Regulations on Legal Knowledge Training for Traffic Law for Operators of Special Purpose Motorcycles Participating in Road Traffic
Circular No. 06/2011/TT-BGTVT dated March 7, 2011, issued by the Minister of Transport, concerning Legal Knowledge Training for Traffic Law for Operators of Special Purpose Motorcycles Participating in Road Traffic, which took effect from April 21, 2011, has been amended and supplemented by:
1. Circular No. 05/2023/TT-BGTVT dated April 27, 2023, issued by the Minister of Transport, amending and supplementing certain articles of related Circulars pertaining to road transport, road transport support services, vehicles, and drivers, which took effect from June 15, 2023.
2. Circular No. 05/2024/TT-BGTVT dated March 31, 2024, issued by the Minister of Transport, amending and supplementing certain articles of related Circulars pertaining to road transport, road transport support services, vehicles, and drivers, which took effect from June 1, 2024.
On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport,
The Minister of Transport hereby stipulates regulations on Legal Knowledge Training for Traffic Law for Operators of Special Purpose Motorcycles Participating in Road Traffic as follows[1]:
Chapter 1.GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates regulations on Legal Knowledge Training for Traffic Law for Operators of Special Purpose Motorcycles Participating in Road Traffic within the territory of the Socialist Republic of Vietnam.
Article 2. Applicability
1. This Circular applies to agencies, organizations, and individuals related to Legal Knowledge Training for Traffic Law for Operators of Special Purpose Motorcycles Participating in Road Traffic.
2. This Circular does not apply to operators of special purpose motorcycles of the Ministry of National Defense and the Ministry of Public Security used for national defense and security purposes.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Special purpose motorcycles participating in road traffic include construction motorcycles, agricultural and forestry motorcycles moving on roads.
2. The Certificate of Legal Knowledge Training for Traffic Law (hereinafter referred to as the Certificate) is a certificate issued to persons who meet the conditions stipulated in this Circular to operate special purpose motorcycles participating in road traffic.
Chapter 2. TRAINING OF LEGAL KNOWLEDGE ON ROAD TRAFFIC
Article 4. Conditions and Application Materials for Training
1. Conditions for training:
a) Being a Vietnamese citizen or a foreigner residing legally in Vietnam.
b) At least 18 years old.
2. Application materials (one set), including:
a) A request form for Legal Knowledge Training for Traffic Law according to the model prescribed in Appendix 1 of this Circular (original copy);
b)[2] (Repealed)
c) Three color photographs measuring 2 x 3 cm taken within six months, similar to identification cards.
3. Applicants submit application materials at institutions authorized to provide Legal Knowledge Training for Traffic Law.
Article 5. Institutions Providing Legal Knowledge Training for Traffic Law
1. Driving schools.
2. Institutions providing training for operators of special purpose motorcycles must meet the following conditions:
a) A classroom equipped with sufficient teaching materials, simulated road shapes, and a system of road traffic signs as prescribed;
b) Instructors must have a college degree or higher, a teaching qualification certificate, and a driver's license for automobiles.
Article 6. Traffic Law Training Program for Road Transport

Article 7. Responsibilities of Institutions Providing Traffic Law Training
1. Enroll and provide traffic law training according to the program stipulated in this Circular.
2. Report on the establishment of traffic law training classes to the Department of Transportation in accordance with the form prescribed in Appendix 2 of this Circular.
3. Organize examinations, issue Certificates to those who meet the requirements, and prepare examination results records for traffic law training according to the form prescribed in Appendix 3 of this Circular.
4. Record management
a) Maintain a Certificate Issuance Management Register according to the form prescribed in Appendix 4 of this Circular;
b) Store records and related documents concerning training and Certificate issuance.
5. Report on traffic law training activities and Certificate issuance to the Department of Transportation as follows:
a) Examination results for traffic law training and Certificate issuance according to the form prescribed in Appendix 5 of this Circular;
b) Usage of Certificate templates according to the form prescribed in Appendix 6 of this Circular;
c) Collection and utilization of tuition fees in accordance with regulations of the Ministry of Finance.
