RESOLUTION
On certain mechanisms and policies to promote development of housing for students at educational institutions and workers in concentrated industrial zones, and low-income individuals in urban areas

In recent years, the State has issued many mechanisms and policies to create conditions for various economic sectors, households, and individuals to establish housing. The living conditions of different strata of the population have significantly improved. Even those with difficulties in housing, such as ethnic minority groups, poor households in rural areas and regions frequently affected by natural disasters, have improved their housing. However, due to various reasons, some social groups in urban areas, such as students at universities, colleges, vocational high schools, and technical colleges; workers in concentrated industrial zones; civil servants, public officials, military personnel, and low-income individuals still face housing difficulties.
To address the housing issue for the aforementioned groups, contributing to preventing economic decline, promoting production and business activities, stimulating investment and consumption, and ensuring social welfare, at the meeting on March 31, 2009, the Government resolved:. VIEWS AND OBJECTIVES
Part I
1. To accelerate the construction of housing for students (hereinafter referred to as student housing) at universities, colleges, vocational high schools, technical colleges, regardless of whether they are public or private (hereinafter referred to as educational institutions), housing for workers in concentrated industrial zones, export processing zones, and high-tech zones (hereinafter referred to as worker housing in industrial zones), and low-cost housing for low-income individuals facing housing difficulties in urban areas (hereinafter referred to as low-income housing). 
2. The construction of student housing, worker housing in industrial zones, and low-income housing must be integrated with the planning of the network of educational institutions, industrial zone planning, new urban area planning, ensuring synchronized technical infrastructure and social infrastructure to meet the needs of living, studying, daily activities, culture, sports, aiming to create a cultural and healthy living environment that is consistent with overall and detailed urban planning approved by competent state authorities.
3. The construction of student housing, worker housing in industrial zones, and low-income housing must be based on actual needs, in line with the country's socio-economic conditions, and the specific circumstances of each locality; it must be organized and managed according to regulations, ensuring the quality of construction projects, effective management and utilization; transparency and openness must be ensured to prevent loss and waste.
4. Strive to meet the housing needs of approximately 60% of students at educational institutions and 50% of workers in industrial zones by 2015.
MEASURES AND MECHANISMS, POLICIES
Part II
I. ON STUDENT HOUSING
1. Projects for constructing student housing are mainly funded by the State through the national budget (central and local levels), while the State encourages various economic sectors to participate in developing student housing for rent under the socialization policy stipulated in Decree No. 69/2008/NĐ-CP dated May 30, 2008 of the Government on policies to encourage socialization in education, vocational training, healthcare, culture, sports, and environmental protection (hereinafter referred to as Decree No. 69/2008/NĐ-CP).
2. Student housing projects are mainly implemented in a centralized manner, capable of addressing the housing needs of students from several schools or clusters of schools, in accordance with the planning on the relevant territory.
3. Provincial People's Committees (hereinafter referred to as provincial People's Committee) are the agencies responsible for managing student housing projects within their jurisdiction.
The provincial People's Committee assigns the Construction Department or other competent agencies to act as project sponsors for centralized student housing projects. For student housing projects within the premises of educational institutions, the respective institution acts as the project sponsor. Project sponsors may establish a Management Board for student housing projects or entrust local competent agencies to manage the investment and construction process and post-construction operation according to the law.
4. Land for constructing student housing is allocated from land that has been reclaimed and compensated for relocation according to planning; it can also utilize the 20% land quota reserved for social housing in commercial housing projects and new urban areas, and existing land within the premises of educational institutions planned for student housing.
Relocation compensation costs are deducted from land use fees and land rental fees retained by the locality.
5. National budget funds for constructing student housing are raised from government bonds; annual budgets of localities and ministries for education investment.
Student housing projects funded from non-budgetary sources can borrow from preferential state credit and local housing development funds (if available).
