DECREE OF THE MINISTRY OF LABOR
Establishing a wage-setting council for workers in each resistance administrative region
THE MINISTER OF LABOR
Pursuant to Decree No. 29/SL dated March 12, 1947, which stipulates the worker regime throughout Vietnam, particularly Article 60 of that Decree;
Pursuant to Decree No. 169/SL dated April 14, 1948, establishing a Labor Department in each resistance administrative region;
Considering the current situation,
DECREE:
Article 1. - Now, establish in each resistance administrative region throughout Vietnam a Council to set the minimum wage for workers and the maximum labor cost.
Article 2. - The Council consists of:
- Chairman of the Resistance Administrative Committee of the region...Chairman
- Director of the Labor Department of the region...Secretary
- Director or representative of the Economic Department of the region...Member
- Secretary of the regional trade union federation...Member
- One female representative...Member
- Two representatives from the business and industrial sector...Members
- Two representatives from the agricultural sector...Members
- Two farmer representatives...Members
The list of members will be submitted to the Minister of Labor for approval by the Resistance Administrative Committee of the region.
Article 3. - The Council shall convene twice a year, in June and December of the Gregorian calendar.
When necessary, extraordinary sessions may be convened by the Director of the Labor Department of the region.
Article 4. - The Council shall determine the minimum wage based on the minimum living expenses of a non-professional worker living alone for one day within the region.
The Council shall also set the maximum labor cost, as appropriate, for one or more categories of workers based on the demand for labor in the market, to prevent unreasonable demands that hinder production, harvesting, and transportation.
Article 5. The resolutions of the Council shall be implemented immediately upon announcement by the Chairman of the Resistance Administrative Committee of the region, but must comply with Articles 56, 57, 58, 59, 61, 62, 63, and 65 of Decree No. 29/SL dated March 12, 1947, and a copy of the resolution must be sent to the Minister of Labor for promulgation.
Article 6. Members of the Council setting the minimum wage and maximum labor cost shall receive a daily allowance of 30 dong and travel expenses according to current regulations.
Article 7. The Council's budget shall be covered by the Ministry of Labor's budget.
Article 8The Heads of the Ministry of Labor's Office, Chairmen of the Resistance Administrative Committees of the regions, and Directors of the Labor Departments are hereby authorized to implement this Decree./.