Chapter 3. ISSUANCE, RENEWAL AND REVOCATION OF CERTIFICATES
Article 8. Certificate and Use of Certificate
1. Certificate template as prescribed in Appendix 7 of this Circular.
2. The Certificate has indefinite validity and can be used throughout the country.
3. When participating in road transport, the driver of specialized motor vehicles must have the following documents:
a) Vehicle registration;
b) Safety technical inspection and environmental protection certificate;
c) A License or Vocational Certificate for Operating Special Purpose Motor Vehicles issued by a vocational training institution;
c) Driving license or Certificate for operating specialized motor vehicles issued by vocational training institutions;
d) Traffic Law Training Certificate or Driver's License for automobiles.
Article 9. Issuance of New Certificate
Within five working days from the date of passing the examination, the head of the institution providing traffic law training shall issue the Certificate to the trainee.
Article 10. Renewal and Reissuance of Certificate
1. Individuals whose Certificates are damaged or lost and whose names are recorded in the storage files at the issuing institution will be reissued according to the Certificate number previously issued.
2. Application dossier for renewal or reissue (one set), including:
b)[3] (Repealed)
a) Application for renewal or reissue of Certificate according to the form prescribed in Appendix 8 of this Circular (original copy);
c) Three color photographs measuring 2x3 cm taken within six months, similar to ID card photos.
3. Submission location for renewal or reissue of Certificate:
a) Original issuing institution;
b) In cases where the original issuing institution is no longer operational, submit to the Department of Transportation managing the original issuing institution.
4. Time limit for renewal or reissue of Certificate:
Within three working days from the date of receiving complete valid application dossiers, the head of the training institution or the Director of the Department of Transportation will renew or reissue the Certificate.
Article 11. Revocation of Certificate
1. Individuals holding a traffic law training Certificate will have their Certificate revoked if they engage in fraudulent behavior or falsify documents as stipulated in this Circular.
Chapter 4. RESPONSIBILITIES OF THE SUPERVISORY AUTHORITY
Article 12. Vietnam Road Administration[4]
1. Organize the implementation of this Circular.
2. Issue training materials on traffic laws for operators of specialized motor vehicles participating in road traffic.
3. Print, issue, and uniformly manage the use of certificate blanks nationwide.
4. Inspect, check, compile, and report to the Ministry of Transport on the work of training knowledge of traffic laws for operators of specialized motor vehicles participating in road traffic nationwide.
Article 13. Department of Transport
1. Implement this Circular within its jurisdiction.
2. Issue and manage the use of certificate blanks in accordance with regulations.
3. Store relevant documents related to the management of training knowledge of traffic laws for operators of specialized motor vehicles participating in road traffic.
4. Organize inspections, checks, compile, and report on the work of training knowledge of traffic laws for operators of specialized motor vehicles participating in road traffic within its jurisdiction.
5. Report to the Vietnam Road Administration[5] on the demand for certificate blanks according to the model specified in Appendix 9 of this Circular. Each January, report to the Vietnam Road Administration[6] on the work of training knowledge of traffic laws for operators of specialized motor vehicles participating in road traffic according to the model specified in Appendix 10 of this Circular.
Article 14. Effective Date
1. This Circular takes effect 45 days from the date of signature and replaces Circular No. 09/2009/TT-BGTVT dated June 24, 2009 issued by the Minister of Transport on the Regulations on Training Knowledge of Traffic Laws for Operators of Specialized Motor Vehicles Participating in Road Traffic.
2. Certificates issued before the effective date of this Circular shall continue to be used.
Article 15. Responsibility for Implementation[7]
The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Vietnam Road Administration[8], Directors of Provincial Transport Departments, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular.

