Considering the report of the Ministry of Water Resources (No. 2729/TT-KH dated December 17, 1994) requesting approval of the feasibility study project "Restoration and development of water resources in the central region and Ho Chi Minh City" and the appraisal opinion of the State Appraisal Council (Circular No. 764/UB-VPTĐ dated March 15, 1995 of the State Planning Commission);

Pursuant to the Government Organization Law dated September 30, 1992;
The project "Restoration and development of water resources in the central region and Ho Chi Minh City" with the following contents:
DECISION:
Article 1. 1- Project name: "Restoration and development of water resources in the central region and Ho Chi Minh City".
2- Objectives of the project: To restore and upgrade five existing irrigation systems (Cam Thuy, Nam Nghe An, Linh Cam, An Trach, Dong Cam); and to invest in two large-scale irrigation works currently under construction (Thach Nam, Hoc Mon - Bac Binh Chanh) to maintain a stable irrigation capacity of 70,000 hectares, including an additional irrigated area of 32,600 hectares compared to before the project.
3- Scope and scale of the project: The project includes seven sub-projects of seven irrigation systems in seven provinces:
- Cam Thuy system in Thanh Hoa province,
- Nam Nghe An system in Nghe An province,
- Linh Cam system in Ha Tinh province,
- An Trach system in Quang Nam - Da Nang province,
- Dong Cam system in Phu Yen province,
- Thach Nam system in Quang Ngai province,
- Hoc Mon - Bac Binh Chanh system in Ho Chi Minh City.
4- Investment capital for the project:
- Total investment capital: 121 million 629 thousand USD,
World Bank loan amounting to 81 million 80 thousand USD (excluding the investment loan for irrigation canals in areas less than 150 hectares).
Where:
- Domestic counterpart funds will cover the remaining portion.
The investment capital for each work will be officially determined when considering the feasibility decision for each sub-project (with the foreign capital being the ceiling).
5- Construction of works and procurement of equipment must be carried out through bidding to save materials, funds, and improve the quality of the works.
6- Based on the Land Law and current regulations, the People's Committees of localities shall coordinate with the Ministry of Water Resources to resolve resettlement issues in areas affected by the project according to the first phase resettlement plan submitted by the Ministry of Water Resources in Circular No. 345/CV-KH dated March 8, 1995 and No. 2357/CV-KH dated November 3, 1994.
7- Maximum implementation time for the project: 5 years from the date of funding allocation.
Division of tasks.
Article 2. 1- The State Planning Commission shall allocate the owner of the Ministry of Finance, the Ministry of Water Resources, and related sectors to balance the capital for the project.
2- The Ministry of Finance shall be responsible for balancing the budget to provide counterpart funding for the project according to the approved feasibility study, and repay the loan for the project on schedule as committed internationally.
3- The Ministry of Water Resources, as the project manager, shall have the responsibility: Based on the approved feasibility study, direct the preparation of the detailed feasibility study, conduct reviews in accordance with the investment and construction management regulations, and ensure that the total private capital is clearly defined as stated in Clause 4 of Article 1 of this Decision.
Organize project management, direct technical and construction activities to ensure quality, timely progress, compliance, and efficiency, thereby determining the calculation process to use effectively.
4- The People's Committees of provinces and cities where the sub-projects are located shall be responsible for coordinating with the Ministry of Water Resources and the Ministry of Finance to prepare counterpart funds to start the synchronous construction of field works, organize resettlement, and ensure the completion and effective operation of the system.
This Decision takes effect from the date of signature; the Minister of Water Resources, the Ministers of relevant ministries, the heads of agencies equivalent to ministries, the heads of government-affiliated agencies, and the Chairmen of the People's Committees of provinces and cities concerned shall be responsible for implementing this Decision./.
