperson one day before the Council convenes.

Review Committee Members are responsible for writing detailed comments and evaluations of the project.

The Scientific Secretary records complete and accurate minutes of all Council sessions. The minutes must be signed by the chairperson and the scientific secretary.

b) For the National Award Granting Council:

The Chairperson is responsible for all activities of the Council, ensuring progress, timeframes, and results of the award granting process of the Council; the Vice-Chairperson is responsible for performing tasks when authorized by the Chairperson.

Council members are responsible for reporting the results of the award granting process in the field of the National Professional Award Granting Council chaired or co-chaired by that member at the Council's session.

The Chairperson, Vice-Chairperson, and other members of the Council are responsible for reviewing, evaluating, and voting to select projects proposed for the award.

4. The forms applicable for the meetings of the Council for awarding the Prize at the grassroots level, ministry, sector, locality, and national specialized level include:

a) The work evaluation form according to Form No. 06a, Form No. 06b, and Form No. 06c attached to this Decree;

b) The work assessment form for the proposed Prize according to Form No. 07 attached to this Decree;

c) The record of vote counting for assessing the proposed work for the Prize according to Form No. 08 attached to this Decree;

d) The minutes of the Council meeting for awarding the Prize according to Form No. 09 attached to this Decree.

Article 17. Procedures for awarding the Ho Chi Minh Prize and the State Prize for Science and Technology at the grassroots level

1. Application dossier for awarding the Prize

The author of the work or the lawful representative of the author submits directly or through postal service one set of application dossier accompanied by an electronic version (in PDF format) stored on a USB drive, including:

a) The registration form for applying for the Prize (original) according to Form No. 01 attached to this Decree;

b) The summary report of the work (original) according to Form No. 02a, Form No. 02b, and Form No. 02c attached to this Decree;

c) Relevant documents regarding the publication or the original confirmation document of the application results of the work according to Form No. 03 attached to this Decree;

d) Copies of relevant documents, scientific and technological materials, and other related documents (if any). For works about Vietnam by foreign authors where the application uses a foreign language, a certified Vietnamese translation must be attached (original).

2. Responsibilities of the head of the agency or organization directly managing the author of the work, the Director of the Department of Science and Technology, and the head of the scientific and technological organization:

a) Organizing guidance and announcing the deadline for receiving the application dossier for awarding the Prize;

b) Organizing the receipt of the application dossier for awarding the Prize;

c) Deciding to establish the grassroots-level Council for awarding the Prize;

d) Organizing the meeting of the grassroots-level Council for awarding the Prize to review and assess the work;

đ) Sending the document proposing the awarding of the Prize along with the list and dossier of works meeting the conditions and criteria to the head of the agency establishing the Council for awarding the Prize at the ministry, sector, and locality level within five working days from the date of receiving the results from the grassroots-level Council for awarding the Prize;

e) Receiving and processing complaints, reports, petitions, and reflections (if any).

3. Responsibilities of the grassroots-level Council for awarding the Prize

a) Reviewing and assessing the work proposed for the Prize according to the standards stipulated from Article 8 to Article 13 of this Decree;

b) Proposing the head of the agency or organization deciding to establish the grassroots-level Council for awarding the Prize to notify in writing to the author of the work or the lawful representative of the author about the result of awarding the Prize within five working days from the end of the Council's session; in case the work is proposed for the next level award, requiring the completion of the dossier according to the Council's opinion (if any);

c) Sending the list and dossier of works receiving at least 80% of the total number of Council members' votes to the head of the agency or organization deciding to establish the grassroots-level Council for awarding the Prize within seven working days from the date of the Council's decision on awarding the Prize at the grassroots level to proceed with subsequent procedures.

Article 18. Procedures for considering the Ho Chi Minh Award and State Award for Science and Technology at the ministry, sector, and local level

1. Application dossier for awarding the Prize

The application dossier for award consideration (one set) shall be submitted directly or via postal service, including:

a) The application document for award consideration (original) issued by the head of the agency or organization directly managing the author of the work, the Director of the Department of Science and Technology, or the head of the scientific and technological organization according to Model No. 05 attached to this Decree;

b) The minutes of the meeting to consider the award of the award-granting council at the grassroots level (original);

c) The application dossier for award consideration as stipulated in Clause 1 of Article 17 of this Decree.