3. Recording method
3.1. At position (1): The certificate number consists of six natural digits in ascending order. The last two characters MT are the registration code specified for provinces and cities in the Circular on the issuance and revocation of registration plates for special-purpose motorcycles participating in road traffic.
3.2. The Certificate uses the Vntime font, with black color for letters and numbers; the full name of the certificate holder uses the VntimeH font in black color.
3.3. Stamps on the Certificate include two stamps: a reduced-size embossed stamp adjacent to the holder's photograph and a red ink stamp placed where the certifying signature is located.

Pursuant to Decree No. 47/2022/ND-CP dated 19 July 2022 of the Government amending and supplementing some articles of Decree No. 10/2020/ND-CP dated 17 January 2020 of the Government stipulating business and business conditions for road passenger transport by motor vehicles;
Pursuant to Decree number 70/2022/NĐ-CP dated September 27, 2022 of the Government amending and supplementing certain provisions of related Decrees concerning business activities in the road sector;
Pursuant to Decree number 47/2022/NĐ-CP dated July 19, 2022 of the Government amending and supplementing certain provisions of Decree number 10/2020/NĐ-CP dated January 17, 2020 of the Government on business and conditional business operations using motor vehicles;
Circular No. 05/2024/TT-BGTVT amending and supplementing some articles of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers, based on the following:
The Minister of Transport promulgates this Circular amending and supplementing certain provisions of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers.
Pursuant to Decree No. 65/2016/ND-CP dated 01 July 2016 of the Government stipulating business conditions for automobile driving training services and driving examination services; Decree No. 138/2018/ND-CP dated 08 October 2018 of the Government amending and supplementing some articles of Decree No. 65/2016/ND-CP dated 01 July 2016 of the Government stipulating business conditions for automobile driving training services and driving examination services; Decree No. 70/2022/ND-CP dated 27 September 2022 of the Government amending and supplementing some articles of Decrees relating to business activities in the road sector;
Circular number 05/2024/TT-BGTVT amending and supplementing certain provisions of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers is based on the following:”
Pursuant to Decree number 65/2016/NĐ-CP dated July 1, 2016 of the Government on conditions for operating automobile driving training services and driving examination services; Decree number 138/2018/NĐ-CP dated October 8, 2018 of the Government amending and supplementing certain provisions of Decree number 65/2016/NĐ-CP dated July 1, 2016 of the Government on conditions for operating automobile driving training services and driving examination services; Decree number 70/2022/NĐ-CP dated September 27, 2022 of the Government amending and supplementing certain provisions of related Decrees concerning business activities in the road sector;
“On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to the Law on Vocational Education dated November 27, 2014;

BASED ON THE GOVERNMENT DECREE NO. 10/2020/NĐ-CP OF JANUARY 17, 2020, REGULATING BUSINESS AND BUSINESS CONDITIONS FOR PASSENGER AND GOODS TRANSPORTATION BY MOTOR VEHICLES; AND THE GOVERNMENT DECREE NO. 47/2022/NĐ-CP OF JULY 19, 2022, AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE GOVERNMENT DECREE NO. 10/2020/NĐ-CP OF JANUARY 17, 2020, REGULATING BUSINESS AND BUSINESS CONDITIONS FOR PASSENGER AND GOODS TRANSPORTATION BY MOTOR VEHICLES;
BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;
At the request of the Director of the Transport Department and the Director General of the Vietnam Highway Administration,
Circular number 05/2024/TT-BGTVT amending and supplementing certain provisions of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers is based on the following:”
[2] THIS POINT IS ABOLISHED IN ACCORDANCE WITH CLAUSE 1, ARTICLE 1 OF THE CIRCULAR NO. 05/2024/TT-BGTVT AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULARS RELATED TO ROAD TRANSPORT SECTOR, SUPPORT SERVICES FOR ROAD TRANSPORT, VEHICLES AND DRIVERS, WHICH SHALL TAKE EFFECT FROM JUNE 1, 2024.

