THE MINISTER OF EDUCATION AND TRAINING

N ||| - BASED on Decree No. 19-CP dated January 29, 1966 and Decree No. 06-CP dated January 7, 1971 of the Council of Ministers stipulating the tasks, powers, and organizational structure of the Ministry of Education.

Article 1- N ||| NOW hereby promulgates attached to this decision the "Provisional Regulations on the Management of Teaching Aids" to be implemented from the 1971-1972 academic year.

Article 2- N ||| The heads of the Office, the head of the School Equipment Company, the Directors of the Planning and Finance Department, the Cadre Organization Department, the Primary General Education Department, the Secondary General Education Department, the Kindergarten Department, the Supplementary Education Department, the Training and Development Bureau, the directors of the Departments of Education, and the heads of the Educational Services are responsible for enforcing this decision.

 

TEMPORARY PROVISIONS
N ||| MANAGEMENT OF TEACHING AIDS

N ||| (PROMULGATED ACCOMPANYING DECISION NO. 182-QĐ ON MARCH 18, 1972)

N ||| Teaching aids are one of the important means that help teachers improve teaching quality and help students enhance their learning quality, having a significant impact on the implementation of educational goals at schools.

N ||| These items are common assets, partly provided by the State and partly made by teachers and students themselves, and need to be managed well.

N ||| The Ministry of Education issues these regulations to define the responsibility system, address corruption and waste phenomena, and to ensure that the management of teaching aids in schools and at all levels of educational administration becomes more systematic.

PART I
GENERAL PRINCIPLES

Article 1- N ||| Teaching aids include: machinery, experimental equipment, models, specimens, chemicals, pictures, maps, film projectors, sports equipment, musical instruments, art tools, labor tools, kindergarten toys... serving teaching and learning activities in classrooms, laboratories, workshops, school gardens, traditional rooms, and outdoor areas.

N ||| Teaching aids are state assets entrusted to schools for management. Therefore, regardless of the source of funding, whether they are self-made by teachers and students or donated, they must be managed properly.

Article 2- N ||| All teachers, staff, and employees of schools and all levels of educational administration have the responsibility to manage teaching aids according to the current state asset management system. Individuals and units with outstanding achievements should be rewarded, while those with shortcomings should be disciplined appropriately, strictly, and promptly.

Article 3- N ||| To ensure the management of all types of teaching aids, all levels of educational administration must regularly inspect and urge schools to properly store and use teaching aids, provide schools with necessary means to store teaching aids, and simultaneously enhance the sense of responsibility among all cadres and teachers.

 

PART II
N ||| SPECIFIC PROVISIONS ON THE MANAGEMENT OF TEACHING AIDS
N |||

Article 4 - N ||| Teacher training colleges, teacher training centers, concentrated supplementary education schools, secondary and junior high schools must have laboratories and teaching aid rooms. Primary schools must have teaching aid rooms.

N ||| Departments of Education must have warehouses to store teaching aids that have not yet been distributed to schools. Laboratories, teaching aid rooms, and warehouses must be tiled-roofed rooms.

Article 5- N ||| Laboratories, teaching aid rooms, and warehouses for teaching aids must have sufficient storage facilities such as cabinets, shelves, boxes... moisture-proofing, termite-proofing, fire-fighting equipment.

N ||| To store precision machines and equipment (optical equipment, measuring devices...), toxic substances that are flammable and explosive, appropriate technical means must be provided.

N ||| When distributing teaching aids to schools, especially precision equipment, complete manuals and machine histories must be included.

Article 6 - N ||| Schools must maintain asset registers for teaching aids and borrowing records. Departments of Education must keep track of the issuance, distribution, and allocation of various types of teaching aids.

N ||| These records must be accurately recorded, timely, carefully maintained, and fully handed over when the responsible personnel change.

Article 7 - N ||| Teaching aids must be inventoried twice a year: at the beginning of the academic year and before summer break. In addition to regular inventory checks, extraordinary inventories must also be conducted in the following situations:

N ||| - When the principal, laboratory assistant, or teaching aid supervisor changes.

N ||| - When schools merge or split.

N ||| - When losses or damages occur due to natural disasters, enemy attacks, or theft.

N ||| - When required by the competent educational and financial authorities.

Article 8 - N ||| Each school and each teacher must plan to utilize existing teaching aids for teaching, learning, research, and scientific dissemination. It is not allowed for teaching aids to exist but for teachers to teach without them.

N ||| Schools need to be adequately funded to purchase materials necessary for experiments, demonstrations, and practical exercises.

Article 9 - N ||| Teaching aids can only be used for common school purposes and must not be lent to individuals privately. For experimental equipment assigned to one school but designated for shared use with another school, both schools must negotiate to establish appropriate usage rules.

Article 10- N ||| Unauthorized transfer of teaching aids to other units or individuals is prohibited. When authorized by the competent authority, a handover record must be established, detailing the name of the equipment, quantity, current condition, along with manuals and machine histories.

N ||| Teaching aids currently allocated that do not meet the Ministry's standards should be reallocated to other schools.

Article 11 - N ||| Teaching aids that are irreparably damaged may be requested to be scrapped. The principal invites the school council to convene and confirm, establishing a record requesting higher-level approval. At the Department level, the Director and Head of Education will form a committee including the Chief Accountant to confirm and decide on scrapping.