6. Design standards and rental prices for student housing:
a) The minimum living space standard for student housing is 4 m
/student; technical and social infrastructure construction indicators in student housing areas follow current construction standards. Student housing development projects can adjust the building density and land use coefficient up to 1.5 times higher than current planning standards, with the number of floors consistent with the construction planning approved by competent authorities.2b) The determination of rental prices for student housing in projects funded by the national budget is regulated by the provincial People's Committee based on the principle of covering only management, operation, and maintenance costs. compared to the current construction planning standards, the number of floors must be consistent with the construction planning approved by the competent authority.
b) The determination of the rent for student housing in projects funded from the state budget shall be stipulated by the provincial People's Committee according to the principle of only covering management, operation, and maintenance costs.
The rent price for student housing projects funded from sources outside the state budget shall be approved by the provincial People's Committee based on the investor's proposal, following the principle that state benefits shall not be included in the rental price and ensuring a maximum fixed profit rate of 10%, with a minimum capital recovery period of 20 years.
c) Students facing difficult circumstances shall be supported by the State to borrow funds to pay for housing rentals according to Decision No. 157/2007/QĐ-TTg dated September 27, 2007, of the Government Prime Minister regarding credit for students and pupils.
7. Investors of student housing projects shall be provided free of charge with model designs, typical designs for housing, as well as scientific and technological advancements in construction and installation to ensure reduced construction costs; they may implement self-execution if they have sufficient capacity as stipulated by law or designate tendering for consulting, construction, and equipment procurement contracts with appropriate cost savings.
8. Investors of student housing projects are permitted to lease or entrust functional units or establish housing service organizations to manage and operate housing funds. Housing management and operation units are allowed to conduct other business services within the residential area to create revenue to offset management and maintenance costs, thereby reducing housing rental prices.
II. ON HOUSING FOR WORKERS IN INDUSTRIAL ZONES
1. Housing projects for workers in industrial zones, invested in and constructed by various economic sectors, shall be leased out through socialization methods.
2. When assigned as the primary investor for infrastructure in industrial zones, the local Industrial Zone Management Board or the enterprise responsible for industrial zone infrastructure development shall concurrently serve as the primary investor for worker housing infrastructure (Primary Investor).
- For industrial zones currently in the formation stage, the project investor for industrial zone infrastructure must organize the determination of housing needs for industrial zone workers, simultaneously organizing the planning and submitting to the competent authority for approval of housing construction plans linked to the industrial zone. After completing the worker housing infrastructure, the Primary Investor may invest in building housing themselves or transfer land, lease already developed land to production enterprises within the industrial zone, or enterprises with housing business functions (Secondary Investors) to construct housing for workers to lease. Compensation and land clearance costs, as well as infrastructure investment costs for worker housing, shall be allocated into the leasing price of land in the industrial zone.
- For established industrial zones, the provincial People's Committee is responsible for reviewing and supplementing the planning, organizing land acquisition, compensation, and clearance to form new land funds or utilizing the 20% land fund designated for social housing construction in commercial housing projects and new urban areas (if consistent with planning) to assign to the local Industrial Zone Management Board, the enterprise responsible for industrial zone infrastructure development, production enterprises within the industrial zone, or enterprises with housing business functions to build housing for workers to lease.
Land clearance compensation costs shall be extracted from land use fees and land lease revenues retained by the locality. When planning worker housing areas, the provincial People's Committee may permit the use of part of the land to build commercial housing to offset land clearance compensation costs for worker housing.
3. Design standards and rental prices for housing for workers in industrial zones
a) The minimum living space standard for housing for workers in industrial zones is designed at 5 square meters/person; technical infrastructure and social infrastructure construction standards in worker housing areas follow current Construction Standards. Worker housing development projects can adjust the construction density and land use coefficient up to 1.5 times higher than current Planning and Construction Standards, without controlling the number of floors, but must be consistent with the construction planning approved by the competent authority.2 b) Rental prices for housing for workers shall be approved by the provincial People's Committee based on the investor's proposal, following the principle that state benefits shall not be included in the rental price and ensuring a maximum fixed profit rate of 10%, with a minimum capital recovery period of 20 years.