[4] THE PHRASE "VIETNAM TRAFFIC MANAGEMENT AUTHORITY" IS REPLACED WITH THE PHRASE "VIETNAM HIGHWAY ADMINISTRATION" AS PROVIDED IN CLAUSE 1, ARTICLE 2 OF THE CIRCULAR NO. 05/2023/TT-BGTVT AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULARS RELATED TO ROAD TRANSPORT SECTOR, SUPPORT SERVICES FOR ROAD TRANSPORT, VEHICLES AND DRIVERS, WHICH SHALL TAKE EFFECT FROM JUNE 15, 2023.
[5] THE PHRASE "VIETNAM TRAFFIC MANAGEMENT AUTHORITY" IS REPLACED WITH THE PHRASE "VIETNAM HIGHWAY ADMINISTRATION" AS PROVIDED IN CLAUSE 1, ARTICLE 2 OF THE CIRCULAR NO. 05/2023/TT-BGTVT AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULARS RELATED TO ROAD TRANSPORT SECTOR, SUPPORT SERVICES FOR ROAD TRANSPORT, VEHICLES AND DRIVERS, WHICH SHALL TAKE EFFECT FROM JUNE 15, 2023.
[6] THE PHRASE "VIETNAM TRAFFIC MANAGEMENT AUTHORITY" IS REPLACED WITH THE PHRASE "VIETNAM HIGHWAY ADMINISTRATION" AS PROVIDED IN CLAUSE 1, ARTICLE 2 OF THE CIRCULAR NO. 05/2023/TT-BGTVT AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULARS RELATED TO ROAD TRANSPORT SECTOR, SUPPORT SERVICES FOR ROAD TRANSPORT, VEHICLES AND DRIVERS, WHICH SHALL TAKE EFFECT FROM JUNE 15, 2023.
[7] ARTICLE 24 OF THE CIRCULAR NO. 05/2023/TT-BGTVT AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULARS RELATED TO ROAD TRANSPORT SECTOR, SUPPORT SERVICES FOR ROAD TRANSPORT, VEHICLES AND DRIVERS, WHICH SHALL TAKE EFFECT FROM JUNE 15, 2023, PROVIDES AS FOLLOWS:
“Article 24. Implementation Provisions
1. THIS CIRCULAR SHALL TAKE EFFECT FROM JUNE 15, 2023.
2. THE HEAD OF THE MINISTRY’S OFFICE, THE HEAD OF THE MINISTRY’S INSPECTION DEPARTMENT, THE DIRECTORS OF THE MINISTRY’S DEPARTMENTS, THE DIRECTOR OF VIETNAM HIGHWAY ADMINISTRATION, THE DIRECTORS OF PROVINCE TRANSPORT DEPARTMENTS, AND THE HEADS OF ORGANIZATIONS AND INDIVIDUALS ASSOCIATED THEREWITH ARE RESPONSIBLE FOR IMPLEMENTING THIS CIRCULAR./”
ARTICLE 6 OF THE CIRCULAR NO. 05/2024/TT-BGTVT AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULARS RELATED TO ROAD TRANSPORT SECTOR, SUPPORT SERVICES FOR ROAD TRANSPORT, VEHICLES AND DRIVERS, WHICH SHALL TAKE EFFECT FROM JUNE 1, 2024, PROVIDES AS FOLLOWS:
“Article 6. Implementation Provisions
1. THIS CIRCULAR SHALL TAKE EFFECT FROM JUNE 1, 2024.
2. THIS CIRCULAR REPEALS: ANNEX 24 OF THE CIRCULAR NO. 38/2019/TT-BGTVT OF OCTOBER 8, 2019, ISSUED BY THE MINISTER OF TRANSPORTATION AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE CIRCULAR NO. 12/2017/TT-BGTVT OF APRIL 15, 2017, ISSUED BY THE MINISTER OF TRANSPORTATION REGULATING TRAINING, TESTING, AND ISSUING MOTOR VEHICLE DRIVER LICENSES.