2. The Minister, the head of an equivalent-level agency under the Government, or other central state agencies, the Chairman of the People's Committee of provinces and centrally-administered cities shall, based on the plan for organizing the award consideration of the Ministry of Science and Technology, be responsible for:

a) Organizing guidance and announcing the deadline for receiving the application dossier for awarding the Prize;

b) Organizing the receipt and processing of the application dossier for award consideration;

c) Publishing on the electronic portal of the ministry, sector, or locality the list of authors of works and the names of works proposed for award consideration during the period of conducting the award consideration;

d) Establishing the award-granting council at the ministry, sector, or local level;

đ) Organizing meetings of the award-granting council at the ministry, sector, or local level to review and evaluate the works;

e) Publishing on the electronic portal of the ministry, sector, or locality the results of the award consideration by the award-granting council at the ministry, sector, or local level for at least 10 days;

g) Sending the application document for award consideration along with the list and dossier of works meeting the conditions and criteria to the Ministry of Science and Technology within five working days from the date of receiving the results from the award-granting council at the ministry, sector, or local level;

h) Receiving and handling complaints, reports, suggestions, and reflections (if any).

3. Responsibilities of the award-granting council at the ministry, sector, or local level

a) Reviewing and evaluating the works proposed for award consideration based on the standards specified from Article 8 to Article 13 of this Decree;

b) Proposing the head of the agency that decides to establish the award-granting council at the ministry, sector, or local level to notify relevant agencies or organizations to inform the author of the work or the legal representative of the author of the work to cooperate and complete the application dossier for award consideration according to the council's opinion (if any) for the next level of award consideration;

c) Sending the list and dossier of works achieving at least 80% of the total number of council members' votes of approval to the head of the agency that decides to establish the award-granting council at the ministry, sector, or local level to proceed with subsequent procedures within five working days from the date of obtaining the award consideration results at the award-granting council at the ministry, sector, or local level.

Article 19. Procedures for considering the Ho Chi Minh Award and State Award for Science and Technology at the specialized award-granting council at the national level

1. The application dossier for award consideration (one set) shall be submitted directly or via postal service, including:

a) The application document for award consideration (original) issued by the Minister, the head of an equivalent-level agency under the Government, other central state agencies, or the Chairman of the People's Committee of provinces and centrally-administered cities according to Model No. 05 attached to this Decree;

b) The minutes of the meeting to consider the award of the award-granting council at the ministry, sector, or local level (original);

c) The application dossier for award consideration as stipulated in Clause 1 of Article 18 of this Decree.

2. Responsibilities of the Minister of the Ministry of Science and Technology:

a) Organizing guidance and announcing deadlines for receiving application dossiers for award consideration at all levels;

b) Organizing the receipt and processing of the application dossier for award consideration;

c) Publishing on the electronic portal of the Ministry of Science and Technology the list of works accompanied by the authors of the works and a summary report of the works proposed for award consideration;

d) Seeking opinions from central ministries, sectors, or provincial People's Committees related to the implementation of the Party's guidelines, state policies, and laws regarding the authors of the works; for foreign authors, following the regulations of the Decree detailing the implementation of certain provisions of the Law on Competition and Rewards;

đ) Establishing specialized award-granting councils at the national level as prescribed;

e) Organizing meetings of the specialized award-granting councils at the national level to review and evaluate the works;

g) Publishing on the electronic portal of the Ministry of Science and Technology the results of the award consideration at the specialized award-granting council at the national level for at least 10 days;

h) Sending the application document for award consideration along with the list and dossier of works meeting the conditions and criteria to the national-level award-granting council within five working days from the date of receiving the results from the specialized award-granting council at the national level;

i) Receiving and handling complaints, reports, suggestions, and reflections (if any).

3. Responsibilities of the specialized award-granting council at the national level

a) Reviewing and evaluating the works proposed for award consideration based on the standards specified from Article 8 to Article 13 of this Decree;

b) Proposing the Ministry of Science and Technology to notify relevant agencies or organizations to inform the author of the work or the legal representative of the author of the work to cooperate and develop a summary report on the effectiveness of the work according to Model No. 04 attached to this Decree if the work is proposed for award consideration at the next level;

c) Sending the list and dossier of works achieving at least 90% of the total number of council members' votes of approval to the Minister of the Ministry of Science and Technology to proceed with subsequent procedures within five working days from the date of obtaining the award consideration results of the specialized award-granting council at the national level.

Article 20. Procedures for considering the Ho Chi Minh Award and State Award at the National Award Granting Council

1. Application dossier for considering the State Award

a) The proposal document of the Minister of Science and Technology along with the list of works proposed for award consideration (original copy);

b) Minutes of the meeting to consider the award of the specialized national award granting council (original copy);

c) The application dossier for considering the award of the specialized national award granting council as stipulated in Clause 1, Article 19 of this Decree;

d) Summary report on the effectiveness of the work (original copy).

2. Responsibilities of the Minister of Science and Technology

a) Submit one set of the dossier as prescribed in Clause 1 of this Article to the National Award Granting Council;

b) Organize meetings of the National Award Granting Council in accordance with regulations;

c) Announce the results of the award consideration of the National Award Granting Council within ten days on the Ministry of Science and Technology's electronic portal and publish three consecutive issues in central newspapers;

d) Receive and process complaints, accusations, suggestions, and reflections (if any).