4. Investors of housing projects for workers in industrial zones shall enjoy the following preferential mechanisms:
a) Exemption from land use fees and land lease fees within the scope of the project.
b) Application of the highest preferential VAT rate (0%).
c) Exemption from corporate income tax for four years from the date of taxable income, and a 50% reduction in corporate income tax for the next nine years, with an application of a 10% corporate income tax rate throughout the operating period.
d) Enterprises constructing worker housing themselves (without charging rent or charging rent but not exceeding the social housing rental price set by the provincial People's Committee) and enterprises renting housing for workers shall be considered reasonable housing costs (included in production costs) when calculating corporate income tax.

- Preferential loans or interest subsidies as prescribed;
- Loans from the local Housing Development Fund and other preferential loan sources (if available);
- The provincial People's Committee may consider and support partial or full interest payments (depending on the financial capability of each locality).
e) Shall be provided free of charge with model designs, typical designs for housing, as well as scientific and technological advancements in construction and installation to ensure reduced construction costs; they may implement self-execution if they have sufficient capacity as stipulated by law or designate tendering for consulting, construction, and installation contracts.
g) Shall be supported by the State for external infrastructure investment beyond the project boundary (transportation, electricity supply, water supply and drainage).
5. The investors of workers' housing projects are permitted to lease, entrust to units with relevant functions, or establish housing service organizations to manage and operate the housing fund. Units managing and operating the industrial zone housing fund are allowed to conduct other services within the residential area to create revenue to offset management and operation costs, maintenance expenses, thereby reducing housing rental prices.
III. ON LOW-INCOME HOUSING IN URBAN AREAS
1. The State encourages various sectors to participate in investing in constructing housing for sale (in one lump sum or on installment), leasing, or leasing-purchasing for low-income individuals in urban areas through socialization methods. who have not received state support for housing or land in any form.
2. The subjects eligible to purchase, lease, or lease-purchase low-income housing include those receiving salaries from the state budget (civil servants, public officials, civil servants, armed forces personnel) and individuals with low income residing in urban areas who do not have housing or whose average living space per person is less than 5 square meters without having received state support for housing or land in any form.2within the detailed development plans of local residential projects. For commercial housing projects with a scale of 10 hectares or more and new urban area projects, the developer must ensure that at least 20% of the project's residential land fund is allocated for building low-income housing (the proportion of land for low-income housing in each commercial housing project or new urban area must be determined in the detailed construction plan approved by the competent authority). For localities that have already set aside land for social housing construction as specified in Clause 2, Article 20 of Decree No. 90/2006/NĐ-CP dated September 6, 2006, of the Government detailing and guiding the implementation of the Law on Housing (but have not yet commenced social housing construction), if developers (who previously transferred this land to the locality) register to build low-income housing, they shall be returned the land fund to construct low-income housing for lease or lease-purchase.
Individuals purchasing or lease-purchasing low-income housing can borrow funds from commercial banks with state support on interest rates and loan terms to pay for housing purchases (in one lump sum or on installment) or lease-purchase payments.
3. Land reserves for building low-income housing for sale must be allocated in the planning of local urban development projects. Investors of commercial housing projects with a scale of 10 hectares or more and new urban area projects must ensure that at least 20% of the project's residential land area is reserved for building low-income housing (the proportion of land area for each commercial housing project or new urban area project must be determined in the detailed construction planning approved by the competent authority). For localities that already have land reserves for building social housing according to Clause 2, Article 20 of Decree No. 90/2006/NĐ-CP dated September 6, 2006, of the Government detailing and guiding the implementation of the Housing Law (but have not yet commenced construction of social housing), if the investors (who previously transferred these land reserves to the locality) register to build low-income housing, then the land reserve will be returned to the investor to construct low-income housing for rent or lease-purchase. in accordance with current technical infrastructure and social infrastructure standards. Low-cost housing projects may adjust their construction density and land use coefficient up to 1.5 times higher than the current construction planning standards (without limiting the number of floors but consistent with the construction planning approved by the competent authority).
