PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 76/2001/NĐ-CP dated October 22, 2001 of the Government on tobacco production and trading activities;

Considering the proposal of the Ministry of Industry in the report No. 773/CV-KHĐT dated March 6, 2002, Circular No. 3971/CV-KHĐT dated October 9, 2002, and the opinions of the Ministries of Finance, Planning and Investment, Home Affairs, and People's Committees of the provinces and cities: Ho Chi Minh City, Hai Phong, Phu Yen, Ben Tre, Binh Duong, Khanh Hoa, Dong Nai.

DECISION:

Article 1. Approving the project on organizing and restructuring the tobacco industry in accordance with the provisions of Government Decree No. 76/2001/NĐ-CP dated October 22, 2001 on tobacco production and business activities, as follows:

1. Entrusting the Board of Directors of Vietnam Tobacco Corporation to continue implementing the reorganization of state-owned enterprises under the Corporation in accordance with Government Decree No. 76/2001/NĐ-CP dated October 22, 2001 and related regulations.

2. Entrusting the People's Committees of the provinces and cities: Ho Chi Minh City, Hai Phong, Khanh Hoa, Dong Nai, Binh Duong to directly manage tobacco manufacturing enterprises in accordance with Government Decree No. 76/2001/NĐ-CP and related regulations, including:

- Khanh Viet Joint Stock Company (Khanh Hoa Province).

- Ben Thanh Tobacco Company (Ho Chi Minh City).

- Company 27-7 (Ho Chi Minh City). - Dong Nai Tobacco Company (Dong Nai Province).

- Binh Duong Tobacco and Import-Export Company (Binh Duong Province).

- Hai Phong Tobacco Company (Hai Phong City).

3. Entrusting the People's Committee of Ben Tre Province to cooperate with relevant ministries and sectors to develop a plan for merging the Ben Tre Tobacco Factory into Vietnam Tobacco Corporation by 2004.

4. The Ministry of Trade shall direct the cessation of cigarette production by Bach Ho II Company from January 1, 2003.

5. Entrusting the People's Committees of Nghe An and Phu Yen Provinces to cooperate with the Ministry of Industry and related ministries and sectors to cease cigarette production from January 1, 2003, for the following enterprises:

- Nghe An Tobacco Factory (Nghe An Province),

- Tuy Hoa Tobacco Trading and Processing Joint Stock Company (Phu Yen Province).

At the same time, continue to reorganize these enterprises in accordance with current regulations.

6. The Ministry of Planning and Investment shall coordinate with the People's Committee of Can Tho City to inspect the implementation of the license for the VINASA Tobacco Production Joint Venture in Can Tho according to the Law on Foreign Investment in Vietnam; if not implemented in accordance with the license, revoke the license.

Article 2. This Decision shall take effect from the date of signing.

The Ministers of Finance, Planning and Investment, Industry, and Trade; the Chairpersons of the People's Committees of the provinces and cities: Ho Chi Minh City, Hai Phong, Can Tho, Da Nang, Nghe An, Thua Thien Hue, Khanh Hoa, Phu Yen, Dong Nai, Binh Duong, Ben Tre, and the Chairman of the Board of Directors of Vietnam Tobacco Corporation are responsible for enforcing this Decision.