3. Responsibilities of the National Award Granting Council

a) Examine, evaluate, and vote to select works proposed for award;

b) Propose the Ministry of Science and Technology to notify relevant agencies or organizations to inform the authors of the works or their legal representatives to cooperate and complete the award application dossier according to the Council's opinion (if any);

c) Prepare the award application dossier for works receiving at least 80% approval from the total number of Council members who attended the voting session, including: Petition; list, summary report on the effectiveness of the work; minutes of the meeting to consider the award of the National Award Granting Council; opinions of the ministry-level agency, sectoral agency, or provincial People's Committee related to the author of the work;

d) Send one set of the award application dossier as prescribed in Point c of this Clause directly or through postal service to the Ministry of Home Affairs for consolidation and submission.

Article 21. Rights and responsibilities of the authors of works awarded the Ho Chi Minh Award and State Award for Science and Technology

1. Receive the Ho Chi Minh Award or State Award for Science and Technology certificate, prize money as stipulated in the Detailed Regulation Decree implementing certain provisions of the Law on Competition and Rewards, and other benefits related to the Award.

2. Adhere to laws on competition and rewards.

Chapter III

AWARDS OF MINISTRIES, SECTORS, AND LOCALITIES FOR SCIENCE AND TECHNOLOGY

1. Ministries, sectors, and localities base on their management fields and specific conditions to decide on organizing award consideration for science and technology.

In case of organizing award consideration, ministries, sectors, and localities shall develop and promulgate Regulations on award consideration and send the Regulations on award consideration to the Ministry of Science and Technology for consolidation and monitoring of implementation. The Regulations specify main contents including the name of the award, time of holding the award, award recipients, fields of consideration, award structure, prize amount, award granting council, model summary report on the work, and other relevant contents suitable to the industry, field of management, and specific conditions of ministries, sectors, and localities.

2. The period for organizing award consideration shall not be less than once every three years for awards funded from the state budget. The awards shall be announced and presented on Vietnam Science and Technology Day on May 18 or at a suitable time decided by ministries, sectors, and localities.

1. For works, they must meet the following conditions:

a) Belong to the management domain of ministries, sectors, or implemented within the scope of localities and directly serve the development of ministries, sectors, or the economic, social, national defense, and security development of localities;

b) Be published or applied in practice for at least one year as of the date of submitting the application dossier for prize consideration.

2. For authors

Adhere well to the Party's guidelines, state policies, and laws; not violate the provisions stipulated in Article 8 of the Law on Science and Technology.

1. Regarding scientific and technological value

a) For scientific research works: Supplement new knowledge or make new scientific discoveries that have an impact on production and social life within the management scope of ministries, sectors, or localities;

b) For research and development technology works: Solve technological issues, create new technologies higher than similar technologies currently being applied in ministries, sectors, or localities;

c) For technology application works: Contribute to creating an overall plan with accompanying technical solutions or making technical and technological improvements to successfully and creatively apply advanced technology in large projects of ministries, sectors, or localities or have an impact on the economic-technical efficiency of such projects.

2. Regarding practical value:

a) For scientific research works: Have an impact on public understanding and social life or contribute to building mechanisms, policies, and laws within the management scope of ministries, sectors, or localities based on the science and practical aspects of the work;

b) For research and development technology works: Contribute to technological innovation or create new products with significant economic value, capable of enhancing the competitiveness of products or economic sectors;

c) For technology application works: Yield benefits in economic and social development or national defense and security or international integration; protect the environment.

1. Application dossier for prize consideration

a) The registration form for prize consideration (original copy) according to Model No. 10 attached to this Decree;

b) Summary report of the work (original copy);

c) Relevant documents regarding publication or original copies of confirmation documents on the results of applying the work.

d) Other relevant documentation related to the work (if any).

2. Prize awarding procedures:

a) Authors of the work or their legitimate representatives submit the application dossier for prize consideration (one set) directly or through postal service to the ministry, sector where the author works, or the People's Committee of the province where the author resides;

b) The application dossier for prize consideration is reviewed by two levels of Councils: the grassroots-level Award Granting Council or the specialized Award Granting Council and the ministerial, sectoral, or local Award Granting Council established by the Minister, Head of a ministry-level agency, member of the Government, other central state agencies, or the Chairman of the provincial People's Committees under central jurisdiction.

The time limit for organizing the award granting process at each level of Council is thirty days from the end date of receiving applications.

c) The unit entrusted to organize the award has the responsibility to compile and present to the Minister, Head of a ministry-level agency, member of the Government, other central state agencies, or the Chairman of the provincial People's Committees under central jurisdiction for consideration and decision to grant awards within fifteen days from the date of the award granting Council's decision at the ministerial, sectoral, or local level.

Ministries, sectors, and localities announce the results of award consideration on their respective electronic information portals within ten days from the date of issuing the award decision.