4. Design standards and pricing for low-cost housing
a) Low-income housing is apartment-type housing, with a maximum apartment size not exceeding 70 square meters, meeting current technical infrastructure and social infrastructure standards. Low-cost housing projects may adjust their construction density and land use coefficient up to 1.5 times higher than the current urban planning standards (without controlling the number of floors but in accordance with the urban planning approved by the competent authority).2after paying off the developer (after obtaining the ownership certificate), but it must ensure a minimum period of 10 years from the date of signing the purchase or lease-purchase contract with the project developer.
b) The selling price of low-income housing is set by the project developer based on covering all investment costs (including bank loan interest if applicable), without including state incentives in the selling price, and adding a maximum of 10% of the benchmark interest rate on investment costs.
The rental and lease-purchase prices for low-income housing are set by the project developer based on covering all investment costs, ensuring recovery of the initial investment within a minimum period of 20 years, including bank loan interest (if applicable), management and operation costs, and a maximum of 10% of the benchmark interest rate; state incentives cannot be included in the rental or lease-purchase prices.
The provincial People's Committee is responsible for appraising the selling, rental, and lease-purchase prices of low-income housing and strictly supervising the sale, rental, and lease-purchase of such housing within its jurisdiction.
5. Developers of low-income housing projects are entitled to the following preferential mechanisms:
a) Exemption from land use fees and land rental fees within the scope of the project;
b) Application of the highest preferential VAT rate (0%);
c) Exemption from corporate income tax for four years from the date of taxable income, followed by a 50% reduction in corporate income tax for the next five years, and application of a corporate income tax rate of 10% throughout the operational period. The Ministry of Finance shall provide specific guidance on implementing this provision;
d) Access to investment credit support from the following sources:
- Preferential loans or interest subsidies as prescribed;
- Loans from the local Housing Development Fund and other preferential loan sources (if available);
- Provincial People's Committees may consider and provide partial or full interest subsidies (depending on the financial capacity of each locality).
đ) Provision of free sample designs and typical designs for housing, as well as scientific and technological advancements in construction and installation to ensure reduced construction costs; they may implement self-execution if they have sufficient capacity as stipulated by law or designate tendering for consulting, construction, and installation contracts.
6. Principles for managing low-income housing funds
a) Project developers must sell, lease, or lease-purchase housing to the designated subjects as prescribed by the State.
b) Purchasers or lease-purchasers of low-income housing are permitted to sell or lease the property after fully repaying the developer (after obtaining the ownership certificate), but must ensure a minimum period of 10 years from the date of signing the purchase or lease-purchase contract with the project developer. The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairpersons of provincial and municipal People's Committees directly under the Central Government are responsible for implementing this Resolution./.
c) Within the first 10 years from the contract signing, if the purchaser or lease-purchaser needs to transfer the low-income housing, they can only transfer it to the State, the project developer, or eligible purchasers or lease-purchasers as stipulated by the locality; the transfer price must not exceed the current market price of similar low-income housing. 
Part III
IMPLEMENTATION 
1. The development of housing for student rental must make a breakthrough in 2009. Relevant ministries, sectors, and the People's Committees of Ho Chi Minh City, Hanoi, and some key localities with many students are responsible for completing all procedures to commence construction in 2009, completion in 2010, and approximately 200,000 accommodation places for students by the second quarter of 2011, with total investment capital of about 8 trillion VND from government bonds.
2. Responsibilities of central ministries and sectors:
a) The Central Steering Committee on Housing Policy and Real Estate Market is responsible for assisting the Prime Minister in directing the implementation of the Program constructing student dormitories, industrial zone worker housing, social housing, and low-income housing in accordance with this Resolution.