Article 12. Teachers must be thoroughly instructed on how to properly store and use teaching aids for their subjects and grade levels, especially those that are precise instruments that are difficult to maintain and operate.

Students at teacher training schools must study methods for storing and using teaching aids for the subjects and grades they will teach in the future.

 

CHAPTER III
IMPLEMENTATION

Article 13 - The Director of the Department, the Head of the Bureau, and the Head of the County, City, or Ward Education Office are responsible for managing all teaching aids within their jurisdiction according to this regulation. Specifically, they are required to:

- Develop annual and long-term plans for equipping all schools under their unit to meet the equipment standards set by the Ministry of Education.

- Organize the procurement of teaching aids to ensure timely and accurate distribution according to the standards and target groups.

- Direct schools under their unit to manage and use teaching aids effectively, adjust the allocation of teaching aids between schools reasonably, and direct schools to produce and purchase teaching aids themselves.

- Provide training for teachers on making, maintaining, and using teaching aids.

- Reward or penalize units and individuals who have achieved results or committed violations in managing teaching aids.

Article 14 - The Principal is responsible for organizing the management of all teaching aids at the school according to this regulation. Specifically, they are required to:

- Inspect and urge staff, teachers, and students to properly store teaching aids and necessary facilities such as rooms, cabinets, shelves, and records, organize regular inventory checks, and arrange repairs for damaged equipment.

- Inspect and urge staff, teachers, and students to use teaching aids effectively, propose the cancellation or reallocation of teaching aids when necessary.

- Plan and implement measures to continuously improve the completeness of teaching aids at the school, organize self-production and additional purchases through labor savings and thrift, and request additional distribution of missing items.

- Based on this regulation, establish specific rules for managing teaching aids suitable for each school.

- Depending on the severity, decide or recommend rewards or disciplinary actions for individuals and units with achievements or violations.

Article 15- Teacher training schools, teacher refresher schools, concentrated cultural supplementary schools, secondary general education schools, and junior high schools with 13 classes or more must appoint an experimental assistant. If there is no experimental assistant, a teacher can temporarily be assigned to both teaching and laboratory management duties. Junior high schools with fewer than 13 classes may assign two or three teachers to perform these dual roles.

In cases of extreme difficulty, based on the actual work of each school, two to three teachers can be assigned to both teaching and laboratory management duties.

These teachers are exempted from 3 to 5 hours of teaching per week. Subject-specific laboratory teachers are exempted from 2 hours per week (Circular No. 46-TT dated October 24, 1962 of the Ministry of Education).

For primary general education schools and kindergartens, it is necessary to assign a teacher to both teaching and educational equipment management tasks. Principals should create conditions for this teacher to fulfill their assigned tasks while teaching a minimum number of hours.

Article 16 - Departments and Bureaus of Education need to assign a leading cadre from the Department or Bureau to be responsible and at least two to three specialized cadres for educational equipment management.

AT Departments and Bureaus with better conditions should establish a department with more personnel to handle this task. At county, city, and ward education offices, specialized personnel should be assigned to manage educational equipment or two to three cadres should be temporarily assigned to concurrently handle this task.

Article 17 - Experimental assistants and teachers responsible for equipment have the responsibility to:

- Safeguard all teaching aids available at the school.

- Contribute to producing additional teaching aids and assist teachers in preparing aids for demonstration and practical exercises.

- Maintain records and files about teaching aids, recording them fully and promptly.

- Conduct inventory checks on teaching aids according to deadlines and principles.

Article 18 - Cadres responsible for educational equipment management at Departments, Bureaus, and county offices, as well as laboratory assistants and teachers responsible for laboratory and teaching aid rooms, must be selected based on their professional expertise and sense of responsibility to enhance the management of teaching aids.

These cadres are provided with safety equipment as stipulated in Circular No. 12-TT dated August 14, 1968 of the Ministry of Education. Depending on specific circumstances, they may receive additional compensation for working in hazardous environments (Circular No. 2-TTG dated January 6, 1963 of the Prime Minister's Office).

 

PART IV
REWARD AND DISCIPLINE

Article 19 - Units and individuals who achieve results in storing and using teaching aids, in producing teaching aids themselves, or in preventing waste and theft of teaching aids will be recognized and rewarded by educational management authorities or recommended for rewards by local administrative committees at various levels.

Article 20 - Units and individuals who lack a sense of responsibility, violate labor discipline, causing damage or loss of teaching aids, resulting in state property losses, must compensate the public treasury according to the material liability system issued in Decree No. 49-CP dated April 9, 1968 of the Council of Ministers and Circular No. 128/TT-LB dated July 24, 1968 of the Ministry of Finance - Labor - General Confederation of Trade Unions.

In addition to compensating for losses, violators may also face administrative disciplinary actions.

Cases of embezzlement, misappropriation, or severe damage to state property will be prosecuted under the Ordinance on Punishing Crimes Against Socialist Property issued pursuant to Decree No. 149-LCT dated October 23, 1970 of the President of the Democratic Republic of Vietnam.

 

CHAPTER V
IMPLEMENTING PROVISIONS

Article 21 - This regulation shall be implemented in all teacher training schools, teacher refresher schools, cultural supplementary schools, general education schools at all levels, and kindergartens managed by Departments and Bureaus of Education.

1. Inspect and supervise the Credit Fund's operations in accordance with the law; This regulation must be disseminated down to individual schools. The School Equipment Company has the responsibility to provide detailed guidance on the implementation of this temporary regulation.