1. Composition of the Award Granting Council

a) The Award Granting Council shall consist of from five to nine members. The Council includes a Chairperson, Vice-Chairpersons, and other members. Members of the Council include managers, scientists with appropriate expertise, and those who understand the field of science and technology related to the project;

b) Council members must not have any rights, interests, or other reasons that may affect the impartiality of the award granting process;

c) In cases where necessary, the person establishing the Council may invite representatives from institutions that have applied the results of the project to attend Council meetings to provide additional opinions on the project.

2. Principles of Operation of the Award Granting Council of Ministries, Sectoral Agencies, and Localities in the Field of Science and Technology:

a) The Council evaluates fairly, democratically, and objectively, using secret ballot voting;

b) At least three-quarters of the Council members must be present at the meeting, chaired by the Chairperson or Vice-Chairperson (authorized in writing by the Chairperson);

c) A project proposed for an award must receive at least 80% of the votes from Council members (members absent may submit their opinions in writing). In cases where projects have the same number of votes for an award and exceed the award structure (if applicable), a re-vote will be conducted.

1. They are entitled to receive an Award Certificate, monetary awards from the state budget paid by ministries, sectoral agencies, or localities not exceeding 100 times the base salary for each project, and other benefits as stipulated by law.

2. Adhere to laws on competition and rewards.

Chapter IV

AWARDS FOR ORGANIZATIONS AND INDIVIDUALS IN THE FIELD OF SCIENCE AND TECHNOLOGY

1. Organizations and individuals residing or legally operating in Vietnam are eligible to establish and grant awards in the field of science and technology in Vietnam.

2. Application Documents for Establishing and Granting Awards

a) An application form (original) according to Model No. 11 attached to this Decree;

b) Draft Regulations on Award Granting specifying the name of the award, the target group, principles, conditions, criteria, procedures for award granting, benefits for organizations and individuals receiving awards, and the time frame for award granting.

3. Implementation Process

Application documents for establishing and granting awards in the field of science and technology as stipulated in Clause 2 of this Article shall be submitted directly or through postal service (one set) to the People's Committee of the province or centrally-administered city (through the Department of Science and Technology) or submitted online through the Provincial Administrative Procedure Information System where the organization's main office is located or where the individual resides.

The Department of Science and Technology shall process the application within fifteen days from the date of receipt of complete documents as prescribed, and submit it to the People's Committee of the province or centrally-administered city for decision.

Within ten days from the date of receipt of complete documents as prescribed, the People's Committee of the province or centrally-administered city shall issue a written response agreeing or disagreeing with the establishment and award granting by the organization or individual in the field of science and technology, and if disagreeing, must specify the reasons.

1. Overseas Vietnamese individuals, international organizations, foreign organizations, and individuals not residing or operating in Vietnam may establish and award science and technology prizes in Vietnam.

2. Application Documents for Establishing and Granting Awards

a) An application form (original) according to Model No. 11 attached to this Decree;

b) Draft Regulations on Award Granting specifying the name of the award, the target group, principles, conditions, criteria, procedures for award granting, benefits for organizations and individuals receiving awards, and the time frame for award granting.

In cases where the application uses a foreign language, it must be accompanied by a certified Vietnamese translation in accordance with the provisions of the law.

3. Implementation Process

The registration dossier for establishing and awarding science and technology prizes as stipulated in Clause 2 of this Article shall be submitted directly or through postal service (one set) to the Ministry of Science and Technology or submitted online via the Government Administrative Procedure Information System of the Ministry of Science and Technology.

Within twenty days from the date of receiving a complete dossier in accordance with the regulations, the Ministry of Science and Technology shall issue a written response agreeing or disagreeing with the organization or individual's establishment and awarding of science and technology prizes; in case of disagreement, the reasons must be clearly stated.

Chapter V

IMPLEMENTING PROVISIONS

Article 30. Effective Date

1. This Decree takes effect from April 10, 2024.

2. Decree No. 78/2014/ND-CP dated July 30, 2014 of the Government on the Ho Chi Minh Prize, State Prize, and other science and technology prizes; Decree No. 60/2019/ND-CP dated July 5, 2019 of the Government amending and supplementing certain articles of Decree No. 78/2014/ND-CP dated July 30, 2014 of the Government on the Ho Chi Minh Prize, State Prize, and other science and technology prizes shall cease to be effective from the date this Decree takes effect.

3. Science and technology prizes that have been implemented and announced plans for awarding before the date this Decree takes effect shall continue to be carried out according to current regulations related to such prizes until the prize awarding process is completed.

Article 31. Responsibility for Implementation

The Minister of Science and Technology, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, central-level state agencies, Chairpersons of provincial and centrally-administered city People's Committees, and relevant organizations and individuals are responsible for implementing this Decree.