b) The Ministry of Construction:
- Take the lead and coordinate with relevant ministries, sectors, and provincial People's Committees to develop overall plans and annual investment construction plans for student dormitories, industrial zone worker housing, social housing, and low-income housing for the period of 2009-2015 to be submitted to the Prime Minister for decision in the third quarter of 2009;
- Coordinate with the Ministry of Planning and Investment and the Ministry of Finance in determining needs and developing allocation schemes for government bonds annually and for the period of 2009-2015 to implement the student dormitory construction investment program;
- Directly guide and instruct some key localities (Hanoi City, Ho Chi Minh City, and other localities) as well as some state-owned corporations to pilot the implementation of certain projects for student dormitories, industrial zone worker housing, and low-income housing according to the mechanisms stipulated in this Resolution during the period of 2009-2010;
- Submit to the Prime Minister for issuance of decisions on mechanisms and policies for the development of each type of housing as specified in this Resolution by April 2009; issue guidelines on specific management of investment construction, sales regulations, operation management, and eligible buyers and renters of low-income housing within its authority;
c) The Ministry of Planning and Investment:
- Take the lead and coordinate with the Ministry of Finance and the Ministry of Construction to establish allocation plans for central budget annually and for the period of 2009-2015 to implement the student dormitory construction investment program, to be submitted to the Prime Minister for decision;
- Supplement projects using non-budgetary funds for the construction of student dormitories, rented industrial zone worker housing, and low-income housing into the list of projects eligible for preferential loans from the Government;
d) The Ministry of Finance:
- Allocate government bond capital for the construction of student dormitories according to the plan approved by the Prime Minister;
- Guide the implementation of financial policy incentives related to this Resolution;
- Study and report to the Government to submit to the National Assembly for supplementary tax incentives at the highest level for projects investing in student dormitories, industrial zone worker housing, and low-income housing during the last session of the National Assembly in 2009.
đ) The Ministry of Natural Resources and Environment shall take the lead and coordinate with the Ministry of Construction and localities to review planning and land use plans to supplement land funds for student dormitory, industrial zone worker housing, and low-income housing projects; guide the implementation of land incentives for projects according to this Resolution.
e) The Ministry of Education and Training, the Ministry of Labor, Invalids and Social Affairs, and training-related ministries and sectors shall cooperate with the Ministry of Construction to determine the demand for student housing in training institutions nationwide and in each locality up to 2015 according to the prescribed schedule to serve the preparation of annual and phased investment construction plans for student housing to be submitted to the Prime Minister for consideration and decision.
g) The State Bank shall develop credit policies for lending to those purchasing or renting low-income housing to be submitted to the Prime Minister by June 2009.
3. Provincial People's Committees:
a) Organize and direct the investigation, survey, consolidation of demands, and the development of programs and plans for the construction of student dormitories, industrial zone worker housing, and low-income housing within the jurisdictional area for the period of 2009-2015, to be completed in the second quarter of 2009 and sent to the Ministry of Construction for consolidation and reporting to the Prime Minister for consideration and decision;     
b) Review, adjust, or supplement land funds for the development of student dormitories, industrial zone worker housing, and low-income housing in general and detailed urban planning of the locality (including land reserved for social housing but not yet allocated to construction enterprises for low-income housing); at the same time, it must determine the development indicators for student dormitories, industrial zone worker housing, and low-income housing as one of the basic indicators of the socio-economic development plan of the locality; these indicators must be developed annually and periodically, in line with economic and social conditions, characteristics of each locality, and must be organized for implementation and regulated responsibility according to the provisions;
c) Develop and approve implementation plans for investment construction projects for student dormitories in training institutions (irrespective of the managing agency) for the period of 2009-2015, overall and annual budget estimates (including specific proposals for government bond capital and local budget), to be reported to the Ministry of Construction for consolidation and submission to the Prime Minister by June 2009; d) Prioritize the use of land revenue and rent retained by the locality for compensation, clearance, and creation of land funds for
student dormitories, industrial zone worker housing, and low-income housing within the jurisdictional area; đ) Organize and direct the implementation of the construction investment program
within the jurisdictional area in accordance with the plan and regulations, ensuring quality and preventing waste and corruption; within the jurisdictional area; e) Issue specific regulations within its authority on incentive mechanisms and preferences to call upon economic sectors to participate in developing the fund
; management regulations for the use, exploitation, and operation of the fund within the jurisdictional area;within the jurisdictional area; within the jurisdictional area; g) Reorganize units responsible for managing investment construction for projects
student dormitories and manage the use, exploitation, and operation of the student dormitory fund constructed with state budget funds within the jurisdictional area; h) Organize regular meetings, mid-term reviews, and annual assessments of implementation results, to be reported to the Ministry of Construction for consolidation and reporting to the Prime Minister.
Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, and Chairpersons of provincial-level People's Committees directly under the Central Government are responsible for implementing this Resolution./.
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Resolution./.