3. Transitional Provisions
a) FOR TRAINING COURSES ENROLLED PRIOR TO THE EFFECTIVE DATE OF THIS CIRCULAR, TRAINING INSTITUTIONS SHALL CONTINUE TO CONDUCT TRAINING IN ACCORDANCE WITH THE PROVISIONS OF THE CIRCULAR NO. 12/2017/TT-BGTVT (AMENDED AND COMPLEMENTED BY THE CIRCULARS NO. 38/2019/TT-BGTVT, NO. 01/2021/TT-BGTVT, NO. 04/2022/TT-BGTVT, AND NO. 05/2023/TT-BGTVT).
b) APPLICANTS WHO MISSED OR FAILED THE TESTS TO OBTAIN A DRIVER LICENSE BEFORE THE EFFECTIVE DATE OF THIS CIRCULAR AND REGISTER FOR A LICENSE TEST AFTER THE EFFECTIVE DATE OF THIS CIRCULAR SHALL BE EVALUATED AND TESTED IN ACCORDANCE WITH THE PROVISIONS OF THIS CIRCULAR.
c) APPLICANTS WHO HAVE ATTENDED FIRE PREVENTION, FIRE FIGHTING, AND RESCUE TRAINING IN COURSES TO OBTAIN THEIR CURRENT LICENSES SHALL HAVE THEIR RESULTS RETAINED (NO NEED TO REPEAT THE TRAINING).
d) IN CASE THE AUTHORIZED BODY IS UNABLE TO ELECTRONICALLY VERIFY THE IDENTITY OF AN ORGANIZATION OR CITIZEN DUE TO ERRORS IN THE ELECTRONIC IDENTIFICATION SYSTEM, SUCH ORGANIZATIONS AND INDIVIDUALS SHALL SUBMIT ONE OF THE FOLLOWING VALID DOCUMENTS WHEN PERFORMING ADMINISTRATIVE PROCEDURES: A COPY OF THE BUSINESS REGISTRATION CERTIFICATE, A COPY OF THE NATIONAL IDENTITY CARD, A COPY OF THE IDENTITY CARD, OR A COPY OF THE PASSPORT.
4. THE HEAD OF THE MINISTRY’S OFFICE, THE HEAD OF THE MINISTRY’S INSPECTION DEPARTMENT, THE DIRECTORS OF THE MINISTRY’S DEPARTMENTS, THE DIRECTOR OF VIETNAM HIGHWAY ADMINISTRATION, THE DIRECTORS OF PROVINCE TRANSPORT DEPARTMENTS AND PROVINCE TRANSPORT AND URBAN DEVELOPMENT DEPARTMENTS, AND THE HEADS OF ORGANIZATIONS AND INDIVIDUALS ASSOCIATED THEREWITH ARE RESPONSIBLE FOR IMPLEMENTING THIS CIRCULAR./”
[8] THE PHRASE "DIRECTOR OF VIETNAM TRAFFIC MANAGEMENT AUTHORITY" IS REPLACED WITH THE PHRASE "DIRECTOR OF VIETNAM HIGHWAY ADMINISTRATION" AS PROVIDED IN CLAUSE 2, ARTICLE 2 OF THE CIRCULAR NO. 05/2023/TT-BGTVT AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULARS RELATED TO ROAD TRANSPORT SECTOR, SUPPORT SERVICES FOR ROAD TRANSPORT, VEHICLES AND DRIVERS, WHICH SHALL TAKE EFFECT FROM JUNE 15, 2023.
[9] THIS ANNEX IS REPLACED IN ACCORDANCE WITH CLAUSE 2, ARTICLE 1 OF THE CIRCULAR NO. 05/2024/TT-BGTVT AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULARS RELATED TO ROAD TRANSPORT SECTOR, SUPPORT SERVICES FOR ROAD TRANSPORT, VEHICLES AND DRIVERS, WHICH SHALL TAKE EFFECT FROM JUNE 1, 2024..
